Abstract

The article examines problematic issues related to the procedure for conducting and processing the results of a public operational search event «inspection of premises, buildings, structures, terrain and vehicles». The author draws attention to the need for legal regulation of the public inspection of residential premises due to the restriction of a number of constitutional rights of citizens during its conduct. The article argues the expediency of preparing a protocol based on the results of a public survey, regardless of the fact of the seizure of objects and documents, and also proves the importance of the participation of representatives of the public (disinterested persons) throughout the event, and not only in the case of the seizure of objects and documents of operational interest. The author of the article proposes amendments to the departmental regulatory act regulating the procedure for conducting a public examination, regarding the procedure for conducting and pro-cessing the results of the operational search event under consideration
