This textual production deals with the inefficiency of the State in enforcing sentences in areas dominated by drug trafficking due to the high degree of dangerousness. For the most part, for reasons of preserving their physical integrity, court officials decline their duties and, any right recognized in a sentence ends up having no effect in practice, not because there was no recognition from the judiciary, but rather because of the lack of State control and mechanisms that enable civil servants to enter the regions and comply with intimidation mandates. In this sense, it is concluded that Brazilian justice is in fact only present in places where state power still has control, residents and rights holders who are in risk areas end up being unaware of the effects of justice.
