Abstract

E-justice platforms are becoming the new working environment of judicial institutions. Their development is challenging, with failures and incomplete deployments. At the same time, their implications go beyond the functional level and entail legal, governance and even constitutional dimensions. The paper analyses the two e-justice platforms used to handle civil and criminal proceedings in Italy. Trial OnLine (TOL) is the fully deployed e-justice platform for civil proceedings, while Criminal proceedings online is similar but much less developed. Tracking the two case histories and analysing similarities and differences allows to identify common challenges and functional and institutional implications.
