The work examines issues of maintaining and increasing food security at all levels of the country. And penitentiary institutions are no exception. Penal systems around the world are institutions designed to safely house individuals who have been convicted of crimes and sentenced to prison. These persons are known as those sentenced to imprisonment. Heads of prisons (public or private) in foreign countries can use several strategies to improve their performance standards. However, some of these actions depend on the ability of prison administrators to cope with certain institutional limitations. In the Russian Federation, institutions and authorities are faced with budget limitations and disruptions in food supplies. An unstable, rapidly changing economic situation can serve as a threat to the economic security of the Federal Penitentiary Service of Russia due to a violation of the deadlines and quality of supplied products to meet the needs of the system. In this context, it is essential to realign the food acquisition system within the system to prioritize self-sufficiency, particularly focusing on the advancement of livestock farming. It is shown that the use of new technologies and tools helps to reduce the expenditure of budget funds to provide food for the needs of the system. In solving the food problem, one should use legal mechanisms that function and have proven effective in other areas. One of such mechanisms is the institution of public-private partnership (hereinafter referred to as PPP). The study indicates that addressing this issue involves a series of actions such as modernization, construction, and implementing advanced technologies and infrastructure upgrades. This can be achieved by leveraging additional sources of financing beyond the budget and by utilizing Public-Private Partnership (PPP) mechanisms.

Sustainable development of regions: Modeling the management of economic security of innovative entrepreneurship

The purpose of this study is to develop a methodology for assessing the level of economic security of innovative enterprises based on the use of taxonomic analysis of the main indicators of their institutional support for the optimal organization of management and forecasting the economic development of the regions of their operation. The method proposed in the article consists in assessing the system of indicators of institutional support for innovative entrepreneurship within the framework of the Institute of Human Capital, the Institute of Financial and Credit Component, the Institute for the Implementation of Innovations in Industry, the Institute of Export Activities, the Institute of Intellectual Property, the Institute of Infrastructure Support, the Institute of Regulatory and Legal Support, the Institute of Public-Private Partnership and Mediation, the Institute of Information Support. The advantage of this technique over the methods for assessing economic security proposed in other scientific works is that the summary assessment indicator is universal and its interpretation makes it possible to identify the relationship between the main integrated indicators for all regions of the studied country, taking into account the unevenness of their economic development, as well as to analyze the question of the causal nature of the transformation of the institutional environment and its consequent. The practical significance of systematized indicators of institutional support, influencing the modeling of economic security management of innovative entrepreneurship, is that they can be used in forecasting the economic development of regions of the country and developing appropriate measures to regulate this process.

Public-private partnership in the field of waste management, not related to municipal solid waste

The paper discusses the need to preserve the environment, taking into account the relationship between wastewater and soil-forming processes. It is shown that the use of new technologies helps to reduce the spending of budgetary funds on environmental protection. Yale University annually analyses the state of the ecological environment for each country, which contributes to the identification of problems and the direction of development of the environmental policy of each state. In addressing environmental problems, one should use legal mechanisms that have been developed to address similar issues, and one of such mechanisms is the institution of public-private partnership (hereinafter - PPP). PPP in the field of environmental protection is aimed at solving issues related to environmental protection, tasks, such as: reducing the amount of discharges of pollutants into water bodies; sewage treatment; increasing biodiversity; environmental education; development of alternative energy. The paper shows that a set of measures that ensure the modernization or construction of sewage treatment facilities and storm water treatment facilities in order to minimize the negative consequences of wastewater discharge is seen in solving this problem with the involvement of extra-budgetary funding sources and the use of PPP mechanisms. The implementation of environmental projects is a common trend for all countries. And Russia will have to solve problems in the field of waste management, not related to solid municipal waste, on an equal basis with all countries. The solution of problems in the field of environmental protection may entail the parallel solution of other problems in other areas, and vice versa.

Influence of Hybrid Legal Institutions on the Management in Local Government on the Example of the Institution of Public-Private Partnership

The basis for the matter discussed herein is the presentation of a new paradigm in modern law, i.e. the creation of hybrid legal institutions. The specificity of this construct consists in the combination of elements of public law and private law in order to achieve mutual benefits. Meeting these two interests is perfectly illustrated by the institution of public-private partnership. The essence of the partnership is the implementation of infrastructural projects in the public sphere by a private entity. A detailed analysis of this institution gives grounds to propose a thesis about the need to change the model of management in local government. The inclusion of private entities in the performance of tasks in the public sphere forces the verification of the traditional way of managing the local government staff. The participatory execution of tasks as part of hybrid legal institutions forces the officials to become more professional. This is the only way the public interest can be safeguarded in a public-private venture.

ПЕРСПЕКТИВИ ГАРМОНІЗАЦІЇ СОЦІАЛЬНО-ЕКОНОМІЧНИХ ІНТЕРЕСІВ СУБ’ЄКТІВ ЗЕМЕЛЬНИХ ВІДНОСИН АГРАРНОГО СЕКТОРУ УКРАЇНИ

The article substantiates and formalizes the conceptual approach to balancing the socio-economic interests of the subjects of land relations of the agricultural sector. The main elements of the mechanism of socialization of the system of land relations regulation are determined, which are: 1) increasing the level of social responsibility of the state to society and business in regulating land relations, which is to ensure fair distribution of land rights between land relations and land productivity. on the basis of socialization of land legislation; 2) ensuring the rapid and effective resolution of conflicts of interest of the subjects of land relations related to the violation of land ownership rights, through the introduction of the institution of land mediation; 3) expanding public participation in the processes of defining goals and programs of land reforms according to the interactive model of crowdsourcing start-up. It is proved that the institute of public-private partnership in the system of land relations regulation can serve as an effective means of realization of socially significant projects in the agricultural sector and development of the administration system in the direction of its social stabilization and coordination of interests of land relations subjects. the statebusiness alliance to the format of multilateral partnership in order to maximize the involvement of the active part of society in a broad dialogue in the preparation and implementation of land reform projects. Partnership between government, business and the public in the framework of social responsibility will contribute to the sustainable development of society, reduce non-financial risks for corporations and serve as a prevention of social crises. Thus, the balance of interests of agribusiness, society and the state, the instrument of which is the socialization of land relations, will balance the aspirations of agricultural holdings and small agricultural enterprises to maximize profits, rural population – to a fairer distribution of land resources, the state – to socio-political stability land relations.

The article presents the issues of development of land reclamation on the basis of the institute of public-private partnership in agro-industrial production, presents the directions of interaction between the partnership of the state and private agricultural business, based on the problems of restoration of land recla-mation facilities, effective use of existing and involvement of unused land resources; the directions of building a rational system of land reclamation development in the context of the Federal Target Program "Development of Agricultural Land Reclamation in Russia for 2014-2020"are determined.

The article is devoted to the study of the representatives of the estates of the city of Shuya and Shuya district in the accounting and loan committee at the Ivanovo-Voznesensky branch of the State bank. The article substantiates the problem that the accounting and loan committees at the branches of the State Bank acted on the basis of the institute of public-private partnership. The article introduces into scientific circulation new archival materials containing information about Shuysky entrepreneurs in the post-reform period. The names of these persons are called. Their years of birth and estate affiliation are mentioned. There is information about the positions that Shuya entrepreneurs held in a given period of time. The author focuses on the reasons for the approval of these persons as members of accounting and loan committee. Information about the status of trade and property affairs of committee members, of their competence in a particular branch of trade, industry, agriculture, credit cooperation, their availability of credit in the bank is provided. The author seeks to follow the process of approval of Shuya entrepreneurs as a member of the committee. Particular attention is paid to the date of approval of entrepreneurs of Shuya as a member of the committee and the time they served in this position. The author comes to the conclusion about the importance of the institute of state-private partnership in Russian Empire in the post-reform period.

 A PPP – Public-Private Partnership – napjainkra elterjedt, közismert fogalommá vált, mely legtöbbször a különböző infrastrukturális beruházásokkal összefüggésben hangzik el. Megkockáztatom, az is közismert tény, hogy e jogintézménynek számtalan típusa, alfaja létezik. Az 1970-es évek végén, 1980-as évek elején indult hódító útjára a nyugati angolszász államokból, majd terjedt tovább a nyugat-európai kontinentális államokba, mely folyamatra az Európai Unió katalizátorhatást gyakorolt. A PPP a kelet-közép-európai államokba a 21. század elejére jutott el, amiben ezen államoknak az Unióhoz való csatlakozása meghatározó szerepet játszott. A kelet-közép-európai államokon kívül e jogi konstrukciót a 21. századra elsősorban a különböző nemzetközi szervezetek közvetítő tevékenysége okán kezdték alkalmazni a kevésbé fejlett afrikai és ázsiai államok alapvető infrastrukturális létesítményeinek kiépítésére, illetve fejlesztésére.
 
 
 

Public-private partnership in the agricultural sector: empirical estimation by factorial characteristics

The course taken by the Government of the Russian Federation to modernize the economy has the goal of bringing the national economy to the path of stable growth and development. For this purpose, various regulatory acts aimed at stimulating the innovative development of the agricultural sector were adopted and are being adopted. Within these measures, a key place is given to the development of the institution of public-private partnership (hereinafter - PPP), which is an important tool for ensuring economic security of the country. We assume, that the need for PPP instruments stems from the very specifics of the agro-industrial sector, which needs the state support to function successfully. The effective development of the agro-industrial sector requires scientifically sound accounting of natural, technical, socio-historical and organizationaleconomic factors. In this regard, there is a need to identify the peculiarities of the organizational and economic mechanisms for the development of the agro-industrial sector and to work out new approaches to its formation, considering that one of these approaches isPPP.

Implementation of Public-Private Partnership in The Russian Federation

The evolution of relations between the institutions of state and entrepreneurship in developed and developing countries at various stages of economic development has proved that their constructive interaction is a critical factor for successful socio-economic development. The constantly increasing gap between the needs and requirements of the population to public services, infrastructure, and budget constraints have resulted in the development of state-business partnership structures. The transforming role of the state in the economy necessitates the importance of finding alternatives to direct regulation of economic processes. One of them is the institute of public-private partnership (hereinafter referred to as PPP), which allows attracting additional resources to the economy, redistributing risks between the state and the business sector, directing entrepreneurial efforts to address important social and economic goals and objectives while maintaining the powers and functions of the state. Foreign experience shows that the implementation of PPP projects ensures significant cost savings.

Institutional Support of the Public-Private Partnership in the Republic of Poland

The experience of the institutional support of public-private partnership in the Republic of Poland has been analyzed. It is noted that Poland was one of the first among the post-communist countries to implement a mechanism of public-private partnership. The peculiarities of the practice of realization of public-private partnership in Poland during the 1990s and its legal support were determined. The possibility of its development on the basis of general norms of civil, economic, administrative and other branches of law is emphasized. The process of development and adoption of separate laws on public-private partnership and their specific features are described. The essence of discussions about the need for creation of a special authorized body for regulation of public-private partnership, which was caused by the problems that arose from public and private partners during the conclusion and implementation of the relevant agreements, was disclosed. The modern components of organizational support for supporting the development of public-private partnership in Poland, their role and their inherent functions are revealed: the Department for Public-Private Partnerships of the Ministry of Investment and Development, similar departments in public administration bodies of different levels, the Public-Private Partnership Platform, Polish Entrepreneurship Development Agency, Institute of Public Private Partnership, private law firms, scientific and educational institutions. The necessity to improve the institutional support of public-private partnership, which is realized by the government of Poland as well, is stated. The content and significance of the latest program documents in this area that are intended to improve the process of administration the development of public-private partnership — the concept «The vision of sustainable development for Polish business 2050» and «Government policy in the field of development of public-private partnership» are characterized. The importance of using the experience of the Republic of Poland in the practice of public administration of the Ukrainian system of public-private partnership is emphasized.

К вопросу о публичном и частном интересе в институте государственно-частного партнерства

We consider some issues of correlation between the theory of public law and civil law in the aspect of legal regulation of relations in the sphere of public private partnership. We analyze the definition of the concept of the agreement on public private partnership, we comprehend the issues of interaction and legal status of the participant of public private partnership, on the basis of the analysis of certain normative-legal acts of the subjects of the Russian Federation and their comparison with the budget legislation, we draw conclusions about the public nature of agreements in the field of public private partnership. We illustrate statistical information on the development of public private partnership in the subjects of the Russian Federation, identify a number of factors that determine the positive effect of interaction between the participants of public private partnership, to which we refers to the development of the institutional environment in the field of public private partnership, the quality level of legal support, improving the experience of implementing public private partnership projects. It is stated that the development of the Institute of public private partnership is essential for the economy of the country as a whole and for regions and municipalities in particular. At the same time, it is impossible to conclude public agreements without the will of the state represented by the relevant authorities. In addition, mentioning the role of private interest, it is noted that in the case of the subjects of the Russian Federation, private partners enter into relations enshrined in the laws of the subjects of the Russian Federation, where the possible forms of participation of the subject in public private partnership are clearly defined, which in a sense limits the freedom of private partners.

ВЗАИМОСВЯЗЬ РАЗВИТИЯ ЭКОНОМИКИ РЕСУРСНОГО РЕГИОНА И ЭФФЕКТИВНОСТИ ИНСТИТУТА ГОСУДАРСТВЕННО-ЧАСТНОГО ПАРТНЕРСТВА

The authors make an attempt to establish a relationship between the effectiveness of the institution of public-private partnership (PPP) and its ability to act as a development tool for resource regions. The methodology of the study included two stages. At the first stage, the problem of determining the resource regions and the approaches to their identification were outlined. The second stage involved an analysis of existing approaches to the evaluation of the PPP institution and the issue of assessing its effectiveness. The approaches have been classified into three groups; assessment basis, calculation criteria and algorithm for the evaluation methodology have been identified. At the third stage, the authors used the theory of fuzzy sets for a comprehensive assessment of the effectiveness of the PPP institution from the perspective of reducing the resource dependence of regions. Four clusters have been revealed, their comparative characteristics are given in the article. It is shown that high indicators of the development of the regulatory framework and the institutional environment do not ensure the effective development of the institute in the region. It is necessary to revise the initial expert evaluation of the criteria, refine the weights of PPP performance assessment factors, and re-clustering. The degree of development of the PPP institution is not sufficient to reveal the relationship with the degree of resource dependence.

ИНСТРУМЕНТЫ РАЗВИТИЯ ОТЕЧЕСТВЕННОЙ СИСТЕМЫ ПУБЛИЧНОГО УПРАВЛЕНИЯ В СФЕРЕ ФУНКЦИОНИРОВАНИЯ ГОСУДАРСТВЕННО-ЧАСТНОГО ПАРТНЕРСТВА

<p>The article analyzes the potential based on the methodology and instruments of the public administration paradigm in the development the institution of public-private partnership at various levels. The need to integrate public administration tools into the existing practice public private partnership is proved to increase its effectiveness and effectiveness. The study establishes correspondence between the main provisions of the public administration theory and the tasks of the public-private partnership development. It singles out the main modern practice development of public-private partnership, defining the need for the introduction of public administration. The research has revealed concrete directions of the implementation in public-private partnership on the basis of the public administration concept and methods. A mechanism of public-private partnership management based on modern tools is proposed. The article outlines some prospects for the transformation the traditional system of public-private partnership into a new paradigm public-private partnership. The results can be used by the authorities of the constituent entities of the Russian Federation and local governments when developing and implementing publicprivate partnership projects, or by commercial organizations when justifying participation in public-private and municipal-private partnership projects.</p>

Англо-Ирландский тип европейских пенитенциарных систем: организационно-правовые основы, средства обращения и условия содержания осужденных

The scientific basis of the classification and typology of the European penitentiary systems are presented. The method of comparative jurisprudence and the system analysis of the European penitentiary reality are used in this article. The methodological substantiation of the existence of a group of European states with their typical features of penitentiary practice is given. The author states the up-to-date characteristic of the Anglo-Irish type characterized by peculiarities caused, first of all, by its scope of the legal system of Common Law and the decline of the settled liberal approaches to a crime and penal pragmatism. The main characteristics of the type under consideration are joint jurisdiction of penal authorities, considerable specific proportion of prisons among correctional institutions, essential development of the elements of progressive penal correctional system, diverse and active usage of rehabilitative means and individual rehabilitative programs for prisoners as well as measures of prisoners’ re-socialization and relatively wide usage of the institution of public private partnership in the penal sphere. The attention is focused on the fact that in the context of active maintaining the progressive standards of treatment of convicted persons in prisons of the Benelux Union, some violations of the convicted persons’ rights are noted in the reports of the representatives of the CPT who visited Ireland, England and Wales, Northern Ireland and Scotland. The author draws a conclusion that the analysis of Anglo-Irish penitentiary type in the context of the controversial reform of the national penal system causes the natural research interest to the further typological comparative and legal study of European penitentiary chart.

ЗАРУБЕЖНЫЙ И РОССИЙСКИЙ ОПЫТ РАЗВИТИЯ ИНСТИТУТОВ ГОСУДАРСТВЕННО-ЧАСТНОГО ПАРТНЕРСТВА

The article is devoted to the Russian experience of the use of public-private partnership, the main problems related to its implementation in the Federation, as well as in the sectors of the construction sector. The article also studied the experience of individual countries in the implementation of public-private partnership. The main event on public-private partnership development, the implementation of which allows today to effectively apply the institute of public-private partnership in solving social problems.
 In this case, the search for consensus in the understanding of the essence of its authors realized the analysis of general and particular features of the category, including identified: 1) generalized notion category as private; 2) the selection of the essential characteristics of this form of interaction of building infrastructure. Isolation of the common symptoms of the category, achieved within the framework of the analysis of foreign and domestic experience of its use.

PUBLIC-PRIVATE PARTNERSHIP IN RUSSIA AS A FACTOR IN THE FORMATION OF AN INNOVATIVE ECONOMY

Institute of public-private partnership in the Russian Fede-ration is currently in its infancy and improvement by adapting international experience of cooperation between business and the state to domestic political-economic model, with its view of legal and regulatory features. The significance of this subject due to the international experience of the past decade suggests that a well-formed structure with the use of public-private partnerships to solve problems in the field of infrastructure and provision of public services, which is important for Russia because of the vast territory and low population density. Objective: To develop practical recommendations on the use of trans-promising forms of public-private partnerships in the innovation economy of Russia. Methodology: The development problems using various methodological approaches, including dialectical approach to the study of various phenomena and laws of development of socio-economic relations in the conditions of market economy; a set of techniques and methods of scientific knowledge of socio-economic phenomena and processes, among them – grouping method, comparison and synthesis, analysis and synthesis, induction and deduction, the system analysis. Conclusion: The article shows the main directions of development of public-private partnership in the Russian Federation. Practical recommendations on the use of advanced forms of public-private partnerships in innovation economy
