SOCIAL, ECONOMIC, AND POLITICAL ASPECTS OF THE DEVELOPMENT OF THE PUBLIC ADMINISTRATION SYSTEM: THE EXPERIENCE OF RUSSIA AND THE COUNTRIES OF THE BALTIC REGION

The growing macroeconomic and political tensions between Russia and the Baltic States since the latter entered into the European Union have emphasized an urgency in establishing reciprocal relationships, based on common ground and mutual interests, to relieve the consequences of sanctions and restrictive policies. The article is aimed at highlighting the distinctions in the public administration framework in Russia and Baltic countries. Thus, the political power from forming a system of public administration can leverage influence on the social and economic relations in conditions of legitimacy and participation of civil society arrangements. The article involves comparative evaluation of Russian and Baltic model of public administration as well as deep comparison of public-private partnership (PPP) and state procurement models in Russia and abroad. Authors highlighted pros and cons of both Russian and foreign frameworks, resulting in “cooperation-prosperity” course.

Ціннісно-смислові особливості формування англосаксонської традиції публічної політики

Досліджено ціннісно-смислові особливості формування публічної політики в англосаксонській традиції. Зазначено, що історичний контекст англосаксонської традиції слововжитку терміна “публічна політика” пов’язаний із англійською системою прецедентного права, однак публічна політика як окрема наукова дисципліна почала формуватись у 50-х рр. ХХ ст. Наголошено на тому, що для вітчизняних пошуків української моделі публічної політики важливим джерелом є осмислення англосаксонської традиції, етапів її формування та їх відмінностей, а також врахування сучасних глобальних умов творення нових типів публічних політик із широким колом суб’єктів.

Formation of the Institutional Model of Public Administration of Post-Industrial Transformation of the Ukrainian Industrial Complex

The analysis of the institutional factors that negatively influenced the activities of the industrial complex of Ukraine in the process of formation of the neo-liberal economy model was performed. It was clarified that the accelerated liberalization of economic relations in Ukraine caused the loss of the core function in ensuring the effective functioning of the industrial sector - management. On the basis of the study of the change of key economic development indicators, the consequences of the crisis in industry were found out. The current conditions of the Ukrainian industrial sector development were described by clarifying such trends as globalization, socialization and humanization, intellectualization and business integration. The conceptual provisions of the institutional model of public administration of the development of the Ukrainian industry on the basis of the post-industrial economy have been formed. The goals, objectives, strategic priorities of the industrial sector development were identified and the promising form of business organization for introduction of high-tech production was determined. The main areas for improving the public administration frame with respect to the regulatory, supporting and coordination components and by forming an effective mechanism of public control were clarified.

CONSIDERATION OF MODELS AND MECHANISMS OF PUBLIC ADMINISTRATION OF PROCUREMENT OF GOODS, WORKS AND SERVICES IN CONSTRUCTION IN UKRAINE

The article presents the questions of reviewing models and mechanisms of public administration in the procurement of goods, works and services in the field of construction. A comparative analysis of the types of public procurement mechanisms in construction, based on a set of features, has shown the superiority of a centralized type of mechanism that facilitates the introduction of efficient and flexible procurement methods, for example, the conclusion of framework agreements. The author’s vision of the mechanism of state building purchases, in the form of a conceptual model and system differences, is proposed. It is determined that a decentralized model of public procurement management involves the independent implementation by purchasers of procurement, that is, allows each customer to procure goods, works and services in the field of construction. The centralized model of public administration is characterized by the implementation of public procurement in order to provide the general needs of a single body on public procurement, that is, customers commission the implementation of public procurement on their behalf, a centralized body. According to the combined model of management, public procurement in the construction industry takes place under contracts implemented under the centralized model, and the direct ordering and receipt of goods, works, or services takes place according to the rules of a decentralized model. It is noted that according to the system-wide understanding of the mechanism of public administration in the procurement of goods, works and services in the field of construction, it represents a set of specialized management technologies (methods, techniques and tools) that ensure the organization of the process of public procurement of construction products by authorized agents. The direction of this process is determined by the need to implement the principles of vali- dity and innovation, fair choice of the best bidding, prevention of corruption and ensuring the high efficiency of the implementation of public public procurement.

Paradoxical Internationalization: Regulatory Reforms in the Mexican Health‐Care System through the Lens of European Experience

AbstractOver the recent past, Mexico has been exemplary in having launched regulatory reforms in order to modernize its health‐care system, with major objectives being universal insurance coverage and less infrastructural fragmentation. In this article we argue that these reforms, widely inspired by the global New Public Management movement and its aftermath, take shape in a difficult encounter with both the traditional public administration model in Mexico and tensions endemic to the aforementioned reform movement as attempts to enhance system integration coincide with procedural disorganization. This results in a paradoxical internationalization of the Mexican health‐care system due to which the above objectives may be difficult to achieve. To illustrate our argument, we examine the Mexican case through the lens of experience two European countries (Germany and Norway) in which reforms have affected the health‐care system in a similar way.

The Interaction between Private and Public Actors: Traditional Principles versus New Trends<br>A Comparative Analysis

Public law has changed markedly over the last two decades, a phenomenon which is attributable to various causes. This paper offers a brief overview of the state of the Italian administration and its relationship to citizens and civil society, in order to explain them to a non-Italian reader. The traditional top-down Franco-Napoleonic pattern of public administration highlighted the superiority of the administration over all other public powers and a fortiori over the citizens. Can a different (bottom-up) model of public administration be individualized and what are its main features? To better evaluate these trends, a comparative analysis with a federal system inspired by a common law culture – such as the USA – will be carried out. The participatory and negotiated elements in the Italian legal system will be compared with the fair procedure concept in the US system of administrative law. This research will show that the ‘traditional model’ is very much the dominant one in both cases. However, there are indeed instances of a bottom-up model, though these seem to differ in context, content and form. The outcome of these changes is that a mixed model situation arises: the traditional model is infused with dialogue-type elements. The Italian legal system should learn from the American experience. Both negotiated rule-making and environmental mediation are examples of a compromise between the traditional and the dialogue model. They can be viewed as concrete proof of the slow but inexorable evolution of the traditional model towards one of dialogue

The effect of the EIDAS Regulation on the model of Hungarian public administration

Regulation (EU) N°910/2014 on electronic identification and trust services for electronic transactions in the internal market, adopted on 23 July 2014 (hereinafter the eIDAS Regulation) is a significant step towards providing such a predictable regulatory environment that enables secure and seamless electronic interactions between businesses, citizens and public authorities of the members of the European Union. The Regulation ensures that people and businesses are allowed to use their own national electronic identification schemes (eIDs) to access public services in other EU countries where eIDs are available, moreover, it introduces the concept of trust services and prepares for the harmonization of further areas.
 Unfortunately, the eIDAS Regulation together with the Commission Implementing Regulation 2015/1501 is not in perfect harmony with the established and emerging models of operations in public administration in Hungary and consequently a common foundation for secure electronic interaction could be provided only with strong limitations.
 To avoid this undesirable situation, the paper proposes the introduction of two registration procedures (built on the basis of the services in the scope of the Regulation) that would complement the missing data items in a transparent manner. This extension would result in the provision of all registered electronic services of the EU countries for all EU citizens.

Такий аналіз потрібен для розробки української моделі публічного управління з активним і розвиненим громадянським суспільством.

Model as a description of the public administration system of the population legal education

On the basis of the analysis of scientific literature, law-oriented models proposed by Ukrainian scientists were determined; their generalization was carried out. The functional model of public administration of legal education in Ukraine has been developed and described its main elements and approaches have been defined.

The concept of civil society and public administration

The category of «civil society» is at the intersection of several scientific fields and is explored by philosophy, political, legal, and other sciences. Today, both among Western and domestic researchers, there is a rather large variety of opinions and assessments regarding the interpretation of the complex, multidimensional issues of civil society. And the achievements of various scientific fields should be involved in the reform of the system of public administration and local self-government, as well as to find an effective model of public administration with effective mechanisms of interaction between government and society. To this end, a brief theoretical analysis of the concept of civil society has been made since the ancient times, when in the history of civil society and state relations two tendencies, called liberal and conservative, have emerged and began to emerge.The first is the division of civil society and state, in opposition to man and political power; is based on recognition of the indivisibility of the individual as a subject of law, guaranteeing his freedom of life and the limited political power. The second (conservative trend) - in the merger of man and power, politics and law, within a single statehood. With the consistent development of this trend, state policy rests on the notion that private interests are insignificant, irrelevant. Activation of state policy and recognition of the right of state dominance over society are put forward.The author draws attention to the fact that civil society in the West (where liberalism prevails) has evolved over a long historical period, and therefore differs from those in the countries that have become independent after the collapse of the USSR. Therefore, one should not be attracted to the borrowing experience of other countries. In the author’s opinion, one must find his own, possibly unique, model that is relevant to our national traditions, which should be oriented towards the principle of individualism, and not collectivism. At the present stage of development, the role of the state and the authorities is to improve the system of public administration, to develop effective mechanisms that should promote the development of civil society in Ukraine.

Modern paradigm of ecologization of public administration

The article analyzes the concepts and models of public administration, their features and basic principles and reveals some gaps, in particular the absence of an ecological component. The place and significance of ecologization as a necessary condition for the transition of Ukraine to the new model of public administration and innovative trends of the qualitatively new paradigm of ecologization of public administration are determined. The basic principles of the modern paradigmatic model of ecologization of public administration are formed.

Theoretical approaches to transformation of modern models of public administration in the field of safety and defense

The article is devoted to the analysis of the peculiarities of functioning of wellknownmodels of public administration in the field of security and defense. To determine the theoretical principles of the system functioning, the author analyzes the peculiarities of all known models of public administration and defines their characteristic features. The article substantiates the basic principles of governance that are characteristic of democratic countries, defines the spheres for restriction of democratic principles when creating a modern model of public administration in the field of security and defense.

Philosophy for Open Government

Open government is a term that has been built socially for a long time; however it is from the promotion that the Obama administration from the United States realizes that it has achieved a high penetration in the political and public agenda of the various countries. The main concern of open government is to articulate efforts of government capacities and modernization of public administration, following the principles of transparency with high openness, participation and collaboration. The aim of this article is to analyze from philosophy the principles that should guide the model of governance and public administration to meet the ultimate goal of the state cosmos.

The provision of public services in municipalities in Thailand to improve the quality of life of elderly people

The purposes of the research were: 1) to study the models of public service provision in municipalities to improve the quality of life of elderly people and 2) to study the factors influencing success in providing public services for elderly people by the municipalities in Thailand. The data were collected using in-depth interviews, focus group discussions, and non-participatory observation and the data were analyzed using content analysis. The findings indicated that the municipalities applied “mixed” models of public service provision for elderly people. First, in the Traditional Public Administration model, the municipalities provide services for the elderly through bureaucratic rules in that they implement the activities themselves. Second, the New Public Management model emphasizes collaboration between the municipalities and private sector. Lastly, the New Public Governance model focuses on a collaborative partnership and network of all stakeholders such as the Ministry of Social Development and Human Security and the elderly's clubs to establish the Elderly Quality of Life Development Center and schools for the elderly to be the center for the elderly's activities. The factors influencing the success of municipalities in providing public services to elderly people were divided into two parts: 1) internal organizational factors such as the leadership of the municipal decision makers, autonomy in policy making, correct and updated information, committed personnel, and budget; and 2) external organizational factors such as national policies, plans and laws for elderly people, the responsible governmental agencies for the elderly people, and the partnership and networks of stakeholders.

UKRAINIAN POLITICAL REGIONALISM IN CONTEXT OF CONTEMPORARY SOCIAL AND POLITICAL CHALLENGES

Social and political challenges facing Ukraine after the Revolution of dignity, pro- cesses of regionalization and decentralization of European research actualized in political Regional studies. Regions in the EU has in fact become the basic structures of European political and economic space in the context of the philosophy of «Europe of Regions».Obviously, the Ukrainian political science must not stand by these trends pan and actively accompany this general trend of spatial structures. For balance and stability of the country depends on the regional structure, adequacy of political and socio-econom- ic development. In this context it is particularly topical issue is the balance in the rela- tions between the «center-regions» regulation is carried out by centralized and decen- tralized mechanisms. Accordingly, the purpose of the article is analysis of domestic political of regions in the current development of the state in the context of modern trends of regionalism.The article analyzes the domestic political status of regions in the context of the current complex processes of constitutional reform, decentralization of power and territorial re- form. It is noted that areas related to the political-spatial system, acting as a kind of po-litical system is not sufficiently developed. As a result, regional issues considered most economists or geographers, and the main thrust of Political Studies focused on the analy- sis of regional electoral processes and regional elites.This state of the domestic political concern of regions as administrative and territo- rial reform one of the main areas involve drastic changes is the system of public authorities at regional level. All this adversely affects the development of regional theory and practice of regionalism, as evidenced by the extremely inconsistent regional policy, the complexity and ambiguity of tragic political and legal processes: the Russian occupation of Crimea, the self-proclamation of the so-called Donetsk People’s Republic (DNR) and Luhansk People’s Republic (LNR).It is noted that the problem of disintegration of the Ukrainian society since indepen- dence have not been solved. Under regional theory should offer the best answer to this challenge. In particular, what model of government will help curb the centrifugal tenden- cies, strengthening integrity and thus provide an effective model of public administration and democracy.Given the tragic events that occurred in Ukraine in 2014–2017 years, to administrative- territorial reform on the basis of administrative regionalism became impossible. Only with the use of policy instruments regionalization return of the Crimea and Donbas be real. It is noted that the political regionalism hides significant political risks versus administrative, including uncertainty about the future prospects of devolution trends.In this regard, notes that the learning experience of European countries, we should not idealize him and mindlessly trace unconditionally perform tips and suggestions of foreign politicians and experts (especially in the federalization). After these reforms, most EU countries carried out under conditions which significantly different from the current Ukrai- nian. It is also necessary to take into account national specifics, which differs signifi- cantly from European and neighboring countries geographic presence aggressor who provokes and supports separatist movements in Ukraine.

Que Modelo é Esse? As Alterações nos Processos de Capacitação de Recursos Humanos nos 20 Anos do Plano MARE

The Master Plan for the Reform of the State Apparatus was implemented by the Brazilian Government in 1995. Among its actions, it instituted the Policy for Staff Development in Public Administration. This action resulted in the guidelines of the public service Training Policyin Brazil. Thus, this article analyzes the main changes in the training processes at the University of Brasilia (UnB), between 1995 and 2015, in the face of the literature on strategic people management. The study is qualitative and as a data collection technique interview and documents were used, being evaluated through content and document analysis respectively. The results were classified into four models of public administration addressed in the literature. The results about the working conditions, planning, execution and control of the training policy as well as the incentives to qualification tend to have one or more public administration models adopted. A Administração Pública consensual: novo paradigma de participação dos cidadãos na formação das decisões estatais

O trabalho investiga os novos rumos do Direito Administrativo brasileiro, especialmente no que tange ao controle da Administração Pública na formação do consenso para a tomada de decisões, com os olhares voltados à importância de se compreender a passagem de uma viciosa relação de supremacia a uma valorosa relação de ponderação, que marca o atual estágio evolutivo da interação entre a sociedade e o Estado para a implementação do fundamento constitucional da cidadania a partir do acolhimento do princípio da soberania popular. Após um breve escorço histórico sobre as recentes reformas do Estado, analisar-se-á o tema discutido a partir da propositura de um modelo de Administração Pública que se ajuste às exigências da sociedade moderna hipercomplexa, fomentando a discussão sobre o arquétipo capaz de propiciar uma gestão eficiente, baseada em mecanismos de governança e de tomada de decisões com participação democrática, a partir da lógica do consenso.

Social Co-Governance

In the past 20-30 years, industrialization and informatization made the society more complicated and social conflicts more difficult to deal with; citizens and their demands diversified, and we are now in urgent need of a new public administration model that suits the changed political, economic, and social conditions. Governance thus emerged worldwide, promoting government reforms and public participation, and urging the government to delegate and empower, and quit the fields that they are not good at managing. Scholars discuss the reasons for the emergence of governance from the perspectives of managerialism, the rise of civil society, and administrative reforms. But these are not the only reasons for governance to rise to prominence. It emerged, in a way, in response to the “legitimation crisis” described by Jurgen Habermas. As society develops, citizens require more legitimacy from the government on the basis of what it already provides, and this may involve performance, participation, responsiveness, law-based administration, etc. We hereby analyze the legitimation crisis in a postmodern society and point out that the paradigm of social co-governance is a response to these legitimacy demands and that multiple parties integrate their demands using governance tools such as participation, consultation, empowerment, etc.
