Forging Ahead in Florida: Teaching and Supervision Strategies in the Face of Legislative Restrictions and Medical Bans

As a nation and a profession, we have witnessed a spark in the momentum and uplifting of social justice movements and advocacy concerning the ongoing oppression of Black, Indigenous, and People of Color (BIPOC) as well as sex and gender-expansive (SGE) people in our community. In response, Florida and other states face an onslaught of restrictive medical bans and legislative bills surrounding how counselors and educators address race, sexuality, and gender in treatment and training programs. Florida has notably been at the forefront of adopting this legislation, not only regulating instructor-led discussion around racism, same-sex relationships, and gender identity in various educational settings but also banning gender-affirming medical care for transgender youth. In this article, we review the legislative and regulatory impacts of race, sex, and gender-based legislation in Florida on education and healthcare, providing strategies for counselor educators, counselors, and trainees in the areas of teaching and supervision.

New approaches to the implementation of supervisory powers in capital markets and organized commodity markets

The article analyzes new mechanisms and measures of influence on supervisory entities in capital markets and organized commodity markets. A general positive assessment is given to the innovations related to the introduction of more flexible tools for adjusting the state of stock and organized commodity markets, as well as the expansion of the powers of the National Securities and Stock Market Commission (NSSMC), while simultaneously strengthening the legal guarantees of the rights of supervised entities. Attention is paid to changes regarding the inclusion of individuals as subjects of responsibility under this law, clearer delineation of the scope of supervised entities, and significant expansion of the rights of supervised entities by utilizing the best practices of regulating procedural relations between the supervisory body and the supervised entity. The article also explores the deepening regulation of communicative connections between these entities and the procedures for implementing supervisory measures. Attention is given to preventive measures for violations, such as «recommendations by inspectors» and «requests for the adoption of measures.» The article analyzes new forms of implementing supervisory powers and measures of influence on supervised entities, as well as new mechanisms for their implementation that were not previously known in domestic practice. The legal significance of «public warnings» is highlighted, and a legal evaluation of «settlement agreements regarding the consequences of violating sectoral legislation» is provided as an alternative to administrative enforcement measures. According to the authors, concluding such an agreement cannot be considered as a discretionary power of the NSSMC but rather a right of the supervised entity. Conclusions are made regarding the compliance of the introduction of «controlled services» with the IOSCO principle. Taking into account the guarantees of the rights of supervised entities, as stipulated in Article 35 of the Law of Ukraine «On Amendments to the Law of Ukraine ‘On State Regulation of Capital Markets and Organized Commodity Markets’ and Some Other Legislative Acts of Ukraine on Improving State Regulation and Supervision in Capital Markets and Organized Commodity Markets» of February 22, 2024, No. 3585-IX (hereinafter referred to as Law No. 3585-IX). The article defines the functional purpose of legislative restrictions on financial sanctions against supervised entities - legal entities, which, in the authors’ view, aim to prevent their economic destruction and the disruption of economic ties in the respective market. In conclusion, the changes introduced as a result of the adoption of Law No. 3585-IX are expected to positively impact the relationship between the regulator and market participants. The innovations in the practice of legal regulation of relations between the regulator and supervised entities deserve to be extended to other similar areas of state control and supervision.

Sustainable, affordable, and transferable approaches to experienced doctoral supervisor development

ABSTRACT Doctoral supervision is complex and takes place against a background of contextual, political, economic, and cultural affordances/constraints; with multiple purposes; and in a global higher education system. The result can be significant tensions for supervisors and, often, poor student satisfaction and progression. Globally, systematic development of doctoral supervision capacity is unusual and/or prohibitively expensive at scale. In response, this paper reports an educational design research initiative to develop a series of collaborative online workshops for experienced doctoral supervisors, supporting deliberate ‘reflective, personal, scholarly and systematic reflection’ across ten areas of doctoral supervision. Participants are then well-equipped to craft a successful application for the prestigious United Kingdom Council for Graduate Education supervisor recognition. Our evidence suggests short-term benefit is in two phases: directly via collaborative workshop engagement with the supervision literature in relation to participants’ shared experiences of supervision, and then via application of that to practice, captured in semi-structured scholarly reflective accounts on development of practice in submission for accreditation. Embedded medium-term benefits are now emerging. Multiple iterations suggest the approach is sustainable, transferable, affordable, and richly beneficial to participants, doctoral students, and wider doctoral communities. The contribution is to development of academics’ teaching and research, and it is both theoretical and practical.

Academic Supervision and Managerial Skills of School Heads for Teachers’ Quality and Work Effectiveness

This study focused on the of academic supervision and managerial skills of school heads for the teacher’s quality and work effectiveness among schools in Sariaya West District, Division of Quezon. The descriptive-correlational research strategy was used after analyzing the study's goals and objectives and reviewing existing research on the subject. There were 160 respondents. These are the school teachers, including master teachers, of Sariaya West District in the Division of Quezon. The result of the study shows that: the school heads in the district were observed to practiced well the academic supervision particularly on adaptability to change, time management, written and verbal communication and cooperation It implies that they employ appropriately to lead the school by practicing to show their teachers that they are competent to supervise school operations and being recognized for their proficiency in these key areas of academic supervision, which are crucial for effective school leadership and management. The managerial skills of the school heads are observed particularly on interpersonal skills, organization and delegation, problem solving and decision making and mentoring. They effectively provide assistance to their teachers in school by explicitly implying the role of interpersonal skills, delegation of task, decisional making and mentoring. The teacher’s quality and teachers work effectiveness in the school increased when leaders practiced academic supervision and observed managerial skills and were able to realize substantially observable measures to a positive degree.

Effectiveness of Teacher Supervision Practices in the Implementation of the Early Years Education Program

Early Years Education (EYE) is the crucial stage in the child’s physical, social, emotional, and intellectual development. This study, therefore, sought to evaluate the effectiveness of teacher supervision practices in the implementation of the EYE program in the Khwisero Sub-county. The study which targeted key education stakeholders in EYE adopted a cross-sectional survey research design. Stratified random sampling and purposive sampling were used to select 10 schools, 10 head teachers, 10 teachers in charge, 1 program officer, 4 ward representatives and 50 assistant teachers. The questionnaire, interview guide and document analysis guide were used for data collection. Frequency of supervision is key to the effectiveness of teacher supervision practices because it affects the adequacy of teaching resources, the development of necessary learning skills, and effective time management. From the findings, it was noted that there are various areas of teacher supervision, which are not adequately addressed as indicated by some respondents, including teaching and learning resources, time management and teacher professional records. By implementing effective supervisory practices, schools can create an environment that supports high-quality education and fosters continuous improvement in learning outcomes. Preparedness ensures that teachers have the necessary skills, resources, and time management capabilities, hence directly influencing the adequacy of teaching resources, learning skills, and time management. Generally, respondents thought that supervisory practices in place were effective, though the degree or intensity of effectiveness varied. Therefore, the study recommended that Early Childhood Development and Education (ECDE) stakeholders support the supervision initiatives in place for effective curriculum implementation of the EYE program.

Kink and BDSM Awareness in Sex Offense Treatment

There has been a recent movement to adopt a sex-positive framework into all areas of psychological practice, including research, practice, supervision, and training in psychology. However, incorporating a sex-positive approach to sex offense treatment has rarely been discussed. As clinicians move to more humanistic and rehabilitative approaches, sex-positivity should be considered. The current article will outline a case study of a client mandated for sex offense treatment who expressed interest in BDSM with his new partner and his therapist’s reactions to this information. Discussion for clinical training and supports for clinicians doing sex offense treatment will be offered.

Research on the Development of Leisure Agriculture and Rural Tourism and Legal Regulation Issues under the Background of Rural Revitalization

Since the implementation of the strategy for leisure agriculture and rural tourism, various regions in China have shown diverse development trends. Despite this, practical difficulties and legal issues persist. Particularly in the areas of administrative supervision, land transfer, contractual systems, and tort liability, existing laws and regulations still need further improvement for efficient and scientific regulatory management. To promote the healthy growth of rural tourism, the primary task is to strengthen regulatory agency construction and clarify the scope of powers and responsibilities to enhance government supervision. Additionally, the establishment of land transfer systems and clarification of property rights are essential legal measures to regulate land transfer. Furthermore, improving contractual systems and defining tort liability regulations can effectively address issues related to leisure agriculture and rural tourism contracts and tort actions. By studying the shortcomings of the current legal system and proposing solutions, the aim is to achieve robust development in China's rural economy and the implementation of rural revitalization.

Surgical trainee experiences from 2013 to 2023 within the United Kingdom as reported by the General Medical Council National Training Survey

IntroductionThe General Medical Council (GMC) issues annual surveys to all doctors within the United Kingdom (UK) in a formal postgraduate training scheme. This facilitates the monitoring of experiences for quality assurance purposes. Low job satisfaction has been associated with heightened levels of burnout and staff turnover, alongside deteriorating clinical care and productivity levels. MethodsWe gathered and extracted data from the publicly available online GMC reporting tool. Data ranged from 2013 to 2023 and spanned 12 postgraduate surgical training programmes across all 18 indicators available. In total, 198 individual metrics were recorded, in addition to burnout. We conducted trend analysis and yearly average mean scores for individual metrics, burnout and geographical differences for 141 individual training programmes within the 16 training regions. ResultsOf the 198 metrics analysed, 83 (42 ​%) were found to have statistically significant negative trends (P ​< ​0.05), in comparison to 24 (12 ​%) with positive trends. 5 specialities had over 50 ​% of metrics showing a significant negative trend. Overall satisfaction was negative in all 12 programmes, with eight reaching significance (P ​< ​0.05). Of 141 individual training programmes, 29 ​% showed a significantly negative trend in overall satisfaction, with 1 ​% demonstrating a significant positive trend (P ​< ​0.05). ConclusionOur study is the first to explore long-term trends in trainee reported surgical training experiences within the UK. Our data have revealed widespread worsening trainee reported experiences and dissatisfaction across multiple specialities and geographical regions, especially in key areas of overall satisfaction, self-development, and clinical supervision.

Labour Inspection as One of the Main Mechanisms for Controlling Occupational Injuries

Purpose of the study is to investigate occupational injuries according to the statistics from labour inspectorates (State Labour, International Labour Organization. ILOSTAT, Państwowa inspekcja pracy), to assess the safety of production processes in Ukraine and countries of the world. Methodology. The methodical approach to the assessment of safety of production processes, protection of workers from dangers and risks in the areas of supervision of Ukraine and foreign countries of the world was carried out based on the statistics of the reports of the State Labour Service of Ukraine (State Labour), International Labour Organization. Ilostat, Państwowa inspekcja pracy using a logical method of cognition (analysis, synthesis, abstraction, generalization, deduction, induction, analogy, etc.), statistical method of injury analysis. The occupational injuries dynamics in Ukraine and countries of the world (Poland, Italy, Turkey, China, Japan, etc.) have been investigated, the comparative analysis has been made and regularities of its growth or decrease have been identified. Findings. Based on the data analysis of the State Labour Service of Ukraine, International Labour Organization. Ilostat, Państwowa inspekcja pracy for the period it was found that the state of occupational injuries is declining, both in Ukraine and in the countries of the world. It has been revealed that the most dangerous industries in Ukraine are coal, socio-cultural, trade, transport and agro-industrial spheres. At present, the most dangerous industries in foreign countries are the construction and manufacturing industries. Practical value. The analysis of occupational injury data from countries around the world makes it possible to evaluate the work of labour inspectorates. On the basis of statistics, supervision areas and the relevant authorities can predict, prevent and eliminate potential industrial hazards ahead of time, to offer promising ways to increase the level of occupational safety in Ukraine based on positive foreign experience.

The State Administrative Decision-Making in the Adoption of Maslahah Mursallah Principle in Indonesia

The development of State Administration Law is a prerequisite for constitutional development in realising good governance. From the perspective of national administration, administrative reform is a revision of several legal policies related to structure, process, and management in the areas of finance, supervision, staffing, accountability and transparency, and political decision-making processes and their implementation. Political decision-making process and its implementation. State administration reform also means reform in the field of state administration law. As one of the efforts to use the Islamic Law approach, one of which is the principle of maslahah mursalah, which prioritises the benefit of the people. So what if this principle is applied to policy making by State Administrative Officials. This study aims to determine the application of the principle of maslahah mursalah to State Administrative Decisions. The method used is normative legal research method, using deductive analysis method. It is hoped that the results of this research will be able to provide an overview of the role of the maslahah mursalah principle in efforts to realise State Administrative Decisions based on good values, as well as providing a sense of justice and prioritising benefits and avoiding mischief.

Academics with disabilities during transformation to a New African University in South Africa

The idea of transformation to a ‘new African university’ has become topical in contemporary African education scholarship. Whilst it is claimed that the process seeks to include all stakeholders, academics with disabilities are excluded because of discourses and dynamics in Africa’s higher education that have remained deeply embedded in Eurocentric thinking and mind-set. This paper applied Critical Disability Theory to analyse the challenges that face academics with disabilities in the areas of teaching, research, community engagement and doctoral supervision in South African higher education and that must be appropriately and adequately addressed for a successful transformation to a “‘new’ African University”. Data were collected through an analysis of South African literature on exclusion of students with disabilities as research, community engagement and supervision are regarded as a continuum and involve both students and the academics. Findings revealed that academics with disabilities are confronted with specific challenges similar to those faced by students with disabilities, as they all function within the same context during transformation to a ‘new African university’. The challenges are inaccessible physical environment, negative attitudes from the community members, impairment-related disadvantages, lack of adequate funding and lack of adequate media for use, which all compound to limit their functioning like their able-bodied counterparts. Including the voice of academics with disabilities in disability policy was proposed as a way to alleviate the challenges they confront enabling them to contribute positively to scholarship and thus affirm the transformation to a new African University

Financial and Customs Control: Aspects of Correlation and Problems of Delimitation

In the context of the reform of control and supervision activities, it is important to distinguish between the various areas of state control and supervision in certain areas of regulation. With regard to the customs sphere, one can state the simultaneous use of the categories of financial and customs control without determining the limits of control and supervisory influence. An analysis of the existing positions on the ratio of these types of state control made it possible to identify four methodological approaches to the model of such a ratio. The selected approaches are based on the identification, absorption, delimitation of financial and customs control, substantiation of scientific categories that unite them, consolidating their regulation and implementation. The existing approaches are united by the recognition of the inseparable connection, mutual conditionality of the categories under consideration and are based on theoretical provisions on the complexity of customs law and the comprehensive nature of financial control in public administration. On the basis of the analysis carried out, the concept of partial absorption is proposed to justify the relationship between customs and financial control. The part of customs control related to the payment of customs duties is positioned as an element of state financial control. At the same time, financial control exercised in the field of cross-border movement of goods can be attributed to customs control. In modern conditions, the role of the financial aspects of customs control is gradually decreasing.

СТРАХОВИЙ РИНОК УКРАЇНИ У ПЕРІОД ДІЇ ВОЄННОГО СТАНУ: ФІНАНСОВИЙ ТА МАРКЕТИНГОВИЙ АСПЕКТИ

The article focuses on the study of modern development trends of the insurance market of Ukraine with an emphasis on the period of martial law. The content of the concept of "insurance market" has been identified and approaches to the interpretation of its essence have been systematized. Theregula-tory basis for the regulation of the insurance market has been developed, in particular, the new Law of Ukraine "On Insurance". A new model of regulation of the NBU has been studied, taking into account the provisions of the European Union directives, the International Principles of the IAIS, and the best international practices. The main requirements of the NBU for the activities of insurance companies and the priority areas of supervision during the period of martial law have been systematized.An analysis of the state and trends in the development of the insurance market has been carried out, in particular: the number of insurance companies and registered insurance contracts, the structure of gross receipts of insurance payments (premiums, contributions), the dynamics of insurance premiums and insurance payments, as well as the costs of marketing insurers. It has been found that in the condi-tions of martial law, the approaches to analysis and the informativeness of the main indicators are being transformed. Indicators of operational activity, marketing costs, the level of capitalization of insurers (that is, the amount of own funds and insurance reserves) are particularly informative in determining market stability. The insurance market experienced the biggest decline at the end of the 1st quarter of 2022. Already by the end of 2022, insurance companies were able to adapt to new operating conditions and the situation stabilized. The main directions of changes in the marketing strategy of insurance com-panies have been determined.The challenges faced by the insurance market during the period of martial law (strengthening of regulatory requirements, coverage of war losses, fulfillment of obligations under voluntary health in-surance contracts, the NBU increased the amount of insurance sums under CMTPLI contracts, insur-ance for Ukrainians who went abroad, difficulties in planning further actions) have been systematized. Attention has been focused on finding ways to neutralize them, as well as on the creation of a compre-hensive system of insurance of military and political risks due to the creation of a special compensation fund or a pool at the state level with the involvement of funds from donors and insurers, including on the basis of public-private partnership.

Nurses' role in urgent and emergency mobile pre-hospital care

In the mobile pre-hospital environment such as the SAMU, the nurse has several functions in the areas of care, administration, operation and supervision, and must participate in the review of protocols and provide training for the other professionals in the team. Despite this, changes have been taking place over the years in relation to the performance of nursing, improving legal aspects and increasing the autonomy of nurses. The general objective of the research is to analyze the role of nurses in urgent and emergency mobile pre-hospital care, and as specific objectives to describe the nurse's attributions as a member of the urgent and emergency mobile PHC service team, to point out the difficulties and challenges exist in the nurse's work and discuss the importance of the nurse in the mobile emergency APH. Thus, the present work is an integrative literature review, using the following descriptors: “emergency assistance”, “pre-hospital care” and “emergency nursing”. The work was prepared between February and May 2022, using studies published between 2012 and 2022. Such works were found in the SCIELO, LILACS and MEDLINE databases. As a result, the nurse must act as an advisor by participating in the review of protocols, in the elaboration and organization of educational content and as a professional of the multidisciplinary team of accidents and disasters. However, the nurse in the PHC has been exposed to unfavorable ergonomics, low salaries, exhausting workload, influencing their physical and mental health. Thus, the role of nurses in the PHC is still fragmented, developing little autonomy, despite being extremely important in the composition of the team, as it promotes assistance, management, education, leadership and humanization. Still, the need for continuing education with realistic theoretical-practical training for SAMU nurses was proved, with an emphasis on mental health for patients in psychiatric crisis.

FEATURES OF THE CONCEPT STATE REGULATION OF NATIONAL DEVELOPMENT MINING INDUSTRY

The organization and maintenance of sustainable socio-economic progress of the country are closely connected not only with the rational use of the country’s natural resources, but also with the implementation of effective state policy on the protection and reproduction of natural biogeocenoses. The construction and implementation of such a policy must meet both the tactical and long-term prospects of economic and social development of the state. The strategic importance of the mining industry for society requires regulation to ensure sustainable development and should be regulated at the state level, but to be specific to regional specifics while taking into account national interests. The article identifies the basic theoretical provisions on the need, extent and methods of regulating the economy, environmental and economic, sustainable and innovation and technological development. The task of state regulation of economic development of the mining industry is substantiated. It is proposed to consider as a set of state measures in the coal, oil and gas, metallurgy, electricity and utilities, aimed at efficient use of natural resource potential based on mining, as well as their exploration, development, primary processing, use and marketing , as a result of which there are progressive changes of production and service and structural nature in the economy of the country and its regions. The purpose of state regulation is the efficient use of natural resource potential based on the extraction of minerals from the subsoil, as well as their exploration, development, primary processing, use and marketing. A set of measures of state regulation of economic development of the mining industry in the areas of planning, regulation, regulation, supervision and control is described. Particular attention is paid to regulatory tools, namely permits with appropriate administrative support, tax, investment. In determining the specifics of regulating the development of the industry, attention is focused on its relationship with the policy documents of the national and regional levels.

On Public Prosecutor’s Supervision over the Implementation of Environmental Legislation in Transport

The paper is devoted to the problems of public prosecutor’s supervision over the implementation of environmental legislation in air, rail, water, road and pipeline transport. The features of the legal regulation of the transportation of especially dangerous goods are analyzed following the case of heavy-duty road and water transport; legislation establishing environmental requirements for economic activities in transport; the authors list the main international agreements concluded in this area. A brief analysis of the state of legality in the field of compliance with environmental requirements in transport is given: the dynamics of environmental crime in transport and the number of violations detected by transport prosecutors are analyzed; the most priority areas of supervision, typical violations identified by prosecutors, and factors contributing to violations are noted; response measures taken by prosecutors. Measures aimed at increasing the efficiency of prosecutorial supervision in the area of supervision under consideration are proposed.

The Importance of the Jurisprudence of the Court of Justice of the European Union for the Consistent Application of the Service Directive

In this paper, we explore the implementation of the Directive on services in the internal market in the Member States of the European Union, with the focus on assessing the clarity of the norms of this acquis. We perform analysis of selected cases from the jurisprudence of the Court of Justice. The source of law in question, among other things, we consider with regard to its implementation in the areas of public health, certification and technical supervision, and in the field of veterinary services. The topic of our work is useful for the professional and scientific community due to the further clarification of the importance of the development of the case law of the Court of Justice for the uniform application of the Directive governing a very important segment of the internal market.

Soft law and multilevel cooperation as sources of (new) constitutional challenges in EU economic and monetary integration: introduction to the special issue

Following the outbreak of the Great Financial Crisis, numerous reforms were conducted in all areas of the European Union (EU)’s Economic and Monetary Union. These reforms aimed at strengthening the resilience of Member States’ economies after they had been put under severe strain by the crisis. They included, among others, the reinforcement of the efforts toward economic coordination in the framework of the European Semester for economic policy coordination, or the creation of the European Banking Union after which competences in the areas of banking supervision and bank resolution have been transferred to the European level. More than a decade after the Great Financial Crisis however, several of these reforms are still underway. This article is an introduction to this Special Issue whose contributions examine the reforms performed to date, as well as those that are currently under discussion, from the perspectives of multilevel (administrative) cooperation and the resort to soft law instruments. Indeed, the procedures newly devised rely heavily on the effective cooperation between national and European institutions as well as on a variety of soft law instruments.

ПРАВОВА ПРИРОДА ПРАВОВІДНОСИН У СФЕРІ СТРАХУВАННЯ: АДМІНІСТРАТИВНО-ПРАВОВИЙ АСПЕКТ

On the basis of the systematic theoretical and legal analysis of scientific researches and the current legislation the legal nature of insurance which is caused by three key approaches – economic, material and legal is investigated. The economic essence of insurance is expressed through the category of monetary funds needed to cover unforeseen needs of society; the material nature of insurance is disclosed through the category of monetary funds, which are used to compensate for damage caused by natural disasters and unforeseen circumstances; the legal content of insurance is manifested through a set of rules governing economic relations related to the protection of the legitimate interests of individuals and legal entities, public entities. It is noted that insurance has all the main functions of the category of finance in financial law but in certain specific manifestations. It is stated that insurance is a complex legal institution, which includes the rules of constitutional, civil, financial, administrative, labor law, social security law, and legal relations arising in connection with insurance, which are public and private law. Imperative norms of the field of financial law have priority in the regulation of public relations, formed in the organization of insurance, implementation of compulsory insurance, licensing of insurance entities, ensuring financial stability and solvency of insurers, on the reorganization of insurance companies, in the National Bank Ukraine's regulatory powers in the areas of insurance control and insurance supervision.

A leadership model for high-intensity organizational contexts

PurposeThis paper aims to offer a new leadership perspective based on the premise that leader effectiveness depends on the context in which leadership behaviors are enacted.Design/methodology/approachLiterature in the areas of abusive supervision and leadership were reviewed. Using social learning and attribution theories, this study develops propositions regarding the role of perceived abusive supervision in high vs low-intensity organizations.FindingsIn this theoretical account, this paper distinguishes between low and high-intensity work organizational contexts articulating a rationale for conditions appropriate for directive leadership. This paper posits that while directive leadership will be more prevalent in high-intensity contexts, it will be specifically targeted toward poor performers, those with personality characteristics that are tied to poor performance and those engaging in deviant behaviors. This study proposes that outcomes of directive leadership will depend on how it aligns with organizational norms and culture and the causality attributed to such behaviors.Research limitations/implicationsRecent leadership theories focus on nurturing and providing support to followers. This paper posits that such theories are suited to low-intensity organizations. This study offers a counterintuitive perspective in proposing that directive leadership which involves inducing stress, will lead to better outcomes in high-intensity organizational contexts. This paper offers testable propositions and avenues for future research on directive leadership in high-intensity organizational contexts.Practical implicationsBased on the premise that leadership is context-dependent, this study proposes that directive leadership is best suited in high-intensity organizational contexts, which is a novel proposal.
