Managing Land Assets For Sustainable Goals To Generate Income Of University

This research aims to find out that increasing university income from land development is a complicated process that requires knowledge and skills in various aspects such as law, urban planning, and the civil structure of buildings that will stand on the land. This research will adopt a descriptive qualitative research approach to understand a particular phenomenon. This approach allows researchers to collect descriptive data to answer research questions regarding optimizing university land management. The research subjects in this study were 30 people consisting of leaders of Surabaya State University and stakeholders who were partners and involved in land development in the University area. Research findings show that sustainable land development is a goal that the University wishes to achieve in the short and long term and needs to be supported by strong financial resources. These results have significant implications for other universities that are managing land assets to contribute income to sustainable land development.

Implementation of a GIS for management effectiveness of data relating to land property, in the department of the ocean (Kribi location)

The Ministry of Domains, Cadastre and Land Affairs (MINDCAF) is the Cameroonian government ministry responsible for drawing up and implementing government policy on domains, cadastre and land. However, the land management policy in Cameroon, and more specifically in the ocean, which envisages emergence in 2035, suffers from numerous problems, such as the complexity of organising the storage and updating of data and access to reliable land information. The aim of the study is to set up a GIS to manage the land assets of the ocean, more specifically TALLA. The methodology consisted of using the cadastral map to choose the GIS technologies and define the architecture of our operation by reorganising the elements of our cadastral map and processing them in ArcGIS and QGIS software, all the while entering the information from the land register in the Attributor table, creating a database. Finally, the GIS has been developed in compliance with technical standards and established objectives. As a result, our GIS offers functionalities enabling the member of the land registry to better archive data, and facilitates the output of the property certificate. It also enables geographic data to be viewed and consulted on an interactive map, spatial and attribute navigation, and data editing. In the light of its results, the GIS implemented can be a promising solution for meeting the challenges associated with current management.

Urgensi Pemberdayaan Tanah Wakaf Muhammadiyah Di Wilayah Bengkulu

This research method uses descriptive qualitative, collective data by conducting in-depth interviews with the chairman and deputy chairman of the Pimpinan Wilayah Muhammadiyah and leadership and deputy leadership of the Majelis Wakaf dan Kehartabendaan. Qualitative data analysis using the Nvivo12 Plus software. The results of the study prove that the management of waqf land assets in PWM Bengkulu, in general, has been going well starting in terms of planning, coordinating, implementation, and supervision even though there are obstacles that are encountered in the field, while in the context of monitoring the management of Muhammadiyah waqf asset,s it is supervised by each assembly concerned and an internal audit is also carried out by the MuhammadiyahCentral Leadership LPPK. Waqf land in the Muhammadiyah Bengkulu area has been used mostly for da'wah activities with facilities for building mosques, education consisting of Kindergarten Schools to Universities, the Health Sector byestablishing hospitals, the social sector planning for the establishment of a Jumpo Home and productive waqf in the form of leasing land and 3 shophouses. The problems or challenges faced by PWM Bengkulu in managing waqf assets are quite dynamic, among them there are still uncertified waqf asset lands.

Influences of Historical and Anthropogenic Factors on the Dynamics of Reconstitution of Post-Cultivation Vegetation in the Sub-Sudanese Zone: The Case of the Department of Dianra, North-West Côte D'ivoire

Prior knowledge of vegetation dynamics, including post-crop recovery dynamics, is necessary for rational and sustainable management of land assets. This study was initiated to assess the influence of historical and anthropogenic factors on post-cultivation reconstitution in the Dianra Department. To this end, information on the history and post-cultivation human activities was collected from farmers. The Phytoecological and dendrometric data were collected using the surface botanical method in the post-cultivation plots. In total, 105 plots of 400 m² were planted in post-cultivation plots between 1 and 32 years old. The influence of historical and anthropogenic factors was assessed using an Analysis of Covariance (ANCOVA), in which the functional traits of the species and the structural attributes of the plots were considered as the variables to be explained and the historical and anthropogenic factors as the explanatory variables. This analysis shows that post-cultivation reconstitution in the sub-Sudanese environment is subject to the influence of several factors, the most perceptible of which are: age, number of years of cultivation, grazed area, cultivation history, groundnut cultivation as the last crop, and cultivation technique by horse and cart. The age, groundnut cultivation as the last crop and the Open Forest/Wooded Savannah cultivation history favoured reconstitution. In contrast, a high number of years of cultivation, grazing and ploughing by horse and cart were unfavourable to reconstitution.

Improvement of the system of taxation of agricultural activities of agricultural organizations

The article is devoted to the peculiarities of taxation of agricultural activities of agricultural organizations. The necessity of introducing a system of taxation of differential rent or net income based on the entire area of land assets in agricultural organizations is substantiated. A methodology for determining differential rent and net income based on the area of agricultural land as objects of taxation has been developed.

Optimizing the Security of Fixed Assets: Strategies to Increase the Recognition of Land and Buildings as Legal Assets

This article aims to find out the optimization of fixed asset security and the recognition of land and buildings as legal assets in Bangkalan Regency. In order to approach this problem, reference is made to the Regulation of the Minister of Home Affairs Number 19 of 2016 concerning Guidelines for the Management of Regional Assets. The data were collected through interviews with the BPKAD of Bangkalan Regency which then the data will be analyzed qualitatively. This study concludes that the implementation of asset security has not been optimal, both in terms of administrative security, physical security and legal security. This is indicated by the large number of land and buildings that are still in the process of submitting for certification, land and buildings that are recognized as owned by other parties, and percaton land. All land assets must be certified on behalf of the Regional Government, put up a land layout mark by making a boundary fence, put up a sign of land ownership, and maintain it so that efforts can be made to maximize the assets to become legal assets.

Introduction: Land is a very important thing in Customary Law (can be referred to as Customary Land Law). The relationship between humans and land is closely related, namely land as a place for humans to live and continue their lives. Customary land is the property of customary law communities that have been controlled for a long time. Customary land law, known as land rights in Indonesia, such as ulayat lands, private lands, business lands, Gogolan lands, bengkok lands, agrarisch eigendom lands, and others.
 Purposes of the Research: This writing aims to find out the relationship between humans and the soil is very related to the land as a place for humans to live and continue their lives. While eigendom is a right of ownership to a land asset that existed during the Dutch colonial era that is subject to the provisions of Western land law in force for eigendom rights, then with the promulgation of the UUPA, the unification of Indonesian land law with the former Western rights that have not been converted to land rights as stipulated in the UUPA.

Local government innovation model in Pekanbaru City, Indonesia: a study of public service mall

This research aims to find a model for implementing local government innovation in Pekanbaru City. One of the Innovation Public Service Mall innovations with the highest score is SMART PETAKU (Pekanbaru City Government Land Asset Management System) with a score of 820. However, there are still several innovations with the lowest score, one of which is the E-Archive with a score of 0. Using the theory of disruptive innovation ( Yu Hang, 2010), the basic design of this study uses a qualitative method with a descriptive approach from primary data sources obtained from in-depth interview techniques and secondary data, namely passive observation techniques. The research findings show that first, the success of the internal perspective is determined by the indicators of visionary and innovative local government head leadership, the right organizational structure with the establishment of a Public Service Mall, an organizational culture that is not separated from the pathology of democracy, and employee competencies that require development. Second, an external perspective determined by supervision from the Pekanbaru City DPRD, community participation, and appreciation factors that have a significant effect on the performance of the Pekanbaru City Government. Third, the marketing aspect is supported by the existence of a dynamic website from the content and information presented. Fourth is the technological perspective, where the Pekanbaru City Government through the Public Service Mall applies the E-Gov concept with application designs for requests and complaints. The conclusion of the study found the IEMT model with internal, external, market, and technology perspective dimensions. Recommendations for further research are collaborative governance studies in service innovation with the private sector at Public Service Malls which are still disproportionate.

The Role of the Medan City Land Office in Issuance of Certificates for Ex-BLBI Asset Substitutes

This study aims to examine and analyze the role of the Medan City Land Agency in handling the issuance of replacement certificates for land rights which are former assets. BLBI, as well as the obstacles faced by the Medan City Land Agency in the process. The research method used is normative juridical research with an analytical descriptive approach. Data collection was carried out through literature and field studies, and research analysis was carried out qualitatively. Based on the results of the research, legal regulations regarding the issuance of certificates in lieu of land rights are regulated in Articles 59 and 60 of Government Regulation No. 24 of 1997 and Article 138 of the Minister of Agrarian Regulation No. 3 of 1997. The role of the Medan City Land Office in safeguarding ex-BLBI land assets involves activities such as tracing ex-BLBI assets based on information from the Ministry of Finance, securing land books, and mapping. Obstacles faced by the Medan City Land Office in managing BLBI assets include transfer of ownership to other parties, difficulty identifying the physical holders of land, falsification of documents, and limited information.

Large-scale land acquisitions exacerbate local farmland inequalities in Tanzania

Land inequality stalls economic development, entrenches poverty, and is associated with environmental degradation. Yet, rigorous assessments of land-use interventions attend to inequality only rarely. A land inequality lens is especially important to understand how recent large-scale land acquisitions (LSLAs) affect smallholder and indigenous communities across as much as 100 million hectares around the world. This paper studies inequalities in land assets, specifically landholdings and farm size, to derive insights into the distributional outcomes of LSLAs. Using a household survey covering four pairs of land acquisition and control sites in Tanzania, we use a quasi-experimental design to characterize changes in land inequality and subsequent impacts on well-being. We find convincing evidence that LSLAs in Tanzania lead to both reduced landholdings and greater farmland inequality among smallholders. Households in proximity to LSLAs are associated with 21.1% (P = 0.02) smaller landholdings while evidence, although insignificant, is suggestive that farm sizes are also declining. Aggregate estimates, however, hide that households in the bottom quartiles of farm size suffer the brunt of landlessness and land loss induced by LSLAs that combine to generate greater farmland inequality. Additional analyses find that land inequality is not offset by improvements in other livelihood dimensions, rather farm size decreases among households near LSLAs are associated with no income improvements, lower wealth, increased poverty, and higher food insecurity. The results demonstrate that without explicit consideration of distributional outcomes, land-use policies can systematically reinforce existing inequalities.

Penggunaan Tanah Aset Milik PT. Kereta Api oleh Masyarakat

One of the main problems until now has not received clear regulations, namely land issues, and the number of conflicts that arise within the community, as well as in the use of land by utilizing and using PT assets. Indonesian Railways (PT. KAI) which is currently in the use and development of businesses to support railway activities, but where there is a lot of use and control of land assets by the community physically. So in the juridical sense of assets owned by PT Kreta Api Indonesia, it can be said that there is uncertainty in the law of land rights, so in this case, an appropriate policy is needed in achieving clarity in the use of land which is as follows the applicable land law regulations. So in writing this study to find out the legal certainty and validity of the use of PT Kreta Api Indonesia's land assets by the community outside the railway activities provided by PT Kreta Api Indonesia. This research uses legal research methods through the use of empirical juridical research methods, with details of writing descriptive analysis. The technique for this research looks at the juridical aspects of the form of land utilization of PT. KAI by the community with a Lease Agreement and the granting of IMB on HPL or HGB. The legal basis for granting rights in the use of land assets of PT. KAI is outside of the activities, businesses, and supports of PT. Kai. The use and utilization of PT KAI's assets by the community are regulated in Spatial Planning in the local area based on Law No. 24 of 1992 and Presidential Decree No. 16 of 1994. Land utilization outside the activities of PT. KAI is contrary to Article 44 of the Agrarian Principles Law, so in this legal act, it can be said to be null and void.

The governance of agricultural lands in marginal areas: A conceptual framework

The present study investigates how local communities cope with the restless abandonment of agricultural lands in marginal areas, providing a theoretical interpretation grounded on the European reality. An analytical framework, based on game theory and inspired by different strands of literature, is used to depict two decision-making processes. First, that of the individual landowner regarding the choice of whether to abandon the land, and the choice of how to intervene (cooperating / not cooperating). Then, the decision-making process of the regulator, concerning the choice of whether and how to support individual or cooperative land management initiatives. A key point of the developed framework is that of endogenizing the factors that contribute to trigger collective commitments, and the conditions that enable or hinder the achievement of desired objectives when collective initiatives are in place. Here, collective commitments are considered non-market regulations of land assets, and they prevail on market forces when land assets cease to be marketable. Results highlight that collective initiatives are preferred to individual actions when there is a high level of land fragmentation, but might need to be supported by external aids in order to be established, and effectively counter land abandonment. Most importantly, collective initiatives cannot be taken for granted and, to an extent, this study contribute to justifying why the rate of land abandonment is particularly severe in highly fragmented areas without collective initiatives. The paper ends with a summary of the main findings, highlights the limits of the approach used, and offers possible developments.

Legalisasi Aset Tanah Transmigrasi Dalam Rangka Penguatan Reforma Agraria di Sumatera Utara

Agrarian reform is a process of rearranging the structure of tenure, ownership, use and utilization of land in a more just manner. Presidential Decree No. 86 of 2018 states that one of the objects of legalization of the assets of the agrarian reform program is uncertified transmigration lands. The complicated problem in legalizing transmigration land is because there are still many remnants of past problems that have not been resolved. This research was conducted to provide an analysis and description of the urgency in implementing the legalization of transmigration land assets in the North Sumatra region in the context of strengthening the agrarian reform program. The type of research used is qualitative research which seeks to find the urgency of implementing legality of transmigration land assets in relation to the agrarian reform program. Based on the letter submitted to the Head of the Workforce and Transmigration Office of North Sumatra Province in 2019, regarding the Data on the Asset Management Program for the Agrarian Reform Task Force (GTRA) activities, there are 5,605 transmigration land areas that have not been certified in North Sumatra Province, spread across 6 regencies. As an object of agrarian reform, the criteria for transmigration land are stated in Presidential Regulation Number 86 of 2018, stating that transmigration land that has not been certified must meet the following criteria: not included in a forest area; or have been granted management rights for transmigration. The conclusion of the regulations governing the legalization of transmigration land assets is an important part of the land certification process which is carried out through land registration.

GRONDKAART LEGALITY AS EVIDENCE OF LAND TENURE RIGHTS BY PT. KAI ACCORDING TO AGRARIAN LAW

Grondkaart or block maps are documents that prove the ownership of assets which are wealth for an institution or company that must be maintained. There are several things that are still being debated regarding the position or legality of Grondkaart itself. One state company that still uses Grondkaart as proof of ownership of its land assets is PT. Kereta Api Indonesia (Persero) or PT. KAI. Land assets PT. KAI is a legacy of the Dutch railroad company which was subject to nationalization, the land often causes disputes due to evidence of land tenure in the form of Grondkaart which is not regulated in Law Number 5 of 1960 and Government Regulation Number 24 of 1997. The formulation of the problem in this article is (1) What is the position of Grondkaart as a basis for rights or evidence of land tenure according to Indonesian Agrarian Law? (2) How is the legal protection and legal certainty of Grondkaart as proof of land ownership by PT KAI so that it can provide a solution to land problems for the residents of Miji Mojokerto? The research method used in this article is the normative legal research method with statutory, conceptual and case approaches. The technique used in the analysis of legal material is to use grammatical interpretation and systematic interpretation. The results showed that Grondkaart's position was not regulated in Law No. 5 of 1960 concerning Basic Agrarian Regulations and Government Regulation No. 10 of 1960 Jo. Government Regulation Number 24 of 1997 concerning Land Registration, this has resulted in that Grondkaart is not a strong proof of ownership of railway land, but can be used as a basis for ownership or as the basis for PT. Kereta Api Indonesia (Persero) to register their land in order to obtain a strong Certificate of Land Rights. Grondkaart is proof of PT KAI's land ownership which if in the process of securing assets a dispute occurs it can be used as proof of ownership where rights have never been renewed.

Criminal Acts Against The Law Of Corruption (Case Study Medan District Court No. 45 / Pid.Sus-TPK/2021 / Fr.Mdn jo Medan High Court case No. 33/Pid.Sus-TPK/2021 / PT.Mdn)

In essence, the land has a very important meaning for human life, because the land is the main foundation of all activities carried out. In accordance with the ownership and use of land in Indonesia, there are lands that are controlled by state-owned institutions, one of which is land controlled by PT.Kereta Api Indonesia (Persero). State-controlled land PT.Kereta Api Indonesia (Persero) which was originally to support the potential development process of PT.Kereta Api Indonesia (Persero) itself, now there are many houses and community business activities throughout Indonesia, one of which is in the city of Medan, North Sumatra province, there are many areas on the edge of the railway where on each edge there are houses and business activities of residents who are renting from the land assets of PT.Kereta Api Indonesia (Persero). The problem raised in this thesis is the lease of land assets of PT.KAI (persero) Division I North Sumatra which led to the conviction in the verdict of committing acts against the law of corruption, because they do not want to fulfill their obligations to pay rent, while the requirements of Article 2 and Article 3 of the UUPTPK are acts against the law (Wederrechtelijkheid) or abuse of control that begins with a violation of procedure or, contrary to the rules or deviations from the authority provided for in the law on procurement of government goods and services, the procedure starts from planning, the need until the completion of all activities to obtain government goods/services with the aim of enriching themselves or benefiting themselves, causing financial losses to the state. While the unlawful acts committed by the defendant include the scope of civil (Onrecht Matiq Overheidsdaad) which is private (vide Article 1365 of the Civil Code) and can file a tort claim in the form of reimbursement of costs, losses, and interest as in Article 1243 of the Civil Code and Article 1267 of the Civil Code.

The Extension and Improvement of the Forest Land Net Present Value Model and Its Application in the Asset Evaluation of Cunninghamia lanceolata Forest Land

In order to solve the problem in that the classical forest land expectation value method ignores the actual forest stock volume when assessing the income at the end of the current production cycle in the forest, and fill the research gap in this area, the technical system of the forest land asset evaluation was enriched. The forest land returns were divided into two parts, i.e., the segmented forest land return price from the growth of the actual forest stand to the end of the growth cycle (Bu1), and the segmented forest land return price for an infinite number of growth cycles after the growth of the actual forest stand to the end of the growth cycle (Bu2). Through structure, the forest land gain price expansion model was obtained, and the stand quality including the average diameter at breast height, average height, stock volume, and outturn of stand as dummy variables were used to construct the growth harvest model related to asset evaluation. Taking Cunninghamia lanceolata forest land as an example, the traditional asset evaluation methods were comparatively analyzed. The residual standard deviation (RSD) of the growth model was less than 10%, the total relative error (TRE) and mean system error (MSE) were within ±10%, the mean prediction errors (MPE) were less than 5%, and the mean percentage standard errors (MPSE) were less than 10%, respectively. Combining the forest land net present value expansion model with the traditional evaluation method, the evaluation value of the forest land assets was subsequently calculated, and accordingly, the forest land asset evaluation prime stand factors were predicated. It was found that the valuation results of the forest land net present value expansion model were consistent with the actual situation. The forest land net present value expansion model can therefore be used for asset evaluation of tree forest land (including natural uneven-aged forest land), bamboo forest land, shrub forest land, and economic forest land, and provide new technical support for forest land asset evaluation.

Pengaturan dan Pengelolaan Aset Tanah Negara dengan Lahirnya Badan Bank Tanah

The Job Creation Law has a major influence with the issuance of Government Regulation No. 64 of 2021 on the Land Bank Agency. Through the Perpres, it is hoped that it can create arrangements and management of state land assets, especially abandoned land, so that it can be utilized for the prosperity of the people. Based on this description, this study aims to determine and analyze the regulation and management of state land assets before the existence of Government Regulation Number 64 of 2021 concerning the Land Bank Agency, to determine and analyze the factors that become obstacles in the regulation and management of state land assets so that a Land Bank Agency is needed. and to know and analyze the legal construction of the regulation and management of the Land Bank Agency in the future. The type of research used is normative juridical research using a statutory approach and concept approach. The research results obtained are: First, the regulation and management of state land assets before the Perpres of the Land Bank Agency was carried out by BPN. Second, the regulation and management of state land assets before the existence of Government Regulation Number 64 of 2021 concerning the Land Bank Agency, the management is still carried out by the National Land Agency (BPN), and the legal construction of the regulation and management of state land assets in the future is a way to fill the void of land bank regulations through principles and values in society.

Pengembangan Aset Tanah Wakaf melalui Budidaya Ikan Lele Berbasis Bioflok di Desa Argodadi Kabupaten Bantul DIY

This community service activity aims to increase the ability to manage waqf land assets so that the community has additional income from biofloc-based catfish farming. The method of implementing this service used training and mentoring. The target partner for this service was Brongkol Hamlet, Argodadi Village, Bantul Regency, DIY. The instrument for evaluating community service activities used a questionnaire and was analyzed descriptively. The service results showed that training in the development of waqf land assets through biofloc-based catfish cultivation proved to increase the ability of the community to obtain additional income. This community service activity concludes that waqf land assets can be managed productively, one of which is through catfish farming.

How do financialised agri-corporate investors acquire farmland? Analysing land investment in an Australian agricultural region, 2004–2019

Abstract This article uses a purpose-designed land parcels database covering all rural land transactions over 16 years (2004–2019 inclusive) to document the ways in which financialised agri-corporate investors acquired farmland in a major Australian cropping and grazing region, New England North West (NENW). Framing these investments through the lens of strategic coupling reveals a mix of land acquisition strategies. Almost 200,000 ha of farmland was acquired by financialised agri-corporate investors in NENW during the study period. Approximately one-third was acquired through takeovers of stock market listed agricultural companies or unlisted agricultural asset management companies, another third involved the purchase of farms already packaged into assetised forms by prior rounds of restructuring and the final third involved the purchase and aggregation of family farms. We interpret this mix of entry modes to indicate a flexible and opportunistic set of dynamics in how financialised agri-corporate investors amass their land assets, underlining their reach and scope in the restructuring of regional agricultures.

Asset specificity and farmers’ intergenerational succession willingness of apple management

Understanding the factors behind apple farmers’ willingness to pass on the management of their farms to their descendants is crucial to the continuity of apple production. Due to the high specificity of the human capital, physical assets, land assets, and geographical location in apple production, this study used a binary logistic regression and a mediating effect model to explore the impact of asset specificity on farmers’ intergenerational succession willingness of apple management (FISWAM) and to examine the mediating effects of loss aversion in the impact of asset specificity on the FISWAM. The results showed that about 18.68% of the respondents expressed willingness to transfer their apple business between generations, and the FISWAM was generally weak. In addition to the negative impact of geographical location specificity (GLS), human capital specificity (HCS), physical assets specificity (PAS), and land assets specificity (LAS) can enhance the FISWAM. Loss aversion plays a partial mediating role in the impact of PAS, LAS, and GLS on the FISWAM.
