Abstract

ABSTRACT Indonesia is a country that adheres to a civil law legal system, where all forms of regulation must be written and form the basis of statutory regulations. At present the laws and regulations in Indonesia that have been made are over regulated. Apart from that, there are still many regulations that are considered to be overlapping. The overlapping regulations give rise to several new problems, including horizontal conflict of legal norms, the emergence of unscrupulous persons extortion, and biased regulations. On this basis, the House of Representatives has taken steps to simplify statutory regulations by using the omnibus law method. With these steps, it is hoped that the creation of legal harmonization and increasing investment in Indonesia Keywords: Simplification of laws and regulations, Banking. ABSTRAK Indonesia adalah sebuah negara yang menganut sistem hukum civil law , dimana segala bentuk peraturan haruslah tertulis dan berbntuk peraturan perundang-undangan. Pada dewasa ini peraturan perundang-undang di Indonesia yang telah dibuat terbilang sengat banyak ( over regulated ). Selain tiu juga masih banyak peraturan yang dinailai tumpang tindih. Peraturan yang tumpang tindih menimbulkan beberap permaslahan baru diantaranya konflik norma hukum secara horizontal, munculnya oknum yang melakukan pungli, dan membuat peraturan menjadi bias. Atas dasar tersebut Dewan Perwakilan Rakyat melakukan sebuah langkah simplifikasi peraturan perundang-undangan dengan menggunakan metode omnibus law. Dengan langkah tersebut diharapkan akan terciptanya harmonisasi hukum dan meningkatkan investasi yang ada di Indonesia. Kata Kunci: Simplifikasi peraturan perundang-undangan, Perbankan.
