A multi-objective optimization framework of constellation design for emergency observation

To meet the urgent needs of emergency observation missions, a well-designed constellation is key to ensuring system performance. This paper presents a multi-objective optimization framework which is well suited for constellation designers to identify key trade-offs and make decisions. Firstly, this work investigates the metrics of responsiveness and coverage simultaneously to approximate to the actual conditions of emergencies, and a multi-objective mathematical model is constructed to explore solutions to enhance the overall system performance. Then, according to the characteristics of emergency missions, a hierarchical chromosome encoding method is proposed in the framework to encode a solution that explores different sized constellations without constraining its specific geometry. Finally, we propose the use of radial axes plots to help constellation designers to gain pragmatic insights for informed decision making. The simulation of disaster management verifies that the proposed chromosome encoding method effectively promotes the convergence of the algorithm, and the multi-objective optimization framework helps to generate a rapid and adequate observation satellite constellation to provide maximum coverage performance while ensuring timeliness.

This article deals with the role of emergency institutes in countering the COVID-19 pandemic in the United States. The author examines such types of emergency as Public Health Emergency, National Emergency, Major Disaster Regime and Emergency Regime. The entire layer of emergency legislation is analysed, including National Emergencies Act of 1976, Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, Social Security Act of 1935, Public Health Service Act of 1944, Defense Production Act of 1950. Acts of the President of the United States and the Congress adopted directly during the pandemic and aimed at countering COVID-19 and protecting the rights of American citizens are considered as well. In conclusion it’s being argued that the formal availability of federal mechanisms of mobilization of assistance to state and local government in the conditions of emergency (especially in the sphere of public health protection) by itself doesn’t guarantee effective response of the state machine to this situation, adequate and timely funding of the corresponding efforts.

MANAGEMENT IN CRISIS AND EMERGENCY SITUATIONS AS A MANIFESTATION OF ORGANIZED ACTIONS

The article presents considerations regarding the issues of state security management in crisis situations and states of emergency in the context of organized actions. During the research and presentation of the results, a system approach has been utilized, because it turned out to be very useful for practical reasons. Only such an approach creates the possibility for a mechanism to organize the state of knowledge about security. This technique was also picked for the reason that the determinants of the system approach are the features of all activities subjected to supervision of security attainment and maintenance, such as: anticipation, adaptation, purposefulness of action, and focus on development, which are the properties of the system approach. A procedure that still remains a modern way of practical action. The system approach was supported by its features such as: holism, comprehensiveness, essentialism, structuralism, contextualism, teleologism, functionality, efficiency, synergism and development. During the research, the method of source analysis has been used, where the key issue was the analysis of the factual subject matter contained in the source materials, legal acts, scientific and popular science literature. The conducted research indicates that the level of threat determines the use of crisis management and emergency state solutions. Threats that are characterized by limited predictability and dynamic volatility. The research results lead to the conclusion that in the interests of the efficiency, the state is introducing a number of legal and organizational solutions, referring to, among others, crisis management and administration of the state in conditions of emergency. The characteristic feature of the above mentioned solutions is cooperation. Its universality means that it is not always possible to notice its occurrence. Usually, cooperation is mentioned in situations of spectacular activities, apart from the perma-nent, "ordinary" intermingling of the activities of various institutions. The legal and organizational solutions mentioned above take the form of organized undertakings, exceedingly useful in all efforts to provide security of the state. Research also indicates that proper organization of state security system activities is a basic condition for an acceptable level of non-risk to the state as an organization and its components and, above all, citizens.

The Need for the Tort Law Privileges of Self-Defense and Necessity in Intellectual Property Law

The COVID-19 pandemic has laid bare inherent tensions between the protection of intellectual property (IP) and the health of individuals touched by life-threatening medical conditions. Examples from around the world have made front page news: hospitals desperate for ventilator parts while 3D-printing instructions for such parts remain unshared for fear of liability; potentially lifesaving medicines whose manufacture and distribution on sufficient scale is limited by the threat of patent infringement; proprietary clinical data essential for making life-or-death decisions withheld from doctors and patients; the list continues. The threat of liability for IP infringement also dampens the ability to innovate under conditions of emergency, further contrasting the protection of IP with the protection of human lives. A number of policy responses for the current pandemic have been advanced, including the application of government rights under the Defense Production Act to IP contexts, compulsory licensing, legislation that would allow for emergency overrides to IP protections, and efforts to encourage companies to make their IP freely available voluntarily through the Open COVID Pledge. But fears of disrupting IP protections have curtailed the use of these measures, leaving the tensions between protection and life-saving access largely unaddressed. In this Article we argue that the time is ripe for doctors, hospitals, independent compounders, medical products manufacturers, engineers and, ultimately, litigants and the courts to consider the necessity doctrine as an old-new tool for resolving IP disputes. Doing so would not only be ethically sound but would also help to resolve many of the public health critiques that have been plaguing IP law by attenuating ingrained misalignments between IP frameworks and the furtherance of public health goals. The Article demonstrates the need for the necessity doctrine in IP law; explains how claims under the doctrine may allow defendants to avoid liability in circumstances in which infringement is necessary to prevent adverse public health outcomes; and shows why the adoption of this doctrine is needed to increase preparedness ahead of future—indeed expected—outbreaks of infectious diseases.

Problems of proactive management of socio-cyberphysical systems: current state and prospects of solution

Goal. The purpose of the study is to consider existing and promising approaches to solving the prob-lems of complex modeling and proactive management of socio-cyberphysical systems (SCPS). Materials and methods. To achieve this goal, the authors of the article used the methods of modern system analysis, integrated modeling and management decisions in complex organizational and technical objects, which include SCPS. Results. The article analyzes the main aspects of the investigated problem under study related to its con-structive description, the formation of the necessary data, information and knowledge for this, their constant updating based on the use of cyberphysical systems (CPS), as well as intelligent multimodal interfaces. In addition, the article describes the problem of the proactive management of SCPS at the set-theoretical level. Scientific novelty. The article proposes a new scientific approach based on the applied theory of proactive control of the structural dynamics of SCFS developed by the authors. It consists in the fact that, on the basis of it, as shown by preliminary studies, the following possibilities work out. Firstly, to directly relate those common goals, the achievement of which the functioning of a specific SCPS at a specific stage of its life cycle, with its strategic and tactical goals. Secondly, reasonably determine and choose the appropriate sequences of tasks and performed operations (actions) related to controlled structural dynamics (controlled by self-organization of SCPS). And, thirdly, to consciously find compromise multi-criteria solutions for the allocation of limited resources of SCPS allocated to control the structural dynamics of these systems in the conditions of possible crisis, emergency and emergency situations.

FUNCTIONAL DESCRIPTION OF THE ZONING OF LOCAL TERRITORIES OF THE GLOBE BY QUANTITY AND DESTRUCTIVE ENERGY OF TECTONIC EXTREME ORIGIN SITUATIONS

In conditions of uneven distribution of sources of danger across the territory of the state, each territory has its own levels of natural, technogenic, social and military loads, which influence on the composition of forces, tactical and technical characteristics of the means of the functioning geoinformation security system, namely the national security system. In Ukraine the civil defense system is functioning to ensure the implementation of state policy in the field of civil defense for protection of the population, territories, environment and property from emergencies by preventing such situations, eliminating their consequences and providing assistance to victims in peacetime and during a special period. The system consists of functional and territorial subsystems and is aimed to solving the issues of ensuring the necessary level of security of the state in the conditions of emergency. At the same time, the issues of implementation of the monitoring function and development of effective decisions by all local subsystems, which aimed at prevention and localization of different emergencies, remain completely open to the state. In this paper in order to further develop the scientific and technical foundations for creating an artificial intelligence system for monitoring emergencies of tectonic origin have been presented the results of a mathematical description of the hierarchical clustering local territories of the globe in terms of the amount and of destructive energy of tectonic origin emergency situations. The results have been obtained by discriminant and canonical multivariate statistical analysis of the Earth's seismic activity in the Sun – Earth – Moon nonlinear energy interaction system. The discriminant and canonical analyzes of the results of hierarchical clustering (zoning) of the local territories of the globe according to the level of seismic activity were carried out using the statistical packages STATISTICA 6.1 and SPSS 2.0. The results obtained in this work are the basis for further comprehensive assessment of the interconnections between the main parameters of the Earth’s movement in the Sun – Earth – Moon system and the main parameters of the tectonic hazard of seismically active local territories of the Earth, aimed at developing the scientific and technical foundations for creating an artificial intelligence system for monitoring emergencies of tectonic origin. Formation of the dynamic model for operative monitoring of the ecosystem’s pollution level through emergencies at nuclear power plants

The system consists of functional and territorial subsystems and is aimed to solving the issues of ensuring the necessary level of security of the state in the conditions of emergency. At the same time, the issues of implementation of the monitoring function and development of effective decisions by all local subsystems, which aimed at prevention and localization of different emergencies, remain completely open to the state.In order to further develop the scientific and technical bases for the implementation of the subsystem of the civil defense system of Ukraine on operative monitoring of changes the boundaries of radiation pollution zone, the level of danger in the zone and the prediction of new hazards, a dynamic model of the combined use of unmanned aerial vehicles and ground control of radiation hazard factors, where the delivery of ground control devices to the danger zone is performed by unmanned aerial vehicles, is developed.

Аспекти застосування відеоконференції в кримінальному процесуальному доказуванні в умовах запровадження надзвичайної ситуації в Україні

Метою статті є визначення основних аспектів застосування відеоконференції в кримінальному процесуальному доказуванні в умовах запровадження надзвичайної ситуації в Україні. Методологія. У межах наукового дослідження використано методи формальної логіки та спеціально-правові методи: порівняльно- правовий, системно-структурний, системного аналізу та прогнозування. Наукова новизна публікації полягає у визначенні специфіки застосування відеоконференції в кримінальному процесуальному доказуванні та виокремленні проблемних питань проведення процесуальних дій в режимі відеоконференції в умовах запровадження надзвичайної ситуації в Україні, аналізі проєкту Закону про внесення зміни до розділу XI «Перехідні положення» Кримінального процесуального кодексу України щодо особливостей судового контролю за дотриманням прав, свобод та інтересів осіб у кримінальному провадженні й розгляду окремих питань під час судового провадження на період карантину, встановленого Кабінетом Міністрів України з метою запобігання поширенню коронавірусної хвороби (COVID 19) № 3276, а також наданні науково обґрунтованих пропозицій щодо їх вирішення. Висновки. Специфіка застосування відеоконференції в кримінальному процесуальному доказуванні в умовах запровадження надзвичайної ситуації в Україні полягає у: 1) волевиявленні суб’єкта, відображеному в клопотанні учасників кримінального провадження або ініціативі слідчого, прокурора, слідчого судді чи суду; 2) письмовій згоді особи, стосовно якої заплановано проведення відеоконференції; 3) фактичних підставах, обґрунтованих доказами, що підтверджують необхідність проведення процесуальних дій у режимі відеоконференції. Запропоновано низку змін і доповнень до ст. 232, 336 Кримінального процесуального кодексу України з метою забезпечення ефективності застосування відеоконференції в кримінальному процесуальному доказуванні в умовах запровадження надзвичайної ситуації в Україні.

РЕЛАЦИЯТА ЗДРАВНО ВЪЗПИТАНИЕ – ПАНДЕМИЯ

The article focuses on several main points. First of all, it is health as a concept, as a phenomenon in our lives. The second focus is the health education. The third focus is the situation of the pandemic, in which the whole world has been since the beginning of 2020 and its impact on the health education and health culture, both for children and for the elderly people. An analysis of the impact of the COVID-19 pandemic on the health education process has been made. The possible conclusions and lessons from the difficult situation and as a consequence – results in the health education of adolescents and the health culture of adults were sought. The created complex circumstances in the life of people in the conditions of emergency and quarantine, which are a barrier for the health education of children and the healthy lifestyle of adults, are also analysed. Options have been sought for overcoming them and consolidating healthy habits in children.

Experience of the Colentina Clinical Hospital Surgery Clinic in the Treatment of COVID-19 Patients Hospitalised in the Period March - August 2020

Introduction: SARS-CoV-2 is a Betacoronavirus belonging to the Sarbecovirus subgenus of the Coronavidae family, antigenically distinct from SARS CoV, with which it has a genetic similarity of about 76% of nucleotides (1). It causes the Covid-19 disease in humans, which mainly affects the respiratory system, through inflammatory and procoagulant mechanisms at the level of alveolar microcirculation. Material and method: There are 145 patients infected with SARS-CoV-2, treated in the Colentina Surgery Clinic during March-August 2020, whose cases were analysed to identify some elements that would help to improve the medical management of these patients from multiple perspectives. Discussion: There was a slight predominance of male impairments, and the ages of interest were mostly over 60 years. The cases that required surgery were in an absolute minority (14 cases). The operations were performed only in conditions of a surgical emergency. Mortality was high (24,13%).

ПРАВОВІ АСПЕКТИ ЗАБЕЗПЕЧЕННЯ ЕКОЛОГІЧНОЇ БЕЗПЕКИ УКРАЇНИ В УМОВАХ ЄВРОПЕЙСЬКОЇ ІНТЕГРАЦІЇ

The article deals with the issues of environmental safety and its provision in the context of European integration. It is emphasized that environmental problems do not know borders and are geopolitical in nature. Failure to comply with environmental safety conditions can have grave consequences, including those that are known to history. Specifically, sustainable development issues related to overcoming the consequences of the 1986 Chernobyl disaster. The issues of environmental safety, the relationship between the economy, business and the environment, as well as the issue of measures to influence environmental crimes and offenses from various angles have been addressed in the literature. However, the issue of environmental safety in the context of European integration, and in particular in the current conditions of emergency, needs further researching. It is emphasized that the problem is in particular the interaction of society, the state and human with the environment and ensuring security and harmony in such interaction in the context of European integration. The purpose of the work is to optimize the legislation in terms of measures to influence offenses against the environment. A person should take care not only of himself, but also of other people and the environment. It is justified that environmental care should not be guaranteed by the cost of living and human health. Business and financial benefits, power cannot be more important than human life and health, because such activities often lead to environmental pollution. In today’s context, it is important that human rights do not contradict the idea of social naturalism (O.M. Kostenko). Often, modern human rights violate environmental security. It has been found that it is important to strike a balance between human beings, society, the state and the environment in ensuring human rights. In addition, it is concluded that a combination of environmental, administrative, criminal and disciplinary responsibility, as well as the application of mediation and other alternative practices aimed at conflict resolve, is important in responding to environmental offenses.

AREAS OF MOBILE TECHNOLOGIES APPLICATION WHEN PREPARING THE POPULATION FOR ACTIONS DURING EMERGENCIES

In the circumstances when human life is intensively affected by many harmful environmental factors resulting from large-scale disasters of different origins and types, the issues of population training in emergency preparedness and response as well as public safety culture development in general are of great importance. According to the State Emergency Service of Ukraine, in 2018 168 people were killed and 839 were injured because of emergencies. In comparison with the same last year period, there is a steady death toll increase despite the fact that the total number of emergencies in Ukraine has decreased in contrast to the previous period. In addition, rescuers have considered fire safety and hygiene violations along with low-level control over the epidemic prevention measures implementation as main causes of natural and man-made emergencies in the country during recent years.
 Such state of affairs may indicate that very often the loss of life during emergency results from the lack of knowledge and failure to comply with the recommendations on life safety, and that the existing system of civil protection training is not able to cover all segments of the population. In addition, the complex technogenic and environmental, and military and political situations significantly increases the risk of dangerous incidents occurrence with casualties. Thus, modernization of knowledge dissemination system on the civil protection and life safety issues among the population are of particular relevance.
 The problem of mobile technologies for educational purposes is analyzed by the Ukrainian and foreign researchers, namely: V. Bykov, A. Struk, S. Smerikov, D. Kigan, A. Andreeva, etc. At the same time, the analysis of scientific and methodological literature and online sources shows that the problem of the use of mobile training for raising public awareness on civil protection issues has not been considered as a separate research subject before.
 The purpose of the article is to determine the peculiarities of the mobile technologies used for population emergency preparedness, as well as to present the developed social mobile application “SES Alphabet” and the prospects of its usage for population training.
 Under the rapid civilizational development of humanity, there will always be the possibility of various natural and manmade threats, and a certain part of the population will suffer from dangerous factors of the external environment. Therefore, the issue of citizen’s safety competence development and the culture of society safety in general will always remain urgent. According to the Ukrainian Constitution, human life and health, its protection against the impact of harmful man-made, natural, environmental and social factors are the highest social values, for which a unified state system of civil protection was created. One of the system’s components is the preparing of the population to behave properly under the conditions of potential emergencies.
 Taking into account the fact that the main task of public policy in the civil protection field is emergency prevention, preparing people to act under special circumstances is an effective form of prophylaxis, first and foremost, of human casualties caused by disasters. The basics of human behavior in extreme situations are formed because of constant training, which provides an adequate level of preparedness in case of emergency. Therefore, the training of the population on civil protection issues should be standardized and widespread.
 There is a natural question about effective tools for such training. In our opinion, it is possible to solve this problem by developing a suitable mobile application. Using of mobile devices for outreach activities on civil protection issues with the civilians and promotion of a safety culture in society have wide prospects because it addresses the major problem of accessibility and rapid provision of the adapted, easy-to-read educational information material. Mobile learning offers great opportunities for self-education of the population because the application allows you to remotely study in the field of life safety regardless of place and time. The high concentration and multimedia of the training material make it possible to focus on the main points, while the user-friendly interface allows you to navigate the vast array of civil protection information material very quickly.
 Considering the opportunities and advantages, mobile education, in our opinion, in the long run can be the most effective outreach activity for the population on socially significant issues, in particular informing citizens about emergency response. The use of mobile devices will create the conditions for accessible, inclusive and continuous education of the population on civil protection issues.
 International experience in the mobile applications in civil protection systems used to inform the public about emergency demonstrates the effectiveness of the mobile technologies in achieving the key tasks in the field of civil protection, namely the protection of life and health of citizens. The mobile application will provide useful and easy-to-read information about emergency procedures, which will help to avoid loss of human lives among the affected population.

Analysis of the chemical safety state in the Luhansk region in the conditions of the warning conflict

The statistics of emergency situations in Ukraine for 2018 are analyzed. The total cost of damage caused by emergencies amounted to more than UAH 516 million. About 15% of the territory of Ukraine with a population of more than 10 million people is in a critical ecological state, in fact not favorable for living. It is shown that the most environmentally hazardous production (coke and metallurgical plants, power plants and chemical industry enterprises) are concentrated in the Donetsk and Luhansk oblasts. The production complex consists of 3995 enterprises, 7 of which are environmentally hazardous objects. Damage to technological installations can result in dangerous consequences for the population and the environment near the enterprises. Due to emergency emissions and discharges there is pollution of atmospheric air, surface and underground waters and soils. Storage tanks and sludges, storage sites for industrial waste, such as slag dumps, waste heaps, stocks of raw materials, etc. located on the territories of tailings storage facilities also cause environmental hazards. There is also the risk of contamination of the area outside the conflict zone and the Sea of Azov in the event of pollution of the Siversky Donets, Kalmius, Mius and Mokryy Yelanchyk rivers, which occur near the clash line and in areas beyond the control of the Government of Ukraine.
 As a result of the analysis of the state of chemical safety in Ukraine, the example of PrJSC «Severodonetsk Azot Association» shows the need to increase safety requirements and prepare new qualified personnel for radiation, chemical and biological protection. 
 The necessity of attracting additional funds for ensuring the effectiveness of the actions of the territorial subsystems of the EGS GZ in the region in the conditions of emergencies, enhancing the readiness of the specialized fire fighting service of the city's civil protection to the actions for appointment, ensuring the timeliness and quality of carrying out work to save people, extinguishing fires, eliminating the consequences of emergencies , creation of the possibility of conducting search, rescue, restoration and friend services around the clock their urgent work.

Physical model for protection of cable lines and radioelectronic means of state and industrial objects from external electromagnetic influence in conditions of prevention of emergency situations

Grounded prerequisites for the development and creation of a physical model of protection of cable lines and radio electronic means of state and industrial objects from external electromagnetic influence in the conditions of emergency prevention.It is determined that the theoretical prerequisites for modeling include the condition of protection, which is the need to ensure complete neutralization of the electromagnetic impact energy, as the main factor in maintaining the proper technical condition of cable lines and radio electronic means. The second prerequisite for the creation of the model is the functional analogy between electricity and pneumatic (hydraulic), which is the basis for the development of protection of cable lines and RES in the direction of replacement of the most vulnerable electrical devices to pneumatic devices (hydraulic), which electrical and jet pneumatic (hydraulic) devices. They will also be linked through energy conversion.The basic scheme of physical model of protection of cable lines and radio electronic means in the conditions of emergency prevention at state and industrial objects connected with external electromagnetic influence, which unlike the existing ones, is created by replacement of separate electronic measuring systems by digital and analog streaming computations Pneumatic devices (hydro-automatic) devices and fiber-optic materials are used to create protection of communication channels.

Pioneirismo extensionista na Universidade do Estado do Rio Grande do Norte: curso à distância em primeiros socorros e suporte básico de vida

A extensão universitária tem como finalidade desenvolver intervenções abrangentes e impactantes na sociedade. O curso de suporte básico de vida na universidade do estado do rio grande do norte (uern) visa contemplar esses objetivos através da disseminação do conhecimento teórico-prático em medidas de primeiros socorros voltadas ao público em geral, por meio de uma linguagem acessível e de metodologias dinâmicas. São abordadas as situações de urgência e emergência mais frequentes em atendimento pré-hospitalar, nas quais, a intervenção precoce funciona como medida salvadora de vida por meio de aulas práticas e teóricas. Este trabalho deteve-se a mostrar como essa iniciativa vem se desenvolvendo, implantando novas modalidades de acesso à informação técnica sobre primeiros socorros, bem como todas as estratégias utilizadas no intuito de treinar efetivamente acadêmicos e leigos. o projeto está em vigor desde o ano de 2013 e, consequentemente à importância do tema, a cada ano, o número de participantes capacitados tem aumentado progressivamente, corroborando a qualidade da informação repassada e o seu respaldo perante à universidade e aos cidadãos. Nesse sentido, é imprescindível a continuidade de caráter permanente do curso, a fim de promover a importância e a atualização constante desse tema tão recorrente e negligenciado, apontando ainda, para a promoção em saúde também no ambiente virtual, levando a informação precisa a qualquer lugar do mundo com acesso à internet.

Today the main content of security is the protection of people and society. The problem of social security in a sense, the security of the person, certain groups of the population, society as a whole becomes the main one. Children are a particularly vulnerable category of the population. They are the main subjects and objects of systemic discrimination, which is especially intensified in the context of armed conflicts. Armed conflicts have a negative impact on the family functioning in general, and especially on the provision of the basic needs of the child, his development and psychological state.According to the UN Children’s Fund (UNICEF), as of January 2019, more than 34 million children worldwide living in conditions of conflict or emergencies do not receive the necessary protection. Their largest number is in Yemen (6.6 million people), Syria (5.5 million people), the Democratic Republic of the Congo (4 million people). In the conflict zone in eastern Ukraine, about 500 thousand children need immediate protection and humanitarian assistance.The article further substantiates the need to fundamentally change the anthological paradigm in the study of security concepts (social, human): to move from monism in explaining the relation between the material and the spiritual, as components of the universe, to pluralism. It allows to represent any phenomenon as an organic unification and a dialectical combination of material and ideal, when under certain conditions there is a priority development of one of them, and to substantiate the necessity of forming a new concept of comprehensive broad security, in which the environment of the subject, will allow him to make and implement decisions according to his goals, aimed at progressive development.The author of the article also identifies and analyzes the risks for children, possible violations of children’s rights during and after an armed conflict. Analysis of the provisions of the Geneva Conventions (1949) and the Additional Protocols thereto (1977), the Convention on the Rights of the Child (1989), the Optional Protocol to the Convention on the Rights of the Child on the Involvement of Children in Armed Conflict (2000), other international acts on the establishment of the protection of the rights of the child in armed conflicts for the purpose of their coherence between themselves and with the norms of international humanitarian law in general is carried out. Measures aimed at improving the mechanism for ensuring the right to child safety and strengthening the protection of children from involvement in armed conflicts are proposed.
