REGULATING SOCIO-ENVIRONMENTAL SUSTAINABILITY IN THE MUNICIPAL MASTER PLAN OF PORTO VELHO – RO, BRAZILAbstract: This paper researches the power of municipalities in Brazil to protect the environment through an urban master plan. The method used is the analysis of the participative elaboration process of 2021 Porto Velho’s Master Plan, in which the author assisted as a land law consultant. It will be seen the phases of the work and examined the documents of diagnostic, proposals, the bill's draft, and the approved law. It will also be seen the municipalities’ constitutional powers in Brazilian Federal Constitution for urban regulation and environmental protection and the relations between these two areas. The paper presents the discussion about the legitimacy of political changes on the master plan without technical support and the role of democratic participation process, and its actors, in the construction of urban policies. Regardless the events that jeopardize the desired environmental protection of Amazon Forest and the efficiency of urban services designed in the technical proposal, the conclusion is that the 2021 Master Plan represents an advance on urban policy and environmental protection regulation in the Amazon city of Porto Velho.Keywords: Amazon Forest Protection. O método utilizado é a análise do processo de elaboração participativa do Plano Diretor de Porto Velho de 2021, no qual o autor trabalhou como consultor de direito urbanístico. Serão observadas as fases do trabalho e analisados os documentos de diagnóstico, propostas, projeto de lei e a lei aprovada. Também serão vistas as competências constitucionais dos municípios na Constituição Federal brasileira para regulação urbana e proteção ambiental e as relações entre essas duas áreas. O artigo apresenta a discussão sobre a legitimidade das mudanças políticas no plano diretor sem apoio técnico e o papel do processo de participação democrática, e seus atores, na construção de políticas urbanas. Independentemente dos eventos que comprometem a desejada proteção ambiental da Floresta Amazônica e a eficiência dos serviços urbanos desenhados na proposta técnica, conclui-se que o Plano Diretor de 2021 representa um avanço na política urbana e na regulação da proteção ambiental na cidade amazônica de Porto Velho.Palavras-chave: Proteção da Floresta Amazônica. Se observarán las fases de la obra y se analizarán los documentos de diagnóstico, propuestas, proyecto de ley y ley aprobada. También se verán las competencias constitucionales de los municipios en la Constitución Federal brasileña para la regulación urbana y la protección del medio ambiente y las relaciones entre estas dos áreas. El artículo presenta el debate sobre la legitimidad de los cambios políticos en el plan maestro sin apoyo técnico y el papel del proceso de participación democrática, y sus actores, en la construcción de políticas urbanas. Independientemente de los acontecimientos que comprometan la deseada protección ambiental de la Selva Amazónica y la eficiencia de los servicios urbanos diseñados en la propuesta técnica, se concluye que el Plan Maestro de 2021 representa un avance en la política urbana y la regulación de la protección del medio ambiente en la ciudad amazónica de Porto Velho. A articulação entre planejamento territorial e licenciamento ambiental tem o potencial de beneficiar o licenciamento ao proporcionar agilidade e simplificação de processos, além de ampliar a possibilidade de participação pública. O Brasil adota diferentes instrumentos de planejamento territorial para diferentes recortes territoriais e com diferentes enfoques (ex.: planos de manejo de unidades de conservação; zoneamentos ecológico-econômicos, elaborados principalmente para estados ou regiões; e planos diretores municipais, devendo abranger as áreas urbana e rural dos municípios). Entretanto, muitos dos benefícios da articulação entre estes instrumentos e o licenciamento ambiental ainda não foram alcançados ou nem mesmo são reconhecidos ou valorizados. Buscando contribuir para uma mudança de visão e das práticas neste sentido, o presente trabalho apresenta um panorama sobre os zoneamentos ecológico-econômicos elaborados no Brasil, bem como sobre os planos diretores municipais, e discute se o licenciamento ambiental tem sido abordado nesse contexto. Para o zoneamento ecológico-econômico, foi consultado o sítio eletrônico do Ministério do Meio Ambiente e as informações disponíveis sobre a situação do ZEE no Brasil e, sobre os planos diretores municipais, foram consultados o relatório organizado pelo Observatório das Metrópoles sobre os planos diretores pós-Estatuto da Cidade e o relatório sobre o Perfil dos Municípios Brasileiros, organizado pelo IBGE. Como resultado, observa-se que: (1) dos 58 zoneamentos ecológico-econômicos já concluídos, apenas 21 são normatizados e, dentre estes, 16 mencionam ou atrelam condições para o licenciamento ambiental às suas diretrizes e zonas; (2) em relação aos planos diretores municipais, poucos fazem referência ao licenciamento ambiental ou deixam tal indicação para regulamentação posterior. Conclui-se que, embora o Brasil possua instrumentos de planejamento territorial aptos a trabalhar de forma articulada com o licenciamento ambiental, não há apenas falha no estabelecimento prático desta relação, mas também há lacunas de planejamento territorial, o que dificulta a ampla aplicação destes instrumentos de forma articulada.

Concerns for the common good in urban planning are relevant in many parts of Europe due to financial crises, lack of public resources, and the impact of climate change. The actualisation of the assessment of the common interests of society is also promoted by processes such as the democratisation of governance and the “right to the city” of residents. The study aimed to evaluate existing municipal master plans in Latvia, reviewing the restrictions on property rights, their proportionality, and the argumentation about the common good of society. This was accomplished through content analysis to evaluate the regulatory enactments and the text of the municipal master plans and their amendments, which are available on the GEOLatvia.LV portal. To compare the content of documents, comparative analysis was used (for example, adoption of historical norms, duplication of content, etc.). For document comparison, term matching analysis and other artificial intelligence tools are used. The results of the study concluded that the practice of local governments in the development and content of municipal master plans is diverse. Municipalities interpret the requirements of regulatory enactments that determine the requirements for developing local government plans in different ways. Generally, it can be concluded that the formal implementation of regulatory requirements does not achieve the goal set in the explanations. To improve the quality of explanations and justifications for municipal master plans and their amendments, it is necessary to popularise and promote the use of additional planning tools, such as research and thematic plans, evaluate development scenarios, and justify interventions in planning documents, especially restrictions set by municipalities.

The gap between morphological knowledge and urban planning is a major problem. The absent or insufficient morphological components of most planning instruments, like municipal plans, seem to reduce planning ability to define adequate rules for urban form transformation. This paper suggests that an integrated methodology for Morphological Analysis and Prescription (MAP), which benefits from the convergence of key complementary methods—morphological regionalization, typological process, and configurational analysis—can be a powerful tool to support planning practice, enabling a structural and comprehensive understanding of urban form dynamics. The Amial area, in Oporto, Portugal, is the setting for comparing the morphological analysis and proposals of MAP and the Oporto municipal master plan (Plano Diretor Municipal), and empirically examining the robustness of MAP.

This research seeks to understand the possibilities of qualitative urban changes in urban space, which municipal master plans can enhance through the application of precepts outlined by the 2030 Agenda and educating cities according to the International Association of Educating Cities, conceived after the COVID-19 pandemic. Initially, this study presents and expands the tacit and informal knowledge that transforms the adjuvant urban space into the informal education process, complementary to the explicit knowledge that the official curriculum contents address. It shows that urban space, as a social instance, extrapolates its physical materiality and contains symbols and signs that enable rereading the culture that built it, also revealing historical moments and techniques that have transformed it over time, making the city an enormous classroom, decisively inducing the construction of citizenship. It evidences the advantages of treating the city planning and management from the standpoint of education for all, touching on social encounters as a way to promote alterity, politicize urban life, and exchange knowledge, noting that the Brazilian Federal Constitution requires public participation in the very preparation of master plans. Methodologically, the research supports all knowledge made explicit, presenting references from several renowned authors, and evidences some singularities of the spaces regarding the coexistence in the urban environment. During and after the pandemic, the municipal master plan, taking space as a social instance that educates for sustainability, as proposed in the 2030 Agenda, will assuredly be one of the structuring axes of quality of life in the post-pandemic period.

Cultural heritage management and local development in a South Sámi and Norse mountainous borderland

ABSTRACTThe article discusses how municipal planning and management can enable South Sámi and Norse cultural history to contribute to local development in two sparsely populated mountain municipalities in south-east Norway. The authors’ methods comprised document studies of relevant planning documents and treatment of single cases, and interviews with actors at different levels, who were responsible for cultural heritage, land use planning, industrial development and reindeer husbandry. The findings revealed that the organization of cultural heritage management was extremely fragmented in terms of responsibilities, activities and localization. Responsibility for managing Norse and Sámi cultural heritage is divided between counties and the Sámi Parliament, and the municipalities have no legal responsibilities. This fragmentation contributes to the neglect and marginalization of cultural heritage management in general, and especially the management of Sámi cultural heritage. The discourse of attractiveness based on competing for in-migration from other municipalities holds a hegemonic position in both municipal master planning and regional planning. The authors conclude that a different approach based on local community development, namely the residential place, should be prioritized, whereby cultural heritage is used to strengthen the inhabitants’ knowledge, identity and ‘sense of place’.

Potencialidade do planejamento participativo no Brasil

O objetivo central deste trabalho é realizar uma reflexão das potencialidades apresentadas pelos atuais planos diretores municipais no Brasil em contraposição aos planos tradicionais, pois o Estatuto da Cidade (2001) trouxe uma ressignificação a esses planos ao designá-los de "planos diretores participativos", na orientação de formulação de planos com a perspectiva de uma efetiva participação popular. Para atingir este objetivo será trabalhada a experiência concreta de dois objetos de estudo: o Plano Diretor Participativo e o Orçamento Participativo e tomar-se-á o município de Londrina/ Paraná, para verificar a aplicação dos pressupostos da participação popular na produção do plano diretor municipal e como exemplo da aplicação do orçamento participativo o município de Porto Alegre / Rio Grande do Sul.

Interfaces da gestão ambiental urbana e gestão regional: análise da relação entre Planos Diretores Municipais e Planos de Bacia Hidrográfica

Este artigo relata uma pesquisa que discute como a questao ambiental vem sendo tratada nos instrumentos e praticas de gestao localizadas em dois recortes territoriais: municipios e bacias hidrograficas. Foi analisada a relacao da dimensao ambiental com a gestao regional e municipal, por meio dos instrumentos Planos de Bacia Hidrografica e Planos Diretores Municipais, tendo como locus a Unidade de Gerenciamento de Recursos Hidricos Tiete-Jacare do Estado de Sao Paulo. Os objetos de pesquisa selecionados foram o Plano de Bacia Hidrografica Tiete-Jacare e os Planos Diretores de Araraquara e Sao Carlos. A pesquisa abordou as seguintes categorias de analise: unidades de planejamento, instrumentos ambientais contidos no Plano de Bacia e nos Planos Diretores, instâncias de gestao e grau de influencia entre os planos analisados. O metodo se pautou em levantamentos, analises bibliograficas e documentais, entrevistas semiestruturadas e questionarios. Os resultados obtidos apontaram que o Plano de Bacia Hidrografica ainda apresenta lacunas e dificuldades para uma atuacao mais ampliada. Nao reconhece os conflitos de uso da terra e de organizacao territorial como uma vulnerabilidade que precisa ser enfrentada. Mostraram, ainda, que os Planos Diretores Municipais concentram-se na aplicacao dos instrumentos voltados ao parcelamento e ao zoneamento urbano. Nesses planos, as condicoes e os aspectos ambientais e regionais se apresentam como uma tematica periferica e pouco articulada com as demais politicas. As analises procuraram demonstrar a complexa relacao entre politicas, instrumentos e instâncias de planejamento e gestao, explicitando os obstaculos que dificultam a aplicacao do conceito de gestao territorial integrada.

People are walking in cities for different reasons. Some walkers walk for going to work, some are walking for shopping and some are for leisure during day and night hours. Medium sized cities like Braga and Guimaraes in Portugal are depending on car for even shorter trips up to 2 kilometers. However, the walkways are allowing people to walk in convenient and safe way including late night environment. The pedestrians feel troublesome to walk on the footpaths because of illegal parking and discontinuation of walkways. Municipality transport plans and master plans do not incorporate pedestrians as a major component. But this egress mode of transportation is very important in medium sized city centers like Guimaraes and Braga for the people to enjoy city centers’ activities. This paper focuses on the types of walkers who use the walkways on a regular basis. Usually, people are feeling comfortable to walk when they go to clubs and bars in a group in these small cities especially after work. This paper again tries to focus the varieties of problems on walkways and to present policies that can improve the situation. Municipal master plan and transportation plan have been studied carefully to see the provisions of pedestrian planning options. Field surveys have been conducted both in form of questionnaire and observation during the end of 2009 and results show different patterns of pedestrian behavior as well as evidence that people get different experiences with problems while walking on the walkways in both surveyed towns. Considering the issues of sustainable mobility, this paper also tries to suggest policies to motivate more people to walk especially in the medium-sized cities of Portugal.
