Abstract
The article examines current trends in modern Anglo-American legal positivism — “inclusive” and “exclusive” positivism. A study of the memory of Herbert Hart as the founder of analytical trends and works, his critics and followers of the existence of the two named vectors. the determination between them takes place in the field of axiology and fundamental provisions that determine the judicial procedure from nonlegal arguments.
