Abstract

The thesis of this study is based on the recognition that the current legal regulation regarding the performance of work or other paid activities by a child in modern sport is sufficient. The performance of work by children is becoming increasingly practical, because usually the condition for achieving success in senior sports at the highest level is to start training at the age of only a few years. The Labor Code introduces art. 304 [5], which allows children to perform work or other gainful activities after meeting a number of criteria contained in this legal provision. This study presents a detailed analysis of this regulation, and then transfers these considerations to the ground of modern practice in sport. The author in this study relies on many independent levels - both code regulations - labor code, civil code, family and guardianship code, internal regulations of Polish sports associations, as well as practice.
