Metodologias ativas e educação universitária: grupos operativos no combate aos estereótipos de gênero e à violência contra a mulher

This article aims to report and discuss the experience with the use of the active methodology of the operating groups withuniversitystudentsoftheLawCourseofFAESACentroUniversitário.Thetechniqueoftheoperativegroupswaschosendue to the understanding that the theme to be worked with students, the fight against gender stereotypes and violenceagainst women, presents itself as a daily challenge in social coexistence in all human spaces. Several contextualized activitieswere carried out, privileging the personalization, experimentation and whenever possible the use of technology, allowingthestudentsaspaceofprotagonisminthediscussionsandreflectionsontheproposedtheme.Theresultsdemonstratedthatthe operative groups are adequate for the discussion and approach of complex themes and multicausal social phenomena,facilitatingnotonlythelearningofconceptsbutalsopromotingchangesofattitude.

Migraciones y fronteras en la época del fetichismo de la ley/ Migrations and borders in the age of the fetishism of the law

En este artículo revisamos diversos aspectos que caracterizan a las migraciones y los desplazamientos humanos en la actualidad. Vemos cómo en diversas latitudes se repiten escenarios de violencias múltiples y complejas, que afectan a las personas y a los países. Con base en el trabajo de campo desarrollado en Tijuana, en la frontera de México con Estados Unidos, reflexionamos sobre el papel de la ley y la seguridad en la conformación de esos escenarios violentos. Así, nos proponemos cuestionar la ambigüedad de la ley y de los discursos de seguridad, intentando aportar a una visión en la que el derecho pueda coexistir con una cultura de sentimientos favorables a la convivencia humana y social diversa.
 Abstract
 In this paper, we review various aspects that characterize migrations and human displacement today. We see how, in different latitudes, scenarios of multiple and complex violence are repeated. Based on fieldwork developed in Tijuana, on the border of Mexico with the United States, we reflect on the role of law and security in shaping those violent scenarios. In this way, we propose to question the ambiguity of the law and security discourses, trying to contribute to a vision in which the law is in conformity with a culture of feelings favorable to the human and social diverse coexistence.

<p>W procesie socjalizacji dziecko uczy się podstaw interakcji społecznych, życia i funkcjonowania w grupie, poznaje społeczne normy postępowania i zachowania, kształtuje swoją osobowość i cechy charakteru. Jednym z najważniejszych zakresów tego rozwoju jest przygotowanie do pełnienia ról kobiety i mężczyzny. W procesie socjalizacji dzieci w zakresie kształtowania ról rodzajowych istotną rolę odgrywa przedszkole. Opisane badania dotyczą interakcji między nauczycielkami a wychowankami w przedszkolu oraz ich wpływu na kształtowanie płci społeczno-kulturowej (rodzaju) dzieci.</p>

El incumplimiento de la obligación atribuible a imposibilidad de ejecutar la prestación por una causa no imputable al deudor, en el sistema de responsabilidad del Código Civil boliviano vigente desde 1976

El presente trabajo aborda una cuestión central del Derecho Civil, como es el incumplimiento de la obligación, que ciertamente es un hecho conflictivo que afecta la convivencia social. Específicamente considerando que, en virtud del artículo 339 del Código Civil boliviano,el deudor no es responsable del incumplimiento si prueba la “imposibilidad de ejecutar la prestación por una causa que no le es imputable”. El objetivo es precisar el significado y presupuestos de aplicación de esta expresión genérica que engloba numerosos hechosy no cuenta con una noción legislativa. Para lograr este propósito, se utiliza doctrina italiana actual y precedentes judiciales allí citados, en razón de que nuestro artículo 339, prácticamente, tiene igual redacción que el artículo 1218 del Código Civil italiano de 1942, fuente principal del Código Civil boliviano vigente desde el 2 de abril de 1976. De esta manera, se aporta al estudio del Derecho Civil nacional y se evidencia la utilidad del Derecho Comparado y la excelencia del Código fuente; haciéndonos reflexionar sobre la suma cautela que se debe tener frente a la necesaria reforma civil en Bolivia para evitar retrocesos en la materia.

ФІНАНСОВИЙ ОМБУДСМЕН І ЙОГО РОЛЬ У ПИТАННЯХ ЗАХИСТУ ПРАВ СПОЖИВАЧІВ НА СТРАХОВОМУ РИНКУ ПОЛЬЩІ

Досліджено етимологію терміна «омбудсмен», розкрито особливості діяльності інституту фінансового омбудсмена в Польщі. Проаналізовано генезис становлення установи і встановлено фактори, які сприяли його появі. Окреслено особливості фінансування інституції Rzecznika Finansowego, визначено сучасні тенденції щодо опрацювання звернень від клієнтів страхових компаній. Означено роль фінансового омбудсмена в розвитку фінансового ринку Польщі. Сформовано перелік пропозицій щодо вдосконалення норм законопроекту України «Про установу фінансового омбудсмена», виходячи з позитивного польського досвіду.Доведено, що місією функціонування інституту фінансового омбудсмена в Польщі є вжиття заходів у сфері захисту клієнтів суб’єктів фінансового ринку, представлення їхніх інтересів при застосуванні положень нормативно-правових актів згідно з принципами соціального співіснування.Вивчено структуру бюро фінансового омбудсмена Польщі, яке працює під безпосереднім керівництвом омбудсмена і складається з департаментів: клієнта страхового та пенсійного ринків; клієнта банківського ринку і ринку капіталу; позасудового врегулювання спорів; адміністративно-фінансового.У ході проведеного аналізу виокремлено дві основні моделі поведінки фінансового омбудсмена Польщі: втручання, головною метою якого є підтримка клієнтів у суперечці, і медіація — урегулювання спорів шляхом укладення мирової угоди. Проведено моніторинг кількості страхових скарг, що надійшли до офісу страхового. І фінансового омбудсмена Польщі, та відсотка їх задоволення фінансовими установами протягом 1995—2017 років.Дослідження було ініційовано групою науковців у рамках організації та проведення міжнародної конференції «Інститут фінансового омбудсмена — український погляд на польський досвід» на базі Краківського економічного університету і містить сучасний аналіз найбільш важливих питань, які стосуються відносин між фінансовим омбудсменом Польщі, страховими компаніями і споживачами страхових послуг. На основі опрацьованого позитивного польського досвіду діяльності інституту фінансового омбудсмена було підготовлено перелік пропозицій з удосконалення норм проекту Закону України «Про установу фінансового омбудсмена».

Retorno à Sociedade: Percepções e Experiências de Ex-Detentas

Esta pesquisa teve por objetivo identificar a percepção de ex-presidiárias sobre o retorno à vida social e à vida profissional, sobre suas impressões quando da detenção e sobre suas relações com a família e a sociedade. Para isso, foi feita entrevista semiestruturada com cinco mulheres atendidas pelo CRAS (Centro de Referência de assistência Social) do município de Criciúma que já cumpriram a pena e hoje vivem em liberdade. Foi possível identificar que algumas mulheres sofreram discriminações por serem ex-presidiárias, corroboradas por morarem em bairros com alto índice de criminalidade. E, ainda, foi identificado que suas experiências punitivas durante o momento de detenção não as prepararam para retorno a sociedade. Com isso, conclui-se que a falta de programas de ressocialização para o retorno ao convívio social e reingresso no mercado de trabalho dificultam a reinserção social destas mulheres. Sugere-se que uma nova pesquisa seja realizada com maior grupo de participantes e também com seus familiares, para melhor compreensão da temática.

El arbitraje y la mediación, más que propuestas, una necesidad para el acceso a la justicia en materia de propiedad intelectual

El acceso y la impartición de justicia mediante el debido proceso en materia de propiedad industrial como en cualquier otra materia es sin lugar a dudas una de las responsabilidades más importantes que tienen los Estados. Lo anterior no sólo y exclusivamente como una función necesaria para garantizar una sana convivencia social, sino también para garantizar un entorno de seguridad y certeza jurídica a la actividad económica de un país como México.Por ello el trabajo de éstos debe consistir en fomentar el conocimiento de la ley y la confianza en las instituciones de procuración e impartición de justicia implementando la tecnología y los mecanismos alternativos de solución de controversias, para de esta forma procurar una impartición de justicia pronta y expedita.

Angehörige oder Zugehörige? – Versuch einer Begriffsanalyse

Societal change has an impact on social coexistence and it is associated with pluralisation of family patterns, altered kinship relations and a greater significance of friendship relations. This is also reflected in familial situations with occurring care needs and the professional carers' perception of these developments has found its linguistic equivalent in terms like 'relatives' or 'Zugehörige'. These and further terms used in nursing communication will be explored in this article. The objective of this article is to determine the meanings of terms used in German-speaking nursing literature for close persons of care receivers. For this purpose an explicating content analysis was conducted and etymological, juridical and social-scientific definitions were compared to the apprehension of professional care givers. The findings show a wide range of terminology combined with a varying comprehension of these terms challenging their appropriateness for professional nursing communication. Based on these findings a definition of the concept 'relatives' is brought up for discussion as an attempt to contribute to a more coherent intraprofessional comprehension.

Una reflexión sobre la labor social en pacientes con trastorno antisocial de la personalidad

Introducción: El trastorno antisocial de la personalidad está vinculado a la clasificación de trastornos de la personalidad en la salud mental. Este diagnóstico se les otorga a personas que presenten rasgos de personalidad específicos e inflexibles que afectan su funcionalidad y en los que no se encuentra otra causa médica aparente. Existen diversos tratamientos posibles para estos pacientes y cuyo manejo debe ser individualizado según su edad y progresión de los rasgos de personalidad. Este trastorno genera un impacto adicional a la comunidad debido a su relación con conductas delictivas e inapropiadas de los pacientes con este diagnóstico, convirtiéndolo en un asunto de interés para la convivencia social. Objetivo: Reflexionar acerca del rol de la sociedad en la prevención, inclusión y manejo de pacientes con trastorno antisocial de la personalidad. Discusión: Conociendo las variables involucradas en el desarrollo de trastornos de personalidad como el antisocial, además del impacto social que genera la expresión de dichos síntomas en la comunidad, se hace necesario una intervención multidisciplinaria desde la sociedad y sectores públicos como salud y justicia a la hora de abordar estos pacientes, pues medidas como mejorar el ambiente que los rodea y el reconocimiento a temprana edad mejora los resultados en el tratamiento y podría disminuir la expresión de la misma, así como las consecuencias sociales producto de casos graves. Conclusiones: El trastorno antisocial de la personalidad es un diagnóstico psiquiátrico que involucra necesariamente al paciente y la comunidad. La concientización de esta patología en la sociedad podría dar herramientas para mejorar la prevención, diagnóstico y atención integral con resultados a nivel individual y social. [Herrera-Gómez AL. Governing religious identities: law and legibility in neoliberalism

ABSTRACTThis article explores from a Foucauldian perspective how, in the neoliberal age, religious diversity has become a new form of governmentality that is based on practices of classifying and categorizing people according to religious criteria. Contributing to studies on religion and marketization, the article explores how religious diversity is promoted as a category of social order and coexistence and develops two ideas: first, religious diversity is a legal-political form of governmentality geared towards rendering complex populations legible for administrative purposes. Second, religious diversity reflects an economic form of governmentality, in that its legal doctrinal cognates (subjective definitions of religion, sincerity of belief, etc.) call forth liberal notions of consumer choice. While both are premised on the idea that people have identities, there are potential tensions between both forms, as the first tends to favor collectives and the second favors individuals. The article is based on research in Spain and Canada.

La convivencia social entre la ética y el pluralismo: “Una perspectiva desde Emmanuel Lévinas”

En términos generales, el presente ensayo se aproxima a la comprensión del fenómeno de la convivencia social bajo dos aristas, el pluralismo y la ética de los ciudadanos. De forma particular, se intenta comprender si es posible vivir juntos y cuáles son las características principales que nos ayudan a saber estar junto al otro. Se analiza y dialoga con algunas características propias del planteamiento que realiza Emmanuel Lévinas, sobre todo, con los elementos de su pensamiento como ser: el dialogo, la responsabilidad, la justicia, la libertad, el respeto (la tolerancia). En un escenario de mucha diversidad, la convivencia social actual se torna como un desafío debido a las muchas exigencias que el ser humano se ha impuesto. Finalmente, en las reflexiones conclusivas, se argumenta la importancia de la apertura y búsqueda de vivir con el otro para mejorar una vida de ciudadanía, y con ella volver a comprendernos como seres humanos y forjar una humanidad con sentido. Humanidad que Lévinas plantea como la ética primera.

Formação docente e superação do bullying: um desafio para tornar a convivência ética na escola

Este estudo teórico objetiva evidenciar a condição sine qua non da formação de professores para a diminuição dos problemas relacionados ao bullying em instituições educacionais. Em meio a um contexto em que a formação docente tem sido tratada de maneira superficial e ingênua, uma vez que, no caso específico dos problemas de convivência em que o bullying é a questão principal, tem se limitado a políticas públicas que definham na elaboração de cartilhas e campanhas de conscientização, torna-se imperativa a discussão de dados que permitam confirmar a necessidade de que os professores possam aderir, de forma mais evoluída, a valores morais para que suas intervenções também possam ser fortalecidas a ponto de contribuírem para a superação de formas de violência como o bullying.

ОСНОВНІ НАПРЯМКИ СУЧАСНИХ УКРАЇНСЬКО-БОЛГАРСЬКИХ ВІДНОСИН (1991 – 2018 РР.)

The year 2018 marks the 100th anniversary of the Ukrainian-Bulgarian diplomatic relations’ establishment. The independent shape of bilateral relations between the two countries founded back in 1918 and fruitfully developed both under the rule of the People’s Republic of Ukraine and Pavlo Skoropadskiy’s Ukrainian State has been dramatically interrupted by the Russian Soviet takeover of Ukraine. The present article touches upon the various aspects of contemporary Ukrainian-Bulgarian relations in the following spheres: that of politics and international relations, that of economic cooperation and that of social and cultural coexistence. The article as well outlines the following newly emerged elements of cooperation between Bulgaria and Ukraine under conditions of the Russian aggression against the latter: humanitarian collaboration, social reintegration and rehabilitation of the Ukrainian military and those living in the temporarily occupied territories. The article also accentuates of the external menace to the Ukrainian-Bulgarian relations, i.e. the national minorities’ harassment and the attempts at the quote unquote “People’s Republics” formation. It is concluded that the most fruitful and comprehensive sphere of collaboration between Ukraine and Bulgaria in 1991 – 2018 has been concentrated in the domains of economy (investments, trading goods and services) and of the social and cultural life. On the other hand, it is the national and cultural identity issues of Bulgarians in Ukraine that might bring about the internal unrest in Ukraine should the Russian Federation decide to “rock the boat” and make a point of the “self-determination of Bessarabia”.

Feminicidio: violencia de género desde Argentina

This article first presents a clarification of the most frequently used terms on the subject of femicide and a brief historical reference to the treatment that has been culturally given to women. Violence against women is then seen as a manifestation of historically unequal power relations between women and men. Violence against women is considered to be a circle formed by direct (physical) violence, structural violence (in social structures, primarily through laws and customs) and cultural violence. This text makes reference to the current fact of femicides and the ways in which they are presented. We go on to mention the psychological and sociological explanations of gender violence and the absence of committed political decisions. It concludes with the need to reorganize the social mentality in order to achieve long-term human social coexistence, eradicating impunity in the cases presented, asserting human rights and recognizing the paradigm shift, in the political, social and cultural spheres, where the woman is constructed as a subject, capable of creating, innovating and setting the standards that are needed for the full development of her life.Key words: femicide, violence, power relationships, social mentality.

Student Beliefs: Thought as a Mean to Improve Human Coexistence

Based on the complexity theory, it is possible to understand the diversity of elements and connections involved in human coexistence. From the systemic point of view, the development of thought processes which are strategic, creative, critical or argumentative, is an element of dignified coexistence, because it favors dialogue, debate or consensus. But attitudes of respect, tolerance and support for human plurality in terms of ways of thinking, feeling and living are also essential. The research assumption is that teaching thinking skills and attitudes could lead to intelligent and respectful behavior in human coexistence. Specifically, college students' beliefs about the need to promote different ways of thinking were analyzed. This is a qualitative phenomenological research. Students from the National Autonomous University of Mexico (Group A) and the Autonomous University of Mexico City (Group B) were investigated about their beliefs on how the development of thought contributes to social coexistence, specifically about creative thinking, strategic thinking, critical thinking and argumentative thinking. Results: the beliefs of students who think creatively lead to a problem solving social interaction, or a thinking about a better world. Thinking in a convenient way allows you to combat violence or improve human communication. Thinking critically helps analyze whether actions are suitable for human coexistence and among others, if we reflect to analyze whether we act in a relevant way or on the importance of the benefits of the rest of the thinking skills and abandonment of mediocrity.

Estudio de iniciación a la Sociología emocional a partir del cual se pretende conocer mejor los cambios y consecuencias del comportamiento social desde el ámbito de las emociones. Centrándonos concretamente el concepto de empoderamiento emocional, se analizará como éste puede ocasionar cambios en las relaciones interpersonales cercanas, y cómo puede generarse una consecuencia de expansión que logre cambios en la estructura cultural de comportamiento social.Emotional empowerment Change in the structure of individual recognition and interpersonal relationships.The following study is an introduction to qualitative research. It is aimed at gaining a deeper understanding of the effects of emotions—specifically the concept of emotional empowerment—on social behavior, while seeking to ingrate this concept into the field of emotional sociology. Control, responsibility or empowerment of one’s own emotions has become a global market, which is presented as modernity’s new toolkit for behavior. In other words, the isolation and individualism that we increasingly face due to unbridled capitalist globalization has resulted in us not being able to find a safer place to be other than ourselves. As if the time had come to cleanse the subjectivity, which has lain dormant after so many years of mass consumption, misinformed information and globalized individualism, in order to strengthen the bonds of social coexistence based on individuality. For this reason, the study below intends to describe how the acquisition of emotional empowerment affects the development of individual recognition and interpersonal relationships. Thus, it identifies a new structure of personal recognition that, on the basis of how we see we ourselves behave, serves to determine how we behave towards others or, to put it another way, to define new patterns of social behavior.

Mikro-utopije u arhitekturi

In recent years, new formats of socially engaged architectural practices have become increasingly present in the urban space. Projects of temporary use, mostly erected by transdisciplinary working collectives, have become part of a broader trend, marking a social turn in architecture. In this paper, these practices are understood as a concrete aesthetic and political phenomenon that brings about alternative forms of social coexistence: micro-utopias arise against the backdrop of urban NEO-liberalisation processes. The history of utopia, and particularly the utopian tradition in architecture, facilitate to put this argument forward.

Relaciones de poder y proceso de cambio. Formas de autoridad en la praxis y los imaginarios de jóvenes participantes del Taller de Formación Política en El Alto, Bolivia

El siguiente trabajo presenta los resultados de una investigación social con metodologías participativas, que se fue conformando como un espacio de análisis y reflexión de las relaciones de poder de jóvenes participantes de Talleres de Formación Política en El Alto, Bolivia, en un contexto tan especial como lo ha sido la década 2006-2016 para el proceso de cambio. En el artículo, mostramos cómo seguimos un hilo deconstructivo de las relaciones de poder concebidas como dominación, para lograr ampliar el margen epistémico de análisis de la autoridad y llegar a la comprensión de tres formas de relaciones de poder: una horizontal, otra vertical y otra procesual, que se constituyen como redes paralelas y superpuestas que se despliegan y se practican por los jóvenes participantes en sus sistemas cotidianos de convivencia social y política. Estas formas de construcción de la autoridad y la toma de decisiones se consolidan como prácticas e imaginarios de los posibles cambios y de su propio papel como agentes en ellos, como actores de una histórica dinámica sociopolítica que tuvo un hito muy importante con la llegada de Evo Morales y el MAS al gobierno boliviano.

The Habsburg Empire at the Liberalization Stage: The Progress of Civil Society

In the article the author determines the formation of a functional correlation between the institutions of civil society and ethnic nationalism in Austria-Hungary. It is established that civil society in the Austro-Hungarian Empire began to form clearly after the democratic reforms of the sixties of the XIX century. It is proved that civil society has undergone stratification in various national and linguistic spaces in the form of educational, scientific, economic, and creative organizations. Civil society on the periphery of the empire has acquired a stable ethno-cultural character.The findings indicate that the acute crisis of identity in Austro-Hungary developed on the basis of two actively functioning sources: the old conflict environment of local historical and state identities and new formations that arose as a result of the cultural and political expansion of ethnic groups belonging to nations that were treated as young and stateless. The problems of economic, social, mental autonomy and cultural coexistence could not receive an authentic representation only in terms of administrative and political decentralization or integration, since in each national-ethnic event they had a spiritual and cultural content and socio-humanitarian content. In the early twentieth century. in Austria-Hungary there was a situation of unstable equilibrium of the composite society, which was characterized by the asynchrony of historical development.The ethnic factor played a dissonant role in the social life of Austria-Hungary. Most ethno-national groups were in different segments of the formation of political nations, in different socio-cultural contexts, which led to difficulties in the formation of classical institutions of civil societies and its formation as homogeneous. The period of modernization of the Austrian empire proved that liberalism and nationalism are historically linked precisely with the principle of people's sovereignty.

Pós-modernidade e Turismo: Reflexões Acerca da Experiência Turística no Contexto das Agências de Viagens.

O fenômeno turístico constitui um projeto de sociedade que se apropria de espaços e os transforma segundo normas e valores que lhe são próprios. As motivações de viagens e os destinos turísticos fazem parte de uma rede de significados pessoais e sociais e sua análise auxilia compreender a nova convivência social e as novas possibilidades mercadológicas. Estudos acerca do comportamento do consumidor no turismo trata a motivação como determinante básico do consumo e o processo de tomada de decisão como algo individual. Assim, pretende-se refletir o turista pós-moderno, suas necessidades e busca contínua por experiências de vida estabelecendo relação com as estratégias mercadológicas para a oferta das viagens no contexto das agências de viagens. Para tanto, foram entrevistadas seis agências de viagens do município de Natal- RN. Os resultados da pesquisa sinalizam que, segundo as agências de viagem, o consumidor do turismo tem buscado experiências, embora apontam que elas ainda não desenvolvem ações estratégicas neste sentido. Pensar o turismo contemporâneo não é descartar os elementos de natureza econômica e mercadológica que o constitui, mas compreender que sua essência está nas viagens como prática humana e a subjetividade que ela implica.
