Abstract

The article is devoted to the analysis of the possibility of giving the moral value to the rule of law. The authors carry out the study of the arguments of the contemporary representative of legal positivism Joseph Raz in the context of his understanding of the rule of law regarding the conception “the internal morality of law” by Lon Fuller. The rule of law principle is considered as a sign of the virtue of law close in meaning to its moral value. This problem is developed in the framework of the ongoing discussion between natural law theory and legal positivism.
