General characteristics of technologies, innovations in intellectual property law

In this work, we consider technologies, innovations and intellectual property rights. In the context of modern development of all spheres of human life, the concepts of «technology», «innovation» and «innovative technologies» are an integral aspect of the present. They play an important and key role in the competitiveness of not only individual enterprises and organizations, but also in law and economics in general, since innovative technologies are the basis for the positive development of society and the legal relations that arise in this regard, including legal relations in the field of intellectual property rights. Intellectual property is the result of intellectual and creative activity, which is formalized and grants the author or a person who is granted the right of ownership of the result by law, which is acquired, exercised and protected in accordance with the established procedure, rules and legally defined norms. It is the objects of intellectual property rights that are in clear interaction with technology and innovation. Detailed attention is paid to the essence and content of innovations and technologies in the field of intellectual activity, in particular in the production and change of characteristics of the relevant objects of intellectual property rights. The author focuses on the conceptual apparatus of such concepts as «innovation», «technology», «intellectual property», «intellectual property rights», and technology transfer. The modern national and foreign literature is analyzed with a view to defining the basic concepts of the study and their legislative consolidation. The author analyzes the features of technology transfer, in particular, it is established that innovative technologies are endowed with novelty, revolutionary nature, irreplaceability, uniqueness, and inevitability. The author establishes the interconnectedness of the content of «innovations» and «technologies» in relation to intellectual property rights, namely, directly to intellectual property objects, which are manifested by applying know-how or an invention to a specific result of intellectual activity in the production process.

В России развиваются программы, способные создавать аудиовизуальные, текстовые и графические объекты искусства. Высокий уровень исполнения, творческая новизна и вложение рабочих мощностей программы позволяет поставить вопрос о возможности наделения искусственного интеллекта авторскими, смежными или патентными правами. Актуальность выбранной темы обусловлена разницей в подходах к правовому регулированию результатов интеллектуальной деятельности искусственного интеллекта в Российском национальном и международном праве. the current pace of development of artificial intelligence is ahead of the possibilities of its legal regulation. Programs capable of creating audiovisual, text and graphic art objects are being developed in Russia. The high level of execution, creative novelty and investment of the program's work allows us to raise the question of the possibility of granting artificial intelligence copyright, related or patent rights. The relevance of the chosen topic is due to the difference in approaches to the legal regulation of the results of intellectual activity of artificial intelligence in Russian national and international law.

CRM TOOLS TO ENSURE THE PROTECTION OF INTELLECTUAL PROPERTY RIGHTS

The article examines the main aspects of using CRM systems in the management of relationships in companies under the condition of ensuring intellectual property rights. It was determined that the protection of intellectual property rights is considered through the prism of the development and implementation of a system of legal norms that require regulation of relations aimed at the need to create and implement intellectual property objects. The need to protect intellectual property rights, which is mediated by the design, development and use of special software, has been proven. Based on the analysis of the essence of the concept of intellectual property and the definition of its main components, the introduction of specially developed software is proposed. The choice of the software environment and tools for the implementation of the visual design of the proposed database is substantiated, which unites all stages of its development and implementation in a single seamless environment for the purpose of ergonomics and optimization of writing code in the appropriate scripting environment, which aims to ensure the generation and reproduction of tables, comparison of databases, synchronization of schemes and data, preparation of reports and optimization of the methodology and technology of their distribution, as well as fast and effective security management in databases. The main areas of implementation of the CRM management strategy and the implementation of software developments in the organization of the company's work, as well as the components of the information support of CRM systems, are presented. The method of implementing the CRM strategy in the company's activities is proposed. An information system for accounting of the company's activities was designed and developed on the basis of the CRM system. The main features, advantages and disadvantages of using CRM systems in the company's activities are determined. The scientific and practical utility of the proposed information management system allows for a step-by-step and component analysis of all business processes, to make management decisions for the purpose of better cooperation and legal protection of intellectual property in the modern information space.

Economic and Legal Aspects of Intellectual Property Protection Abroad

In the context of the rapid development of technology, science and digitalization, the expansion of cross-border relations between states, the active entry of artificial intelligence into the daily life of society, human intellectual activity and the protection of the rights of the results of his creative work is the most pressing issue. For a long time, the legal regulation of relations arising from the use of intellectual property was considered exclusively the object of domestic legal relations, and did not go beyond its limits. National structures have tried in different ways to balance the interests of the owner of an intellectual property object and consumers seeking free access to these objects. Since the release of intellectual property beyond the borders of one state, problems have arisen of inconsistency in the legislative framework protecting the interests of the actor of the intellectual property object. In turn, this leads to the loss of new technologies and scientifi c developments by countries, and at the level of individuals to the loss of royalties. Taking into account the fact that intellectual property products permeate all spheres of the economy and national economy, we are forced to block the exchange of scientifi c research and technical developments at the international level in order to prevent theft of an intellectual product. In order to protect the rights of the owner of an object of creative work at the international level, and free, unhindered access to these objects by the entire world community, it is necessary to bring the legislative regulation of intellectual property rights beyond the supranational level, and regulate this law enforcement object by international organizations, applying the norms of international law. This scientifi c research is devoted to the study of the peculiarities of the protection of intellectual property rights abroad. The authors state that the legal regime of the state plays an important role, in the territory of which a number of powers of the owner of the object to protect their own rights are determined.

ТЕХНИЧЕСКИЕ РЕШЕНИЯ ПО СОЗДАНИЮ ВЕДОМСТВЕННЫХ ОРГАНИЗАЦИОННО-ТЕХНИЧЕСКИХ СИСТЕМ КЛАССА «КИБЕРПОЛИГОН» КАК СРЕДСТВА ОБЕСПЕЧЕНИЯ ИНФОРМАЦИОННОЙ БЕЗОПАСНОСТИ ВЕДОМСТВЕННОГО НАЗНАЧЕНИЯ

The article is devoted to the study of problematic issues of the formation of departmental organizational and technical systems of the «cyberpolygon» class as a solution to the problem of management in organizational systems based on an integrating platform in the form of a control configurator, which should ensure the necessary level of readiness of the cyberpolygon in the context of changes in the technologies used in departmental information security systems. An approach is considered to substantiate the possibility 
 of providing the necessary (required) level of readiness of the organizational and technical system of the «cyberpolygon» class of the integrating platform, taking into account the shortage of the level of readiness of the technology of the functional modules of the cyberpolygon. The results of a comparative assessmentof the state of the art of the control configurator and solutions that are registered in the Russian Federation as objects of industrial and intellectual property are presented.

Formation of the model for the commercialization of the company's digital intellectual assets

Purpose: of the study is algorithmic modeling of the commercialization of digital intellectual assets (CIAS), taking into account pricing factors, risk and the level of commercial potential, based on the identifi cation of CIAS and determination of their specifics. Methods: general scientific methods of comparative analysis, systematization and generalization, identifi cation of distinctive features and price-forming factors that take into account the specifics of the objects of research are used. To form a model of the commercialization of digital intellectual assets, the algorithmic approach, the method of expert assessments in calculating the indicator of commercial potential, approaches and methods of valuation in determining the initial value of assets were used.Results: the author formulated the defi nition of a digital intellectual asset (DIA), establishes its relationship with related categories of assets, identifi es two categories of DIA indicating common and distinctive properties. Based on the results of the identifi cation of DIA, the factors aff ecting the value and commercial potential of various types of DIA are determined. The method for calculating the indicator of the commercial potential, taking into account the factors considered, is proposed. The tools of the commercialization, as well as approaches and methods of estimating the initial cost for various categories of DIA are disclosed. The algorithmic model of the DIA commercialization is constructed. Conclusions and Relevance: the algorithmic model of commercialization of new types of assets, digital intellectual assets, proposed in the article takes into account their specifi cs and factors aff ecting the initial cost and commercial potential. The model can be used by Russian companies to increase their competitiveness in the context of the development of the digital rights and technologies market. Further research should be devoted to the specifi cation of the commercialization algorithm for certain categories of DIA: 1) intellectual property objects in digital form; 2) digital (digital utilitarian) rights to such objects and their use, implemented exclusively according to the rules of the information system (investment platform).

The article is devoted to a comprehensive study of technologies designed to protect intellectual property rights. The scientific basis for the study of information technologies for ensuring the protection of intellectual property rights is analyzed. Attention is paid to the close connection between the development of information technologies and challenges to the protection of intellectual property. This issue is considered in the context of administrative and legal aspects of such protection. The author formulates proposals aimed at improving administrative and legal acts in the area under study. The trends in the development of intellectual property law are analyzed, revealing a range of directions for its further advancement, notably expressed in the processes of globalization of legislation and the transition from protecting rights fixed on material carriers to protection of information. Emphasis is placed on the fact that the transfer of modern technologies is one of the main avenues for the creation and utilization of intellectual property, which is also provided for in international legal acts. The stimulation of creating fundamentally new technologies and developments, along with their broad industrial utilization, greatly depends on a systematic approach to structuring the strategy for the development of the national innovation system. This system integrates fundamental scientific research and the commercialization of their results, employing legal mechanisms for the circulation of property rights over intellectual property objects. Particular attention is paid to the legal regime of blockchain protection. Attention is drawn to the complexity of legal protection of the blockchain, which consists of both information and intellectual property. It is indicated that this object is a system for recording, storing and processing information and a technology for performing actions in the digital environment. It is proved that blockchain is a value associated with objects with exclusive rights and has the ability to issue invoices. It is emphasized that blockchain can be considered within the framework of the Law on Information - as an information product in the form of a document containing information.

Intellectual property rights in international and Russian investment law

The investment activity is diverse and can be carried out with the use of intellectual property rights in accordance with the current international and Russian investment law. The article aims to identify the specifics of the application of intellectual property rights as investments and the implementation of intellectual investments, i.e. investments endowed into intellectual property rights. The objectives of the study are to consider the categories of an investment and object of investment activity, intellectual property, exclusive and other intellectual rights, as well as to analyze and determine the features of legal regulation of the activity in question at the international and national levels in the Russian Federation. Based on the results of the systematic analysis with the use of formal legal, comparative and other research methods, it is concluded that investments as a property in a broad sense may include both exclusive and other non-personal intellectual property rights to the results of intellectual activity and equated means of individualization of goods, works, services and enterprises. At the same time, they exclude intellectual property itself as a set of various types of intangible products, moral and other personal non-proprietary intellectual rights by virtue of their inalienable and non-transferable character. It is argued to be the same with respect to the object of investment activity, i.e. the property which the investment is endowed in and is capable to bring income to the investor in the future. Investments into such intellectual property rights can be called as intellectual investments.The legal regulation of investment activity with the use of intellectual property rights has a dual character (in the sense that it is carried out by different investment legislative acts with the similar subject of their regulation) and depends on the type of a particular object used. If intellectual property rights are invested in fixed capital, then they are to be recognized as capital investments and are governed by the Federal Law of February 25,1999 No. 39-FZ “On Investment Activity in the Russian Federation Carried out in the Form of Capital Investments”. If intellectual property rights are used as the object of investment activity, i.e. where investments are endowed in, such intellectual investments are subject to the regulation by the Law of the RSFSR of June 26, 1991 No. 1488-1 “On Investment Activity in the RSFSR”.

Basics of implementation of the standards of international agreements in the sphere of international trade by Ukraine

The latest international trade is characterized by serious, radical changes - the creation of a global information space, where the main products of production are information and knowledge, and information technologies penetrate almost every sphere of economic activity. International treaties become the main source of legal regulation of relations arising in the field of international trade.
 It has been established that the future development of Ukraine's economy directly depends not only on determining the directions of transformation of legal relations in the field of international trade, but also on how Ukraine directly implements the provisions of current international treaties in the field of international trade, in particular in such an important field as intellectual property - international agreements are the determining factors of the competitiveness of the country's economy, the most valuable capital that determines the strategy and tactics of our country's development, the most important driver of innovation.
 It was found out that today, the states have come to the realization that without solving issues related to the international regulation of relations in the field of intellectual property, without concluding international agreements in this field, it will be impossible to promote any object of intellectual property in the world. It is substantiated that all the specified international treaties regulating intellectual property as an object of trade transactions, to which Ukraine has joined, form an interconnected system of international trade relations. The WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) occupies a special role among the system of these international agreements. The implementation of the TRIPS Agreement in Ukraine progressed in parallel with radical changes in the ways of using intellectual property in trade and the growing use of the international intellectual property system. Currently, Ukraine is at the final stage of institutional reform in the field of intellectual property - the State Organization «Ukrainian National Office for Intellectual Property and Innovations» (UANIPIO) has been established; its powers, scope and directions of its activity are established; the right to represent Ukraine in international and regional organizations, etc.
 Ukraine is an active participant in international trade processes and the corresponding main international legal acts in this area, which increases the interest of our state in optimizing and improving the standards, norms and provisions that regulate it. Judicial practice has confirmed that international treaties are an integral part of national legislation.

Legal Aspects Related to Intellectual Property Protection in the Field of Digital E-Commerce Technologies

Intellectual property created through digital technologies plays a crucial role in the economy, serving as a vital tool for developing the domestic market. Therefore, it is essential to ensure adequate protection of intellectual property rights in the sphere of digital technologies and electronic commerce. This research aims to analyse the legal regulation of intellectual property protection in digital technologies for electronic commerce. The following methods were used: formal-legal, comparative-legal, formal-logical, analysis and synthesis, dialectical, and functional-instrumental. The article identifies the peculiarities of conducting electronic commerce in Ukraine. This text discusses the determination of intellectual property objects in digital e-commerce technologies and common violations in this area. It highlights the need for comprehensive legal norms to prevent violations and compensate for damages. Additionally, the text examines the problems through which violations of intellectual property rights often occur and studies the American and European models of intellectual property protection. Civil law instruments protect intellectual property rights in digital technologies and e-commerce. The text outlines the importance of protecting intellectual property as a foundation for innovation and proposes practical tools for protecting rights in this sphere. It is important to note that the development of e-commerce presents advantages and challenges that impact the regulation of this market's growth and innovation. This is due, in part, to violations of legal property rights.

Formation of intellectual property commercialization strategies

The object of research is the process that forms strategies and methods for effective commercialization of intellectual products at industrial enterprises. The problems of introducing intellectual property objects into the economic circulation in the field of industrial production have been analyzed. The most important of them are economic and managerial problems, which consist in the lack of necessary funding and are determined by the difficulty of assessing the market competitiveness of an intellectual product. Special attention was paid to market, technical-technological, and legal problems, the presence of which inhibits the development of the technological market and significantly affects the efficiency of intellectual and innovative activities. The presence of these problems predetermined the main goal of the study – to devise methods and strategies for the commercialization of intellectual property objects. Three basic strategies for the commercialization of intellectual products have been studied: the strategy of promoting an intellectual product, the strategy of diffusion of innovations, and the strategy of accumulating maximum income. Based on them, an integrated strategy for the commercialization of intelligent products for enterprises of the machine-building industry, which is oriented towards achieving the goals of maximizing the economic and social effect of the production of an intelligent product, was formed and substantiated. The main component of an integrated strategy is an organizational mechanism that provides investment support for innovative activities and scientific and consulting support for an intellectual product. The research results could be used to form programs of intellectual and innovative activity of industrial enterprises and would serve as a basis for further scientific research on these issues

Развитие правового регулирования использования интеллектуальной собственности в контексте задач инновационного производства

In corporate management system of innovative production, the presence of intellectual property maintains con-troversial and borderline position between economics and law. The effective use of such two-axis regulation within the company significantly affects its recovery and stimulates the introduction of new solutions based on intellectual innovations that contribute to the improvement of market competitiveness of the organization. Cur-rently, Russia is implementing the technological development concept, which contains the elements of “intel-lectual activity results”. While considering this issue in the context of global technological trends and transfor-mational changes in the field of advanced manufacturing technologies, solutions for legislative positive impact based on intellectual property rights are becoming relevant. In the context of digitalization of the process of cre-ation of new products and virtual testing it is recommended to consider the possibility of legislative registration of new intellectual property objects.

Digital Intellectual Property and its Protection

Purpose — to determine the meaning and content of new terms of the theory of law, which will later be used in other branches of law. To actualize the problem of digital intellectual property objects. Identify the gray zones of legal regulation that have arisen in practice and analyze changes in judicial practice in 2022-2023. Methods. Classical methods are used. It showed high efficiency: a comparative legal, dialectical-materialistic method, formal-legal. Results. The list of intellectual property objects is expanding. New entrepreneurial activities are emerging, based on the collection of information and the creation of 3D models. Gaps in legislation lead to many years of litigation, unforeseen expenses, the inability to determine the outcome of a legal conflict. As a legislative proposal: to eliminate the identified problems, it is advisable to revise Article 1225 of the Civil Code of the Russian Federation "Protected Results of Intellectual Activity and Means of Individualization" taking into account those objects that have formed in the construction sector. Discussion. Actualization of problems in the terminology of the theory of law, which create difficulties in the application of legal norms in various types of legal activity. Increasing the importance and scientific value of interdisciplinary research. It is necessary to unify terminology affecting digital intellectual property objects in various branches of law. The protection of intellectual rights can be strengthened.

Balance of Interests of the State and the Copyright Holder in the Field of Intellectual Property for the Purposes of Competition Protection

The paper analyzes the balance of interests of the state and the copyright holder in the field of intellectual property for the purposes of competition protection. Having analyzed various measures of legal support by the state aimed at stable economic development through the prism of trust in the state and law, the author draws attention to «parallel imports.” The author also focuses on the possibility of limiting the protection of rights to intellectual property objects at the contract level due to the negotiating power of counterparties on whose sites production is located, which is similar to some Asian states. In the paper, the author analyzes the practice that took place before 2022 and compares it with the current state of ensuring the rights and legitimate interests of copyright holders. Summing up the study, the author believes that investment opportunities and trust for the state from both the society, representing the state, and national business and for foreign participants to international trade may be created through a solution that will allow the latter to fully realize their rights to intellectual property rights protection when resuming activities in the country.

Knowledge Management and Intellectual Property in the Organization

This paper aims to demonstrate the interrelationship between knowledge management and intellectual property management in the organization as a prerequisite for achieving and maintaining competitiveness in different types of organizations. Knowledge subject to management can refer to both processes of creation of intellectual property objects and in terms of their market realization. Among the characteristics of this type of intellectual property knowledge is that it is concentrated in experts in the field, either internal or external to an organisation, and that the intellectual property legislation and market are dynamic. These are just some of the premises justifying the importance of managing this knowledge for the purpose of maintaining the competitive advantage of organisations that own intellectual property assets. The author’s thesis is that the management of an organisation’s intellectual assets inherently involves the management of knowledge associated with them, but knowledge management itself is not limited to that associated with intellectual property. An interdisciplinary methodology is used, the approach is from the general to the particular. Complex, systemic, and structural approaches are used as well as the methods of analysis and synthesis.

MANAGEMENT OF THE EFFICIENCY OF USING THE COMMERCIAL POTENTIAL OF INTELLECTUAL PROPERTY

Abstract. The article is devoted to the study of existing approaches to the economic evaluation of the effectiveness of commercial opportunities of intellectual property and industrial innovations in the production and commercial activities of industrial enterprises. The most important groups of indicators characterizing the effectiveness of commercial opportunities of intellectual property and industrial innovations are defined and substantiated. These groups include: indicators characterizing the market characteristics of intellectual property (market target indicator, market prospects (development) indicator, intellectual technology positioning indicator on the market); cost characteristics reflecting the real costs of developers and consumers of intellectual property; commercial characteristics reflecting the consumer value of the intelligent technology for potential use; patent-legal characteristics of intellectual property and industrial innovations that reflect the patent purity of the object of intellectual property, the protection of exclusive rights to it, the impossibility (or in the extreme case - significant difficulty) of copying and counterfeiting. The currently used methods of assessing the effectiveness of the use of commercial opportunities of intellectual property and industrial innovations, which are based on the ratio of results and costs, i.e. are considered in detail. on the comparison of the obtained effect and costs. The feasibility of checking the obtained values of economic efficiency, as well as the organization of strict control over the spending of funds and compliance with the planned deadlines, has been proven.

ANALYSIS OF PROBLEMATIC ISSUES BETWEEN DOMAIN NAMES AND OTHER MEANS OF INDIVIDUALIZATION

In the article, the author studies the similarities and differences between domain names and individualization means, as well as the growing number of problems between domain names and individualization means due to the globalization of the Internet and the proliferation of e-commerce. The commercial significance of domain names is directly reflected in the disputable situations. The article also lists the objects of intellectual property that are not registered as domain names under the legislation of the Republic of Uzbekistan and not prohibition of the registration of domain names that are identical or confusingly similar to a trademark or service mark is brought up as a matter of discussion.

Exhaustion of rights and parallel import: legal assessment from the point of view of security

In the context of external challenges and threats, integration and digitalization of the economy, attention is growing to the issues of exhaustion of rights or parallel imports. The article considers the issues of exhaustion of exclusive rights to intellectual property objects from the point of view of ensuring security.The object of the study is the model of exhaustion of exclusive intellectual property rights in Russia, its features from the point of view of ensuring various types and levels of security. Based on the proposed periodization of the legal regulation of exhaustion of rights in Russia in the context of Eurasian economic integration, the author examines the formed model of exhaustion of intellectual property rights, highlights its features, identifies options for its scientific justification from the standpoint of ensuring national security in the context of internal and external threats.Methods of systemic, historical and institutional analysis, formal logical and comparative legal methods were used. The author proposes a periodization of the legal regulation of exhaustion of rights in Russia in the context of Eurasian economic integration, a classification of participants in legal relations directly or indirectly involved in the mechanisms of creation, use and turnover of intellectual property rights. Attention is drawn to three aspects of the mechanism of exhaustion of rights that has developed and is developing in Russia: the conceptual apparatus of the mechanism, the complexity and multilevel nature of the security provided by it and the mobile nature of the mechanism of exhaustion of rights. Conclusion are drawn that in modern Russia the established model of exhaustion of rights, combining elements of regional and international principles of exhaustion, can be considered as a way to counteract sanctions pressure, measures to protect domestic copyright holders, producers and consumers, measures to support the domestic economy, conditions for the formation and strengthening of technological sovereignty. It is proved that the established correlation of various models of exhaustion of rights in Russia reflects the dominance of aspects of national security protection, the strengthening of economic components of intellectual property rights protection.

Formation of an organizational and economic mechanism for increasing the economic stability of an enterprise in the management of intellectual property objects

The purpose of the study is to analyze the impact of macro- and microeconomic factors on the formation of the management system of intellectual property objects as a structural element of the organizational and economic mechanism of increasing the economic sustainability of the enterprise. The right of ownership of intellectual products is considered an institutional prerequisite for increasing the enterprise's sustainability on an innovative basis, and objects of intellectual property are determined as a critical factor of social production. In enterprise management's organizational and economic mechanism, attention is focused on goals and incentives. It is proposed to consider increasing the economic stability of the enterprise as a complex goal of management, the reengineering of which is initiated by disturbances of various etymologies with the dominant influence of external factors. As an adaptive tool for transforming the organizational and economic mechanism of enterprise management into an open system, the creation of conditions for the effective implementation of the formation, use, and distribution of intellectual property objects is proposed. The system's components of increasing the enterprise's innovative potential are highlighted, including strategic management of intellectual property, protection of intellectual property rights, management of the intellectual property portfolio, internal knowledge management, creation of an innovative culture, and optimization of financial management of intellectual assets. A comprehensive understanding of the prerequisites for protecting intellectual property rights in the context of the institutional system functioning at the national level is presented. It has been proven that the ability to transform intellectual property objects into an influential factor in acquiring sustainability by business entities depends on the quality of public-private partnerships in terms of relations between the government, businesses, and universities. Consideration of the Economic Purpose and Intent of the Infringer in Determining the Amount of compensation for Infringement of Exclusive Rights

Relevance. Compensation for violations of exclusive rights to works and other intellectual property objects is the main method of protection used by authors and right holders. The possibility of using a compensatory approach in determining the amount of recovery from the infringer acquires special significance in the conditions of the development of modern technologies, leading to the emergence of new ways of using works, in the implementation of which the right holders do not have the opportunity to unambiguously establish the scope of use and the amount of damages caused. At the same time, the practice of applying the provisions on compensation for violations of exclusive rights has revealed the need to develop additional criteria to exclude cases of unjustified recovery of disproportionate compensation in the formal application of the methods of their calculation established by law.The purpose of the study is to determine the specifics of using additional criteria, such as "economic purpose" and "unity of intent of the infringer", when establishing the amount of compensation for violations of exclusive rights to works and other intellectual property objects, taking into account the development of judicial practice and clarifications of the courts of higher instances.Objectives: to identify problems associated with the application of the criteria of "one economic purpose" and "unity of intent of the infringer" in determining the amount of compensation for violations of exclusive rights to works and other objects of intellectual rights; to identify opportunities for further development of legal regulation taking into account the above criteria.Methodology. In preparing the study the author applied general scientific methods, methods of analysis and synthesis, system method, formal-legal method.The results of the research have theoretical and applied nature and are aimed at improving the quality of legal regulation of civil legal relations.Conclusions. The conclusions made in the article are of a controversial nature, aimed at further development of approaches contributing to the uniform solution of problems arising in the application of legislative provisions on determining the amount of compensation for violations of exclusive rights to works and other intellectual property objects in order to prevent and suppress such infringements, as well as compensation for losses caused by them.
