Challenges in Cybercrime Prevention and Legal Frameworks in India: An Analytical Study

The rise of cybercrime has been a major problem for countries, businesses, and people all around the world. The purpose of this study is to shed light on the difficulties in enforcing laws against cybercrime in India and to highlight the critical need for such a framework in order to stem the tide of this rapidly expanding threat. There has been an upsurge in cybercrime in India in recent years. The fact that it has such a detrimental effect on people's social and economic life makes it a very worrying issue. Data from cybercrime cases prosecuted in India's most susceptible states and cities under the IT Act and the Indian Penal Code formed the basis of our study. In addition, we have examined the data of cybercrime instances perpetrated by individuals of varying ages. In addition to outlining the many reasons for cybercrime and the crimes themselves, this article also provides crucial recommendations on how to reduce cybercrime. Both the investigation and punishment of cybercriminals and the general deterrent against cybercrimes are weakened by these obstacles. To tackle the unique problems posed by cybercrime in India, this study acknowledges the need of a thorough legislative framework and suggests important components that should be included in the laws.

Digital Forensic Accounting: An Overview

Forensic analysis has become crucial for detecting financial crimes such as fraud, extortion, money laundering, and tax evasion in a rapidly evolving world. This type of analysis is also essential for promoting economic development and enhancing public trust in governments. As fraud strategies advance alongside rapid digital innovations, traditional forensic accounting relies on manual data examination and is increasingly inadequate for addressing sophisticated criminal fraud. The rise in cybercrime underscores digital forensics' need to conduct effective investigations. This study provides an overview of digital forensic accounting, emphasizing the need for forensic accountants to acquire digital forensic skills to conduct thorough investigations. It reviews previous research highlighting the importance of integrating digital technologies into forensic accounting, stressing that this convergence is crucial for enhancing the detection of financial crimes and cyber fraud. Furthermore, the study outlines the basic concepts of both traditional forensic accounting and digital forensics and presents some digital forensic accounting tools that can be utilized in forensic accounting and computer forensics.

Modelling cybersecurity impacts on digital payment adoption: A game theoretic approach

The pervasive adoption of digital payment systems globally is a crucial development, shaping the financial landscapes of diverse nations. However, this surge in adoption has precipitated a concerning rise in cybercrimes. This prompts users to reassess preferred payment modes and occasionally leads to a shift back to traditional cash transactions. Given the central role of digital payments in steering the digital economy’s growth and their profound impact on a country’s gross domestic product, the imperative to augment the number of digital payment users becomes increasingly compelling. In response to this imperative, this article introduces a game theoretical model to comprehend how digital payment service providers can ensure optimal security for their services and systems. The objective extends beyond merely addressing the escalating threat of cybercrime; it also seeks to cultivate a pervasive sense of safety among users. Simultaneously, it endeavours to dissuade cybercriminals from investing efforts in exploiting the robust security measures implemented by digital payment service providers. To validate the efficacy of our model, we employed a strategic approach. We have formulated four research questions using the problematization technique and leveraging a thorough examination of the existing literature. Subsequently, we systematically map the findings of our model, ensuring a nuanced alignment with the existing academic discourse. The article aims to have a widespread and significant impact by enhancing security and fundamentally influencing the trajectory of digital payment adoption, thereby contributing to the development of the digital economy.

Digital character assassination in the Jordanian law

One of the rights inherent in a legal personality is the ability to maintain the individual's dignity and treat himself with respect, regardless of his social status. The rise of cybercrime has made it possible to launch digital attacks on someone's honor or reputation, creating a need for rules that limit what can be posted on personal pages and websites. The adoption of Cybercrime Law No. 17 of 2023 shows that Jordanian lawmakers have been proactive. Through the use of a descriptive and inductive analytical approach, this research demonstrated the uniqueness of this legislation, which prohibits the distribution or attribution of any works aimed at defaming a person’s reputation. Presenting an incorrect image of the targets and isolating them socially is the deliberate moral destruction of a person, organization, institution, or social group through spreading rumours, fabricating accusations, and manipulating data and facts. This procedure is similar to the deliberate assassination of individuals. Lawmakers in Jordan have tightened penalties for the perpetrators of this crime and those who helped commit it. The study found that although the goal of character assassination and the crime of digital defamation is to harm the victim's reputation and dignity, there is a significant difference. Character assassination differs from digital defamation in that it requires a specific goal: the moral destruction and social isolation of the targeted individual. This paper aims to clarify the term character assassination, analyze the legislative text that explicitly criminalizes it, identify the elements of this crime and how it is committed, verify the criminal protection procedures decided by the Jordanian legislator, and explain the reasons that prove these crimes. Optimizing fraud detection in financial transactions with machine learning and imbalance mitigation

AbstractThe rapid advancement of the Internet and digital payments has transformed the landscape of financial transactions, leading to both technological progress and an alarming rise in cybercrime. This study addresses the critical issue of financial fraud detection in the era of digital payments, focusing on enhancing operational risk frameworks to mitigate the increasing threats. The objective is to improve the predictive performance of fraud detection systems using machine learning techniques. The methodology involves a comprehensive data preprocessing and model creation process, including one‐hot encoding, feature selection, sampling, standardization, and tokenization. Six machine learning models are employed for fraud detection, and their hyperparameters are optimized. Evaluation metrics such as accuracy, precision, recall, and F1‐score are used to assess model performance. Results reveal that XGBoost and Random Forest outperform other models, achieving a balance between false positives and false negatives. The study meets the requirements for fraud detection systems, ensuring accuracy, scalability, adaptability, and explainability. This paper provides valuable insights into the efficacy of machine learning models for financial fraud detection and emphasizes the importance of striking a balance between false positives and false negatives.

In today's rapidly evolving world of science and technology, our interactions with devices like Alexa and Siri have become as commonplace as conversations with family members. Initially, technology served to create products, generate services, or achieve desired results. However, the advent of affordable and accessible new technologies has ensnared everyone in its web, even influencing mundane activities such as drinking water, with smartwatches reminding us to hydrate. Services like Swiggy and Zomato deliver food within minutes, fostering a culture of convenience that can make us lethargic. Technology's impact spans across booking travel tickets, movie reservations, online shopping, and virtual classes, making us increasingly reliant on it. Traditionally, the essentials for human life were "Roti, Kapda, aur Makan" (food, clothing, and shelter), but now smartphones and internet access have joined this list. While technology's success hinges on data availability, it also raises significant concerns about privacy and security. The Supreme Court of India has highlighted the misuse of social media for spreading falsehoods and violating privacy rights. Social media's pervasive influence affects all age groups, particularly children, exposing them to inappropriate content and leading to premature mental maturity. This exposure results in risks like cyberbullying, sextortion, cyber trafficking, child pornography, and online fraud. Consequently, children and parents face mental health issues, academic distractions, and potential criminal involvement. The rise in cybercrime has placed India among the top ten countries affected, with Russia leading the list. The growing dependence on technology necessitates a balanced approach to leverage its benefits while safeguarding against its threats.

Economic cybercrime in the diaspora: case of Ghanaian nationals in the USA

Purpose This study aims to delve into economic cybercrime within the African diaspora, with a specific focus on Ghanaian nationals residing in the USA. It aims to shed light on the nuanced and unique approaches that diasporic actors adopt to execute economic cybercrimes, especially online frauds. Design/methodology/approach Drawing on press releases and official indictments collected from the U.S. Department of Justice, the study adopted content analysis. Through this approach, the study outlines its findings Findings The analysis reveals patterns in economic cybercrimes among Ghanaians abroad. Notably, the findings suggest that diasporic individuals often work with local accomplices to perpetrate various economic cybercrimes, with money laundering being particularly prevalent among those living outside their home country. This underscores the profound influence of geographical location on the choice of cybercriminal activities. Moreover, the research reveals that diasporic actors use several tactics, including adopting false identities to interact with victims and the creation of sham companies for laundering money. Additionally, demographic characteristics such as age and gender seem to significantly influence the involvement of diasporic individuals in economic cybercrimes. Research limitations/implications The research was primarily based on press releases and official indictments within the USA. Although these sources offer substantial insight into the rise of cybercrime among Ghanaian diaspora members, their focus on specific data types and geographical regions might constrain our comprehension of the nuances of this phenomenon, particularly across various diasporic groups and regions. Hence, future research could enhance our understanding by conducting fieldwork, not just in the USA but also in other areas using primary data to delve deeper into the issue of cybercrime within the diaspora. Practical implications The study’s findings have implications for individuals, organizations and policymakers alike. By understanding the strategies of economic cybercrime offenders, as demonstrated in this research, individuals can be better equipped to navigate digital technologies for both personal and business purposes. Moreover, policymakers and government agencies can use these insights to develop policies aimed at mitigating the spread of economic cybercrimes, particularly within diasporic communities. Originality/value The paper stands out for its innovative approach and scope. While numerous studies have explored cybercrime activities, the prevalence among diasporic actors remains underexamined. Through its methodology and scope, this paper opens avenues for further research into the phenomenon of cybercrime within diasporic communities.

Advancing Digital Forensic through Machine Learning: An Integrated Framework for Fraud Investigation

The rise of cybercrime and cyber-related crime encourages efficient digital forensic investigations more crucial than ever before. Traditional investigation methods can be time-consuming, costly, and resource-intensive, while machine learning algorithms have the potential to reduce the complexity by promoting automation and investigation capabilities. This study begins with an analysis of digital forensics framework using a document analysis methodology. Moreover, exploring current practice and potential implementation of machine learning in digital forensics for fraud investigation is demonstrated through the features of Autopsy 4.15.0, a widely known digital forensics tool. The findings suggest the implementation of a comprehensive digital forensic framework that prioritizes the interpretation phase, with the support of machine learning capabilities. At present, machine learning mainly supports the analysis phase, which happens to be the most time-intensive process of digital forensic investigations. Furthermore, as fraud investigation has a role of fraud detection and prevention, current digital forensics procedures do not support the fraud detection and prevention process, despite the potential for machine learning to support this through pattern recognition.These discoveries are particularly significant in the fight against fraudulent activities, such as tax fraud, data fraud, financial fraud, and asset misappropriation, in the digital age.

Legislative Responses to Cyberbullying in the UAE: An Examination of the Effectiveness of Two Federal Decrees

Abstract This article examines the phenomenon of cyberbullying from a legal perspective, focusing on the United Arab Emirates (‘UAE’). The increased use of technology in daily life has led to a rise in cybercrime, including cyberbullying. Children are frequent users of the cyber-world, and cyberbullying has become a significant issue that can have severe physical and psychological impacts. This paper aims to explore cyberbullying in the UAE and analyse the relevant provisions of two laws: the Federal Decree Law No. 34 of 2021 on Combating Rumours and Cybercrime and the Federal Decree Law No. 3 of 2016 on Child Rights. Specifically, the paper addresses two questions: whether the concept of cyberbullying is distinct from that of physical bullying, and, more importantly, whether existing UAE laws are sufficient to address cyberbullying. The paper concludes by highlighting the urgent need for the UAE to revise some provisions to tackle cyberbullying and protect users, especially children.

Side-channel attack–resistant PRESENT cipher by versatile key scheduling and compact S-box utilizing optimized three-phase logic design

The most widely used technology at the moment is the Internet of Things (IoT), which is expanding at a rapid pace because it allows us to remotely control and manage a variety of smart devices and relieves us from our demanding daily routines. Technology is also vulnerable to security breaches, as evidenced by the rise in cybercrimes and identity theft. More so than any other known IoT security breach, side-channel analysis is extremely insecure. A current issue for lightweight IoT applications is differential power analysis, a kind of side-channel analysis that is very accurate in obtaining the secret key. As a result, developing a safe style takes more time and effort. PRESENT is an easy-to-use, low-power encryption algorithm that is based on Advanced Encryption Standard (AES) and is utilized in IoT devices like RFID tags and access cards. Even with the plethora of countermeasures proposed in the last ten years, none are able to keep up with the IoT’s rapid expansion. A clever combination of masking and hiding techniques could stop several security breaches. Masked three-phase dual rail pre-charge logic is a new hybrid countermeasure that thwarts combined side-channel attacks and is suggested as a means of attaining the necessary degree of security. The hybrid design utilized in PRESENT resulted in an increase in complexity and required more work in terms of area and power. Consequently, more PRESENT optimization techniques are applied. Additionally, for PRESENT hardware implementation, a flexible key scheduling structure with parallel input and output is proposed. Using the Cadence Virtuoso simulation tool with 180-nm technology, a secured structure combining optimized algorithm and secured logic is designed, and the outcomes are analyzed. Normalized energy deviation (NED)/normalized standard deviation (NSD) analysis and Pearson correlation are used to analyze safety. The simulation results for the gates show that our proposed logic has the lowest values of NED and NSD at the assigned frequencies. When compared with side-channel analysis, the outcomes have shown to be both safe and effective. In comparison to earlier designs, the suggested system’s area and power consumption are cut by 67% and 64%, respectively.

As users, we consistently engage with computers for activities such as communication, data sharing, information retrieval, social interactions, and more, all conducted over networks. It is evident that the network connecting various devices globally, including servers, computers, laptops, mobile phones, etc., serves as the fundamental technology facilitating these tasks. However, this interconnected system poses a significant threat in the form of cybercrime. Despite the implementation of cybersecurity measures throughout the network, there exist flaws and obstacles that compromise security, leading to the occurrence of these crimes. Securing cryptocurrency transactions: Innovations in malware detection using machine learning

Cryptocurrencies are crucial in modern commerce and finance, whether at the national, corporate, or individual level. They serve as fundamental currencies for buying and selling, enabling various business transactions. However, the rise of cybercrime has brought about concerns regarding their operations, potential breaches in encrypted currencies, and the security systems managing them. The frequency of attack tactics and the motivation of attackers seeking financial gain are well-known. Many cryptocurrencies lack the necessary algorithms, techniques, and knowledge to effectively detect and mitigate malware, making them vulnerable targets for hackers. In this study, machine learning techniques are employed to detect malicious code in digital currencies. Additionally, a comparison of these techniques is conducted to determine the most suitable algorithm and technology, Furthermore, this study highlights the importance of effective malware detection in securing cryptocurrencies. Three datasets of different sizes were used, each yielding distinct results based on dataset size. The AdaBoost model demonstrated superior performance when applied to the short dataset, while the decision tree model performed best with the medium-sized dataset. Conversely, the Naive Bayes model consistently produced the worst results, while the large-size KNN model achieved the highest performance.

The rise of cybercrime has caused the public to worry about criminal acts of theft and falsification of personal data in electronic form. Therefore, the government is obliged to provide protection to the public from all forms of disturbances caused by misuse of information technology and digital transactions. Based on this, this research aims to find out and understand what are the obstacles for BSRE as an agency providing electronic certificate management services which cannot provide services in general. Then, does BSRE's authority to provide general electronic certificate services to the public conflict with statutory regulations? The method used in preparing this research is the Normative Law research method with the data source, namely secondary data collected through literature study. The research results show that the obstacle for BSrE as an agency providing electronic certificate management services is that it cannot provide services in general because it is still separated by agency and non-agency provisions which limit the scope of BSrE in providing electronic certificate services to the public/general public. Furthermore, BSrE as an electronic Certification Organizer only serves the public as Indonesian citizens who have the status of government or agency employees. Processed to remove information before extracting meaningful features. Finally, the model undergoes training and testing to ensure reliable results, in detecting instances of Intimidator in text-based data.
