Efforts to Strengthen Cyber Defense and Cyber Security of the Indonesian Government in Maintaining National Security

The development of science and technology makes the threat to national defense also widen. From threats in the form of physical and non-physical. Increasingly sophisticated technology introduces people to the internet. Internet has become one of the primary needs today. Almost all activities are centralized from the Internet. Socio-economic, political, culture has been affected by the existence of the internet. Relations between communities have become very easy with the internet connected by social media. Out of a total of 270 million Indonesians, more than 170 million are active on social media. Not only that, economic activities, education to health have been facilitated by an online system with the existence of E-commerce and similar applications. This research discusses efforts to strengthen the Indonesian government's cyber defense and cyber security in maintaining national security. Using a descriptive qualitative research method, the author will discuss further the Indonesian government's efforts to strengthen cyber defense and security. One of these efforts has been carried out by issuing Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions, the existence of this PP strengthens the protection of personal data and information. Therefore it becomes interesting to be discussed further.

Legal Urgence for Registration and Establishment of Legal Fintech Companies Based on Information Technology Authority Regulation Number 77/Pojk.01/2016 Concerning Money-Base Loan Services and Bank Indonesia Regulation Number 19/12/Pbi/2017 Concerning

This study aims to discover and analyze how the Financial Services Authority regulations and the Bank Indonesia regulations relate to information technology-based money lending and borrowing activities in the implementation of fintech peer-to-peer lending, particularly for Paylater users who feel disadvantaged by seeing what it looks like and how the explanation of the regulations regulate fintech, so that many consumers continue to feel disadvantaged. In addition, how is the supervision provided by the Financial Services Authority to administrators of peer-to-peer lending activities in accordance with the governing laws and regulations? In this study, we used a normative juridical research type with a statutory approach (the statute approach) and a case approach (the case approach) by conducting a literature study. The results of this study explain that the form of regulation on fintech peer-to-peer lending is regulated in Financial Services Authority Regulation Number 77/POJK.01/2016 concerning information technology-based money lending services and Bank Indonesia Regulation Number 19/12/PBI/2017 concerning the implementation of financial technology, and Government Regulation Number 82 of 2012 concerning the implementation of electronic systems and transactions, with arrangements for organizers to record, a regulatory sandbox, registration, and licensing to the Financial Services Authority. That the cases that occurred, as seen through the existing arrangements, continue to fail to accommodate the cases encountered by consumers. Regarding this action, the supervision provided by the Financial Services Authority is in the form of pre-operational supervision and supervision during operations, but there are obstacles in supervision, namely the absence of the Financial Services Authority's fintech department to resolve all problems from the Financial Services Authority's side, and at the supervision stage, it is not able to adapt to innovation so quickly.

Code Checking using BIM for Digital Building Permit: a case study in a Brazilian municipality

There is a growing interest from municipalities around the world in digitizing the building permit process using building information modeling (BIM) and geographic information system (GIS) for automated code checking. However, technical, political, and commercial barriers still prevent digitization from becoming a reality and being widely implemented and locally adapted. The main objective of this research is to analyse best practices and lessons learned by a Brazilian municipality for BIM-based electronic system implementation. The adopted methodology included a comprehensive literature review of existing international initiatives in America, Europe, and Asia. Data collection occurred in a case study in a Brazilian municipality implementing BIM to digitize the different types of existing permits. The results indicate the leading practices and lessons learned by the municipality in their internal stage for developing the automated code checking system and promoting changes in processes, policies, and organizational culture. The findings also highlight best practices and promising international experiences, a comparative analysis with the Brazilian municipal context. The main contribution of this study is to provide a greater understanding of the required practices and the BIM/GIS role in the digital building permit process. As a practical contribution, the experiences in the Brazilian context provide valuable inputs for the journey of smart cities.

Perlindungan Hukum Terhadap Kurir Jika Terjadi Ketidaksesuaian Pengiriman Barang Terhadap Konsumen Dalam Transaksi Cash on Delivery (COD)

The digital world offered by the sophistication of the Internet, presents new innovations that change old conventional habits. The existence of the development of the internet, presents an innovation where the market can be reached anytime and anywhere, and under any conditions known as E-commerce or electronic commerce. The sale and purchase is considered to have occurred if both parties have agreed on the goods and prices, even though the goods have not been delivered or the price has not been paid. The formulation of the problem is regarding the legal relationship of the parties in COD transactions, as well as legal protection in COD transactions. The method used in compiling this research is a research with a normative method approach. The source of the research that the author took is in the form of normative analysis related to regulations related to the protection of couriers, such as Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions, Law Number 22 of 2009 concerning Road Traffic and Transportation, and Law No. Number 38 of 2009 concerning post. The COD mechanism does not stop only at the relationship between the seller and the buyer, but involves parties that are very important for the operation, namely the delivery service company and courier delivery service, which presents a new legal relationship in the COD transaction process. Couriers in delivering goods to consumers or recipients of goods are also responsible for the goods delivered, if there is damage on the basis of negligence on the part of the courier, the courier is responsible for the goods, however, as long as it is not the fault of the courier, the courier will not be charged and compensation for damaged goods.

Proposals for Improving the System of Radiation Safety in Medical Exposure. Part 1. Analysis of information contained in state reporting forms and information databases in Moscow

The aim of the search was to compare the sources of information and evaluate dynamics of changes of the patients doses during x-ray and radionuclide examinations in medical organizations in Moscow from 2017 to 2020. Material and methods: Reporting forms № 3-DOZ, № 30 and Radiation-Hygienic Passport for 2017–2020 from Moscow organizations of different forms of ownership were collected and analyzed. The analysis was performed of the main indicators that determine the radiation safety in medical exposure: the number of medical organizations operating sources of ionizing radiation, the equipment of radiation diagnostics, the structure of radiation diagnostics and collective doses from medical exposure. Results: The analysis of trends of the development of radiation diagnostics in Moscow presented in the paper shows that the number of organizations operating ionizing radiation sources is increasing every year; the number of computed tomography scanners is growing by an average of 10% per year, and there is approximately the same increase in the number of computed tomography examinations. Therefore, in 2017-2019 the annual increase in the number of examinations was 10%; it was 30% in 2019–2020, which is associated with the epidemic of the new coronavirus infection COVID-19. The increase in the collective dose from medical exposure corresponds to the increase in the number of X-ray examinations. Comparison of the considered reporting forms and data from the unified X-ray information system shows that all reporting forms have their advantages and disadvantages, which are discussed in detail in the paper. For a comprehensive assessment of the condition of radiation diagnostics, it is necessary to compile data from different statistical reporting forms, which negatively affects the reliability and representativeness of the data. It should be noted that all the considered statistical reporting forms provide no data on individual and accumulated patients doses, as well as standard (typical) doses for the equipment of X-ray and radionuclide diagnostics. The existing procedure of data collection does not allow to receive and analyze the data online. Conclusion: Among the analyzed statistical reporting forms, there is no one that fully provides the tasks of the current assessment of the situation and operational management of public radiation doses. Some of the data in fact duplicate each other, and the existing discrepancies are more likely express difficulties in collecting and summarizing information than differences in reporting forms. Current statistical reporting forms require revision, consolidation, clarification and automation of data collection processes. Further implementation of electronic systems for recording and controlling patients doses, and generation monitoring and reporting systems, as well as interdepartmental interaction systems and the creation of an electronic office of organizations will reduce the rate of non-submission of reporting documentation. That makes it more objective and provides all the data necessary to optimize radiation protection of patients.

Legal Protection of Film Copyright Holders Against the Distribution of Free Film in Telegram Media

Copyright is an exclusive right owned by someone who creates a product that can be realized in a tangible form without compromising the laws and regulations. The function of copyright is protection of the work inherent in the maker, but it is the best compared to the reality in the field. In Internet media, in this case, telegrams are widespread and accessible regarding film series, the legal phenomenon violates copyright in the film works made by someone even though the legal protection arrangements for copyright have been regulated in Law Number 28 of 2014 concerning Copyright and are also contained in Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions. Of course, law enforcement and legal efforts need to be carried out through various solutions which will be discussed later in this paper where the method used in this paper uses normative juridical research with literature and assesses several relevant laws and regulations using qualitative descriptive analysis techniques. The study results indicate that the regulation regarding Law Number 28 of 2014 and its joint ministerial regulation has not been effective and does not work for the legislation to protect copyrights for works owned by someone.

Upaya Hukum Terhadap Debitur Pada Layanan Pinjaman Uang Berbasis Finansial Teknologi

This study's objective is to investigate the legal remedies taken against debtors of technology-based financial lending services and how to avoid problems with technology-based money loan services. This research is normative legal research undertaken by reviewing and analyzing literature and statutory books. According to the findings of the research, legal remedies against debtors in peer-to-peer lending services are governed by Law No. 11 of 2008 regarding Information and Electronic Transactions. Law No. 21 of 2011 pertaining to the Financial Services Authority, Government Regulation No. 82 of 2012 pertaining to the Implementation of Electronic Systems and Transactions, Regulation of the Financial Services Authority No. 1/POJK.07/2013 of 2013 pertaining to Consumer Protection in the Financial Services Sector, Regulation of the Financial Services Authority No. 77/POJK.01/2016 Year 2016 pertaining to Information Technology-Based Lending and Borrowing Services, Minimal Capital Requirements, and Minimal Capital Requi Legal Efforts, Debtors, Money Loan Services, and Financial Technology are keywords.

Responsibilities of Business Actors to Consumers Due to Incompatibility of Objects and Specifications in Electronic Transaction Agreements

This article aims to determine the legal protection for the violation or non-fulfilment of consumer rights in transactions conducted electronically and to determine the form of responsibility of online business actors for acts of default against consumers in transactions conducted electronically. Then, this research is normative juridical research supported by a statutory approach. In addition, this research is also supported by various data sources, including primary legal materials in the form of laws and regulations, secondary legal materials consisting of books and scientific journals, and tertiary legal materials covering various complementary information and data originating from various websites on the Internet. The results of the study explain that in conducting transactions of goods and/or services, especially those carried out electronically, various laws and regulations such as UUPK, UU ITE, and PP concerning the Implementation of Electronic Systems and Transactions have guaranteed the rights of consumers and provided obligations to business actors. In this case, if the consumer's rights are violated or, in other words, the business actor does not carry out his obligations. The consumer is entitled to compensation or compensation. Therefore, as a form of responsibility for the occurrence of violations of consumer rights in the form of receiving goods or objects and specifications that do not match the specifications, business actors are obliged to provide compensation. If this cannot be fulfilled, it is possible to take various litigation and non-litigation dispute resolution options.

Pengaruh Tata kelola Kolaborasi dan UU Cipta kerja Terhadap Perkembangan UMKM Disaat Pandemi Covid 19

This research is related to the development of MSMEs in Indonesia. The dependent variable used in this study is the development of MSMEs during the Covid 19 pandemic, while the independent variables are collaborative governance and the Omnibus Law. The power of sharing in collaborative use of social media is the key to the success of MSME marketing during the COVID-19 pandemic. The Omnibus Law encourages the strengthening of the MSME ecosystem through various facilities, including ease of licensing, certification, financing, market access, training, digital infrastructure, implementation of electronic systems and transactions, as well as the business climate in the MSME sector. The purpose of this study was to determine and analyze the influence of collaborative governance and the Omnibus Law on the development of MSMEs during the Covid 19 Pandemic. The method used in this research is descriptive quantitative by taking a sample of 30 MSME actors in Jakarta. The conclusion of this study is that there is a significant influence between collaborative governance and the Omnibu Law on the development of MSMEs during the Covid-19 Pandemic

The Secondary Use of Data to Support Medication Safety in the Hospital Setting: A Systematic Review and Narrative Synthesis.

Objectives: To conduct a systematic review and narrative synthesis of interventions based on secondary use of data (SUD) from electronic prescribing (EP) and electronic hospital pharmacy (EHP) systems and their effectiveness in secondary care, and to identify factors influencing SUD. Method: The search strategy had four facets: 1. Electronic databases, 2. Medication safety, 3. Hospitals and quality/safety, and 4. SUD. Searches were conducted within EMBASE, Medline, CINAHL, and International Pharmaceutical s. Empirical SUD intervention studies that aimed to improve medication safety and/or quality, and any studies providing insight into factors affecting SUD were included. Results: We identified nine quantitative studies of SUD interventions and five qualitative studies. SUD interventions were complex and fell into four categories, with ‘provision of feedback’ the most common. While heterogeneous, the majority of quantitative studies reported positive findings in improving medication safety but little detail was provided on the interventions implemented. The five qualitative studies collectively provide an overview of the SUD process, which typically comprised nine steps from data identification to analysis. Factors influencing the SUD process were electronic systems implementation and level of functionality, knowledge and skills of SUD users, organisational context, and policies around data reuse and security. Discussion and Conclusion: The majority of the SUD interventions were successful in improving medication safety, however, what contributes to this success needs further exploration. From synthesis of research evidence in this review, an integrative framework was developed to describe the processes, mechanisms, and barriers for effective SUD.

Perlindungan Hukum Terhadap Pengguna Aplikasi E-Commerce yang Terdampak Kebocoran Data Pribadi

Technological developments continue to develop very rapidly, one of which is in the electronic trading system, hereinafter referred to as e-commerce. Along with this, there are concerns from E-Commerce application media users regarding personal data stored by E-Commerce application media companies, so that more specific rules are needed regarding legal protection for E-Commerce application users. The purpose of this research is to further review the rules related to legal protection for users who are affected by the leakage of personal data on E-Commerce media such as based on the agreement in the Terms and Conditions as well as the rules of related laws such as, the ITE Law and its amendments, PP 71/2019 concerning the Implementation of Electronic Systems and Transactions, Government Regulation Number 80 of 2019 concerning Trading Through Electronic Systems, Regulation of the Minister of Communication and Information Technology Number 20 of 2016 concerning Protection of Personal Data in Electronic Systems. The method used in this research is normative juridical research, with a statutory approach. The collection of sources of legal materials, both primary and secondary, is carried out through laws and regulations and all official documents that contain legal provisions and searches related to research results such as journals and the internet.

Challenges in the implementation of electronic systems for patient report of symptoms in oncology: a scoping review.

Under-recognition and under-treatment of symptoms are prevalent throughout the health care system in the United States. While the reasons for this are complex, it is widely recognized that electronic symptom reports can improve clinicians' ability to manage symptoms. However, electronic symptom reporting has yet to be widely implemented. Electronic systems are most effective when tailored to the specific patient population or clinical setting. For example, numerous oncology-focused electronic symptom reporting systems have been developed for patients with cancer undergoing treatment in the United States. The objective of this scoping review was to identify challenges that arose in the implementation of electronic systems for patient-reported symptoms in oncology clinical practice, and approaches that were taken or recommended to overcome those challenges. This scoping review involved comprehensive searches of Medline, CINAHL, and the Cochrane Central Register of Controlled Trials, which yielded 3,133 articles. Following screening, 20 research studies met the inclusion criteria and were included in this review. Data were systematically extracted from the articles using a qualitative content analysis. Challenges identified were thematically categorized as technical issues, system usability issues, patient lack of comfort/knowledge of technology, incomplete/missing data, lack of patient use of the system, other patient issues, difficulties timing completion with clinical processes, lack of clinic staff involvement/engagement, and lack of clinician comfort/knowledge regarding the use of patient-reported outcome data. The findings of this review highlight challenges that need to be addressed when implementing an electronic symptom reporting system for patients with cancer, and potential strategies for overcoming these challenges. This review may help hospital administrators and clinicians prepare for and improve the implementation of electronic symptom reporting systems into clinical practice, thereby providing evidence to enable their broader use.

Nursing staff's assessments of medication management process in the psychiatric and operative domains: A cross-sectional study after introduction of an electronic medication chart.

To describe nursing staff's assessments of medication management process in the psychiatric and operative domains after introduction of an electronic medication chart. The medication management process includes all structures and practices within the organisation that guide and support medication administration and related procedures. A cross-sectional survey. A Finnish version of the Medication Administration System - Nurses Assessment of Satisfaction (modified MAS-NAS) paper-based questionnaire was sent to all nursing staff (N=855) working in operative (n=498) and psychiatric (n=357) domains in one central hospital. Data were analysed using statistical methods. In total, 324 nursing staff members participated. More than half agreed that medication management is efficient (64%), safe for patients (76%), and that the current medication administration system provides the necessary medical treatment information (e.g. prescriptions by physicians, medication data) (64%). Respondents' overall satisfaction with medication management process was slightly above average on a scale from 1 to 10 (mean=6.2; SD=1.8; median=7, range 2-9). Respondents who used electronic medication chart reported higher overall satisfaction with medication management process (median=7, mean=6.1, SD=1.8 and range 2-9) than those not using it (median=6.5, mean=6.3, SD=1.6 and range 2-9). No statistically significant difference was found (U=8552.000, p=0.33). This study revealed several problems in the medication management process. The results can be used in developing the medication management process. Electronic medication chart should be used and developed further in terms of efficacy, safety and access. One year after the electronic medication chart was introduced, only half of the respondents had used it. That is why implementation of electronic systems or technological applications should be carefully considered as a whole.

Liability of Marketplace as Electronic System Provider in Regard to System Failure Occured on Online Transactions

Digital transaction activities in community activities have increased due to the accelerated adoption of digitalization in Indonesia but it also has potential problems in the future such as many frauds and even crimes that often occur in cyberspace so that they tend to harm consumers or users. This research also examines the liability of Electronic System provider in regard to the system failure occurrence on online transaction. However based on the research The existence of current regulations concerning Electronic Information and Transactions in conjunction with Government Regulation Number 71 of 2019 concerning Implementation of Electronic Systems and Transactions the liability in the case of system failure that causes losses to the other party, is not explicitly stated there are no sanctions for indemnity for Electronic System Provider the existing regulation only regulate the administrative sanction Therefore, the author suggests that electronic system provider must secure, carry out maintenance and all the efforts necessary for the electronic system to work properly to be reliable. Liability for system failures that cause harm to other parties must be explicitly stated in the Regulations

Spanish Version of the System Usability Scale for the Assessment of Electronic Tools: Development and Validation.

BackgroundThe System Usability Scale (SUS) is a common metric used to assess the usability of a system, and it was initially developed in English. The implementation of electronic systems for clinical counseling (eHealth and mobile health) is increasing worldwide. Therefore, tools are needed to evaluate these applications in the languages and regional contexts in which the electronic tools are developed.ObjectiveThis study aims to translate, culturally adapt, and validate the original English version of the SUS into a Spanish version.MethodsThe translation process included forward and backward translation. Forward translations were made by 2 native Spanish speakers who spoke English as their second language, and a backward translation was made by a native English speaker. The Spanish SUS questionnaire was validated by 10 experts in mobile app development. The face validity of the questionnaire was tested with 10 mobile phone users, and the reliability testing was conducted among 88 electronic application users.ResultsThe content validity index of the new Spanish SUS was good, as indicated by a rating of 0.92 for the relevance of the items. The questionnaire was easy to understand, based on a face validity index of 0.94. The Cronbach α was .812 (95% CI 0.748-0.866; P<.001).ConclusionsThe new Spanish SUS questionnaire is a valid and reliable tool to assess the usability of electronic tools among Spanish-speaking users.

The Validity of Electronic Contracts in Software Applications

The development of information and communication technology resulted in the form of agreements turned into electrical forms, which are commonly referred to as electronic contracts. Discussion on electronic contracts refers to Article 46 paragraph (2) President Regulation No. 71 of 2019 on the Implementation of Electronic Systems and Transactions must also fulfill the legal conditions of the agreement. Based on this case, it is necessary to do a deeper study of the electronic contract, because it certainly has the potential to not fulfill the legal conditions of the agreement.Method research used in this research is library research. While the approach in this study uses a normative juridical approach. The source of legal material in this study uses primary and secondary legal materials.The results of this study state that the validity of electronic contracts in software applications can be canceled and null and void. Electronic contracts in software applications can be canceled because they do not meet the subjective requirements in terms of skills. This is because those who make electronic contracts through click warp have the potential to be immature, because they are under 18 years of age. Especially in the context of the use of smartphones or other devices related to the use of software applications, there are no clear rules regarding the minimum limits of users of such smartphones or devices. While the electronic contract has the potential to be null and void because the electronic contract is potential to conflict with the laws and regulations of Article 47 paragraph (1) President Regulation No. 71 of 2019 on the Implementation of Electronic Systems and Transactions. Electronic contracts in software applications are generally made using foreign languages, while Article 47 paragraph (1) requires that electronic contracts faced by Indonesian citizens must be made in Indonesian.Keywords: Electronic Contracts; Click Warp Agreement; Terms of Legitimate Agreement.

A Shift in The Principle of Bank Secrecy due to Advancement in Information Technology

Bank secrecy is a conditional legal agreement used by a bank to guarantee the confidentiality of customers' dealing and financial affairs. However, the advancement in information technology, especially in the implementation of electronic systems and transactions across banks, has introduced tremendous changes in the ability of financial institutions to efficiently secure customers’ data. This study provides a detailed explanation of the transformation process using the normative method. The result showed a shift in the principle of bank secrecy to data security in the event of a violation.

Oncology Research: Clinical Trial Management Systems, Electronic Medical Record, and Artificial Intelligence.

To discuss the implications of electronic systems and regulations regarding the use of electronic systems implemented during the conduct of a clinical trial and identify the impact of such platforms on oncology nurses' responsible for providing care to the research participant. Peer-reviewed journal articles, internet, book chapters, and white papers. Electronic systems are being increasingly used in the conduct of clinical research. Electronic systems enable the capability to streamline data transfer, remote enrollment capabilities, greater transparency of the trial conduct, improved research documentation, and clearer audit trails. The oncology nurse is at the center of implementation of electronic systems to support the conduct of clinical research and enables safe and effective care to the research participant. Oncology nurses are vital to the successful outcome of clinical research studies and are key members of the clinical research team. Electronic systems move beyond traditional data collection in clinical trials with multiple benefits. Such systems may enhance the successful completion and adherence of the clinical trial and maintain the safety of the individual consented to research trial.

Adaptation of international public service digital indicators in ukraine’s health system: prob­lems and prospects

Digital transformation of healthcare in many countries around the world is aimed at strengthening the healthcare system with respect to increasing staff shortages, aging of population and increasing number of chronic diseases. Technologies which are used for digitalization of healthcare system include electronic systems that provide electronic storage of patients’ medical data, electronic networks for exchange or transferring of patient data to other medical practitioners and professionals, electronic systems for diagnostic or prescription of drugs, telemedicine (providing health care services remotely), mobile phones and devices (more than 165,000 mobile applications for medical services have been developed), robotics, artificial intelligence and genomics, the scientific area that uses data on human genome to diagnose the disease. Permanent collection, analysis and use of data on patients’ health status can improve the quality and effectiveness of the health care service substantially. A number of indicators has been developed by the European Commission to monitor the level of diffusion and effectiveness of electronic health systems. Some of them are included in the Digital Economy and Society Index (DESI), which consists of more than 30 indicators for the EU member countries. Getting data on those indicators in Ukraine requires identification of problems of their applications in the Ukrainian economy by the indicators of the Digital Public Services (eHealth) section. Recommendations for solving the identified problems to ensure the effective implementation of electronic systems in the health care of Ukraine were elaborated in the paper.
