Perspective directions for improvement of legal and social protection of the personnel of the State Criminal and Executive Service of Ukraine taking into account positive foreign experience

The article substantiates perspective directions for improvement of legal and social protection of the personnel of the State Criminal and Executive Service of Ukraine taking into account positive foreign experience, namely:
 1) compliance with the requirements of international standards on the formation and competencies of penitentiary staff. Such standards include: the Universal Declaration of Human Rights (1948); Convention for the Protection of Human Rights and Fundamental Freedoms (1950); Basic Principles of the Use of Force and Firearms by Law Enforcement Officials (1990); Minimum Standard Rules for the Treatment of Prisoners (Mandela Rules) (2015); European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (1987); European Penitentiary Rules (2006 as amended in 2020);
 2) overcoming the phenomenon of discrimination (on any grounds) in the implementation of personnel policy in the penitentiary system;
 3) ensuring compliance between the conditions of service of penitentiary staff (taking into account the risks, responsibilities and stressful situations associated with the performance of official duties) and the level of wages, which should ensure a decent standard of living for employees and their families;
 4) increasing the safety of the staff of the State Criminal and Executive Service of Ukraine as a guarantee of their normal work, which ensures non-interference in the work of staff during the performance of their duties.
 It is noted that the safety of the staff of the State Criminal and Executive Service of Ukraine is a guarantee of their normal work and ensures non-interference in the work of staff in the performance of their duties. Negative events in the penitentiary system of Ukraine have highlighted that the problem of ensuring the safety of personnel of the State Criminal and Executive Service of Ukraine requires detailed study to develop effective ways to overcome existing problems, taking into account the experience of foreign countries and their ability to achieve positive results on this issue.

Measurement uncertainty for mechanical resistance of manufactured steel bar

Abstract This research work has been focused on estimation of the measurement uncertainty for different steel reinforcement bars. The investigated material was HRB400 steel reinforcement with approximately diameter 16 mm and length 500 mm by using uniaxial tensile testing device. International standard ISO 6892: 2016 and guide for measurement uncertainty have been implemented an accurate method to determine the measurement uncertainty of HRB400 steel reinforcement bar measurements. The results of expanded uncertainty for 569.47 N/mm−2 correspond to 0.76 N/mm−2, which fulfil the international standard requirements. This accurate method can be used in most of the accredited laboratories as inspection services of steel reinforcement bar by using uniaxial tensile testing device at good accuracy.

FLOTANT concept: floater design, integrated modelling & global performance

Abstract This paper presents the final design of the FLOTANT concept developed within the framework of a Cooperation Research Project funded by the European Union’s Horizon 2020 research and innovation programme. The FLOTANT concept is a hybrid concrete-plastic barge-type floating offshore substructure holding a 12MW wind turbine; buoyancy is achieved using plastic material (foam) fitted within the floater substructure. The paper describes the FLOTANT project innovations and presents the principal dimensions of the floating wind turbine system. The floating system has been developed to fulfil strict requirements at two different locations: Gran Canarias (GC) and West of Barra (WoB) sites. Therefore, two different mooring solutions including innovative elastomers to reduce peak loads are presented. The floating system’s intact and damaged static stability is checked along with the hydrostatic and hydrodynamic properties, showing the low-cost barge-type system’s feasibility. To ensure the desired behaviour of the floating system, a relevant subset of design load cases (DLCs) based on international standard requirements have been simulated checking the global performance of floater and moorings. Fully coupled hydro-servo-aero-elastic simulations have been performed to consider the wind and wave loading, the aerodynamic response of the rotor, the hydrodynamic response and structural dynamics of the turbine-floater-mooring assembly, and the control system actions. A summary of the results of the last design loop within the FLOTANT project is presented.

Strategic management of airports efficiency and safety in the process of air and multimodal logistics transportations development

The airport is a complex system that focuses on the intersection of the interests of different players in the transport market and different activities related to the performance of air transportation. The airport has an independent position in relation to partners and users of air transport. Therefore, the role of the airport, above all, is to unite the efforts of the air transport system and find a balance between their economic interests in order to maximize the efficient and safe use of air transport. In addition to effective cooperation with its partners, the airport must meet the requirements of international standards for aviation security, the appropriate state of infrastructure and efficiency of technological processes. States are also interested in developing, increasing the capacity of airports, expanding opportunities in the process of operation, as the airport contributes to the revival of ties between countries and the development of the global economy, tourism. Bringing the air transport infrastructure in line with international requirements is an important component of Ukraine's strategy aimed at ensuring the competitiveness of the national economy on the world market. Solving the problems of airport development is a nationwide problem that hinders the use of the high transit potential of the state. The complex and diverse challenges facing airports require rational, integrated and flexible solutions in business process management and active cooperation of air transport system participants, which is manifested in the coordination of strategic, tactical and operational decisions. The article is devoted to improving approaches to strategic management of airport efficiency and safety in the process of ensuring the implementation of international air and multimodal logistics services.

AUDIT FEATURES OF THE FIRST IFRS FINANCIAL STATEMENTS

Abstract. This article focuses on the financial audit of the first financial statements prepared in accordance with International Financial Reporting Standards (IFRS). Also, the article examines the requirements for the training, maintenance and design of workers in accordance with International Standards on Auditing (ISA) 230 «Audit documentation». The article identifies the main objectives, relevance and need for an audit of the first IFRS financial statements. The main sources of information for such an audit have been formed. The article analyzes the requirements for the first IFRS financial statements. Based on these requirements, the criteria are formed according to which the auditor will check the correctness of the transition of the company from national to international standards. Also, the main audit procedures that will be applied by the auditor in performing such an audit are identified. The research identified the importance of an audit of IFRS accounting policies. The criteria by which the auditor will verify the compliance of the applied accounting policy with the requirements of international standards are defined. The article identifies and analyzes the role of proper use of reasonable cost in the transition to international standards. There are requirements for such application, which will be important when auditing the correctness of the first IFRS financial statements. The article provides an overview of the transformation file of the transition to IFRS as one of the important sources of information for the audit. The procedure of transition from national to international standards with the help of a transformation file is analyzed. The importance of the auditor’s use of such a transformation file is determined. The research of the audit of the first financial statements in accordance with IFRS, allowed to form the requirements for audit documentation in accordance with the requirements of ISA. The main composition of the audit documentation that the auditor should have upon completion of the audit of the first IFRS financial statements is indicated. Improvement of the methodological materials for the preparation of non-financial reports in the field of compliance management

Introduction. Non-financial reports in the field of compliance management is able to prove to regulators, investors, and other concerned parties that a corporate compliance system is really operating and effective and that it corresponds to the nature and scale of the company’s activities. In the presence of highly diverse methodological approaches to the disclosure of non-financial information, the lack of specialised reporting standards in the field of compliance remains one of the most important issues. Purpose. Improvement of the methodological approach to the preparation of non-financial reports in the field of compliance management. Methods. The main conclusions made in this article are based on general scientific methods: analysis, synthesis, comparison, deduction, and induction. Conclusions. We proposed a methodological approach to the development of non-financial reporting in the field of compliance management is proposed, including the following: the principles determining the content and quality of reports; reporting forms depending on the range and structure of the disclosed information, the degree of its standardisation, and its purpose; basic composition of reporting elements and indicators categorised according to the functions of the compliance management process (prevention, detection, and response) and corresponding to the latest versions of the GRI Standards. Using the methodological approach, we analysed the quality of information disclosure in the field of compliance in public reports of Russian companies that take leading positions in specialised rankings and competitions. The obtained results show that Russian companies are annually trying to improve the quality of reporting processes in accordance with the requirements of international standards. However, reporting in the field of compliance management is still at an early stage of its development.

Polysystem Bioregulator Based on the Polyprenols for Active Health Management

A man developed new polysystemic bioregulator in the form of a bio-logically active additive (BAA) based on polyprenols isolated from Si-berian fir by the multistage extraction. Polyprenols and its precursor dolichol have key positions in metabolic processes underlying the nu-merous diseases pathogenesis. Hence, there is a necessity to replace the cellular polyprenols pool to ensure the functioning of the “cellular health laboratory”. In order to give the scientific justification of the qualitative and quantitative composition of the dietary supplement formulation the authors gave the biochemical characteristics of the initial raw materials. They assessed functional properties of a specialized product and gave the recommendations for its use. The researchers ob-tained clinical evidence of the BAS effectiveness while its additional in-clusion in the diet of patients with acute bronchitis and with long bone fractures. A man justified the BAS prescription ingredients composi-tion, mg/1 capsule not less than: polyprenols – 5; eleutherosides – 0.1; schizandrins – 0.1. The technology innovativeness lies in the presence of an active gelatinous shell containing fir and chaga extracts, which have a synergistic effect in relation to the metabolic disorder correction in the pathologies under consideration. The researchers tested the recipe and technology in a production environment certified according to the international standard requirements, which guarantees the quality char-acteristics stability and developed product competitiveness in the health-saving technologies market.

The concept of the auditor's professional skepticism and its genesis

The paper considers such a fundamental principle of audit as the auditor's professional skepticism. Guided by an integrated approach, the conceptual foundations of professional skepticism, patterns of its origin, its formation and development are determined depending on the understanding of the public function of audit and the auditor's duty to detect the fraud at the appropriate historical stage. It is noted that the concept of skepticism has a deep history and is considered in philosophy, psychology, law and other sciences. It is concluded that in the aspect of audit the methodological skepticism deserves attention, which is not limited to doubt, but is aimed at making sound hypotheses. Their construction and verification are subject to the general laws of gnoseology, which directly apply to the auditor's cognitive activity. Based on this approach, it is proposed to consider a hypothetical judgment in audit activity to identify and assess the risks of fraud from the standpoint of professional skepticism as making and verifying assumptions in the form of a version. Thus, the professional judgment of the auditor, which takes the form of professional skepticism, is necessarily based on the conclusions of the opposite or contradictory judgment. The paper also presents a critical assessment of the Law of Ukraine "On Auditing Financial Statements and Auditing" to determine the content of professional skepticism. The ways to improve national legislation and its conformation with the requirements of International Standards on Audit are proposed.

Harmless treatment technology of phosphogypsum: Directional stabilization of toxic and harmful substances

Phosphogypsum is one of the typical by-products of phosphorus chemical industry. As a strategic industry related to the national livelihood of China, phosphorus chemical industry has accumulated and produced a significant amount of phosphogypsum. In general, phosphogypsum contains approximately 80%–95% calcium sulfate dihydrate, and less than 5% toxic and harmful elements. In this paper, toxic and hazardous components in phosphogypsum were efficiently solidified and stabilized by highly targeted solidification and stabilization technology. Calcium carbide slag or lime was used as an alkali-base neutralizer of phosphogypsum, and polymeric ferric sulfate or polymeric aluminum chloride as a directional solidification stabilizer to analyze the leaching toxicity of the mixed powder in 1, 3, 5 and 15 days. The experimental results demonstrate excellent solidification and stabilization effect with the leaching pH of 6–9, the leaching concentration of P, F and heavy metals of less than 0.5 mg/L, 10 mg/L and 0.1 mg/L, respectively, which meets the requirements of relevant international standards. Mechanistic analysis indicates that the solidification and stabilization of toxic and hazardous substances in phosphogypsum is perfectly achieved owing to the generation, adsorption and encapsulation of insoluble substances. This technology can reduce the costs and difficulty in the phosphogypsum treatment, and has extensive application potentials.

Change Control Management: An Overview

Change control is a basic element of the quality management system of a pharmaceutical company, that focuses on controlling change to provide a quality product by preventing non - compliance. Changes may occur at any time during the product life cycle, leading to changes in the manufacturing process, the number of materials, and the manufacturing location. All of these changes are post-approved changes. These changes can be controlled and not eliminated, through proper assessment and action plans. The change control committee consisting of the head of quality assurance, manufacturing, sales and other members of relevant disciplines, inspect the proposed changes that may alter the validated and qualified state of facilities, equipment or process. The proposed change will likely have an impact on the quality of production or Good Manufacturing Practice as there are done to be in line with the International Standard Organization requirements. These approved changes should not impact the quality, safety and potency of medicinal product. If ignored, it makes the patient life - critical which may even lead to death. This present review provides an overview of the industry’s Change Control change management protocol in Quality Management System in a company. The major objective is to identify, evaluate, measure, provide action and final authorization to ensure that the changes should not affect the product strength, integrity, purity, quality, or safety. There are many aspects of view on the change control management that take place in the pharmaceutical industry, where we can gain knowledge on concepts of change control. This article also delivers a flow of change management process starting from the request on change by an initiator to the closure of change with appropriate remedial action and follow up assigned by Quality Unit and other responsible authorities.

Analysis and modeling the electronic document management system of ministries of Iraq

Implementation of the european union recommendations on strengthening the criminal liability for offences in the provision of payment services

The transition of an increasing number of social relations into the virtual space and the intensive development of information technology is accompanied by the emergence of new illegal phenomena, in particular, of a criminal law nature, which requires appropriate legal regulation. Recently, the number of infringements on public relations in the field of electronic payments has significantly increased, including by issuers of electronic wallets. This trend creates a threat to any state that encourages the international community to develop appropriate norms that should be implemented in national legislation to bring it closer to international standards. Currently, active work is underway to strengthen criminal liability in Ukraine for violations in the provision of payment services, considering the recommendations of the European Union. The purpose of the study is to analyse and develop conclusions on the advisability of implementing the recommendations of the European Union in the national criminal legislation regarding the tightening of sanctions for criminal offences committed in the field of providing payment services using non-cash means of payment. Methodological tools are selected in accordance with the goals set, the specifics of the object and the subject of the study. The study used the general dialectical method of scientific knowledge of real phenomena, their connection with prosecution for criminal offences, and general scientific and special methods of legal science. The scientific position is argued that the proposed changes to the Criminal Code of Ukraine by introducing liability for illegal actions with electronic money are formulated in such a way that it allows enforcing such a rule. According to the current legislation, it is determined that in the presence of a license to provide payment services, certain legal entities have the right to issue electronic money, in particular: banks, branches of foreign payment institutions, electronic money institutions, postal operators, the National Bank of Ukraine, state authorities and authorities local self-government. Considering that all the listed persons are legal, they are not the subject of a criminal offence, including for violations in the field of payment services. The inconsistency of national legislation with the requirements of international standards on the criminalisation of certain acts committed in the field of payment services necessitates further study and the development of recommendations for harmonising the current legislation.

Modelling of Luminous Flux Directed to the Upper Hemisphere from Electrical Substation before and after the Refurbishment of Lighting Systems

This article deals with options for how to express the luminous flux from outdoor electrical substations of the electric transmission system. Processing of the models of light emissions before and after refurbishment of lighting systems was motivated by setting out rules for the design and erection of refurbished lighting systems in outdoor electrical substations, which are most commonly built in inhabited rural areas with low luminance of the background. The proposed model and calculations are based on requirements of international standards and recommendations for lighting of outdoor workplaces as well as on internal regulations of the ČEPS (Czech Transmission System Operator). These requirements are implemented in real electrical substations and lighting models that are extended by the calculation space of the software goniophotometer. The software goniophotometer was used to evaluate light distribution characteristics of entire electric stations in various situations. This article assesses the impact of different lighting systems installed at electrical substations from the perspective of both direct and total luminous flux directed to the upper hemisphere. It takes into account three outdoor electrical substations (420 kV) of a transmission network and their lighting systems before and after refurbishment. The aim of this article is to determine to what extent the electrical substations contribute to emissions of luminous flux to the upper hemisphere. Results from calculations on models show reduced radiation to the upper hemisphere up to 52.3% after refurbishment of obsolete lighting systems, although total installed flux actually increased due to a change in the ratio of direct and reflected luminous flux after refurbishment of lighting systems.

Assessment of digital channels of communication with defined reliability characteristics

In the classical theory of telecommunications, an indicator of reliability is the probability of an information bit error. In modern international standards and recommendations, there is a hierarchy of quality indicators of the communication channel based on measurements, which is not related to the classical theory of noise immunity. The procedures for measuring the quality indicators of information transmission are possible only when using an already existing telecommunication system. The use of the classical theory of noise immunity makes it possible to provide for the correspondence of the energy parameters to the necessary quality indicators for the future communication system. The research aims to develop a unified methodology to assess the quality of communication channels and combine the classical theory of telecommunications with international recommendations and standards. To find the relationship between them, we analyzed existing methods of assessing the quality of communications channels, developed an algorithm for assessing the quality parameters and analyzed the characteristics of the channel. The methodology helps to assess the level of compliance of the quality parameters of information transmission through the channels of existing digital telecommunication systems with the requirements of international standards and recommendations. It is possible to research the behavior of quality indicators and optimize the operation of existing and design new digital communication channels according to the criteria of the quality of information transmission in accordance with the requirements of international standards and recommendations.

This article discusses the issues of improving the methods for compiling financial statements on cash flows based on international standards. In particular, a literature review on the problems of cash flow management was carried out, and the requirements of international standards were described. A three-year report on cash flows was analyzed, compiled on the example of a particular business entity, and proposals and recommendations were developed for its transformation into international accounting standards.

Институциональное развитие Северного морского пути в рамках модернизации экономики России

The Northern Sea Route, which is of fundamental importance for the national economy, is one of the most important components of the country’s point infrastructure system. Effective functioning and, in particular, the desire to increase the competitiveness of northern seaports, both in the Russian and global systems, requires a well-organized institutional structure aimed at improving the parameters of port infrastructure and infrastructure to ensure efficient transportation of goods. The article examines the theoretical and practical aspects of the development of the Northern Sea Route, the modernization of the Russian economy. For the study, methods within the framework of a systematic approach were used. The article summarizes the main aspects of the institutional support of the transport infrastructure of the Northern Sea Route, taking into account the integration orientation. The directions and principles of modernization transformations of the Northern Sea Route are proposed. It is determined that the basis of national legislation in the field of the Northern Sea Route modernization should be international conventions and standards. The laws in the field of maritime transport infrastructure and the Northern Sea Route are briefly reflected on, and it is also established that the current legislation in the field of maritime transport infrastructure fully meets public needs and international legal standards. It is noted that for the effective management of the maritime transport infrastructure, first of all, institutional support should be brought in line with the requirements of international standards, and its balance should be ensured at the mega-, macro-, meso-, and micro-levels. НАПРЯМИ ПІДВИЩЕННЯ КОНКУРЕНТОСПРОМОЖНОСТІ МОРСЬКОЇ ТРАНСПОРТНОЇ ІНФРАСТРУКТУРИ УКРАЇНИ

The article summarizes the main directions for increasing the competitiveness of the maritime transport infrastructure of Ukraine, taking into account European integration. To improve the competitiveness of maritime transport infrastructure in Ukraine, it is necessary to identify and justify strategic directions for the modernization and restructuring of maritime transport infrastructure, with the help of investment and tax support, improve state regulation through the introduction of promising achievements of scientific and technological progress, technological and organizational innovations, promote the constancy of foreign economic interests of subjects of the maritime industry of Ukraine on the world stage. It was noted that for the effective implementation of foreign economic activity in the field of maritime transport infrastructure, first of all, to bring the institutional and legal support in line with the requirements of international standards. The next step to improve the competitiveness of maritime transport infrastructure is the introduction of «port-landlord» management modules, the formation of centers for the development of maritime transport infrastructure (clusters), as well as the implementation of the «dry ports» logistics technology. Also, an integral part of increasing the competitiveness of maritime transport infrastructure is the improvement of information logistics and an increase in the overall level of informatization of port activities. These include trade facilitation, with the help of the European customs information system NCTS (The New Computerized Transit System), the implementation of “the Maritime Single Window” and “SafeSeaNet” systems. Another key area for increasing the competitiveness of the maritime transport infrastructure is to ensure the environmental safety of the functioning of the maritime transport infrastructure. The proposed directions will ensure the constant, efficient, competitive, and stable development of Ukraine’s maritime transport infrastructure. The presented strategic directions for increasing the competitiveness of the maritime transport infrastructure of Ukraine will make it possible to get closer to European standards and ensure the adoption of effective administrative and managerial decisions. The implementation of the proposed directions will ensure an increase in the competitiveness of the maritime transport infrastructure of Ukraine, aimed at consistent integration into the European and world maritime transport markets.

ТЕОРЕТИЧНЕ ПІДҐРУНТЯ МЕТОДИК ВСТАНОВЛЕННЯ НЕВИЗНАЧЕНОСТІ РЕЗУЛЬТАТІВ ЕКОНОМІЧНИХ ВИМІРЮВАНЬ, ЗДІЙСНЮВАНИХ МЕТОДАМИ НЕЗАЛЕЖНОЇ ЕКСПЕРТНОЇ ОЦІНКИ

The article behaves to the field of assets and property rights independent expert appraising/valuation. Theoretical bases, on those economic measurements expert valuation results uncertainty degree methodology is based, are examined. The substantiation of the probabilistic-metrological approach methodology principles to evaluation results uncertainty degree quantitative determination, based on the evaluation result interval form presentation, is considered. The requirements of national and international evaluation standards for the evaluation results uncertainty are analyzed. The methodology of evaluation results accuracy objective quantitative indexes is described and performed. It is well-proven that the level of valuation results errors at economic measurements implementation can be set on the basis of information theory and measurement errors theory laws application. It is shown that in the case of Comparative Sales and Income approaches applying, uncertainties for given levels of confidence probability in the form of numerical values of the confidence interval limits can be established on the basis of similar property adjusted single unit value indicators or rental rate rows statistical processing. The conditions that must be met when these economic measurements performing are formulated. The main principles of the economic measurements implementation using the metrological methodical approach are considered. It is grounded on independent valuation results uncertainty degree quantitative determination on the basis of economic measurements series implementation with next results row statistical processing. Base terms, limitations, original assumptions of that evaluation works accuracy conditions are set. Possible directions of evaluation methodologies further improvement are analyzed. Attention is accented on the informative-metrological approach to valuation results uncertainty degree exposure. It is shown that it gives an opportunity to set the valuation uncertainty degree by objective quantitative indexes, as these results errors estimates. Some recommendations in relation to priority directions of further researches are offered.

Daylighting Performance Design for Art Studios of Old Factory Renovation Buildings in Subtropical Regions

In the subtropical zone of China, a large number of old factory buildings rich in industrial historical and cultural value have been transformed into art studios. In the existing research on building renovation, there are still problems such as insufficient lighting, low uniformity, and ignoring the effect of glare in the lighting environment of buildings after transformation. To fill this research gap, this paper provides a daylighting design strategy for these factory buildings in subtropical zones to ensure that the transformed art studios can offer an excellent indoor daylighting environment. Through the control variable method, the window-to-wall ratio, the form of external windows, and the visible light transmittance of glass are set with quantitative and variable values, and a design strategy that meets the requirements of international general daylighting standards is obtained step by step through the simulation. The daylight factor, uniformity, daylight autonomy, and dynamic glare probability are used in this research process to measure whether the daylighting strategy meets the daylighting requirements of the CIBSE Lighting Guide for art studios. The results show that the average indoor lighting coefficient can be increased from 1.29 to 6.18, and the minimum value of the lighting coefficient can be increased from 0.4 to 4.4 by enlarging the windowed wall ratio from 1:30 to 1:3, using the combination method of the horizontal window, skylight and skylight recommended by the analysis results, and selecting veneer glass with 88% transmittance. This allows for better uniform lighting inside the building and reduces glare. This conclusion can support the lighting performance design of industrial buildings in the future.

Within the framework of this article, the analysis of methodological approaches and management practices for providing information technology support for standardized corporate management systems as a key element of their stability and antifragility in the uncertain business environment is carried out. The geopolitical, economic and social uncertainties of the present time significantly strengthen the role of integrated quality management systems that simultaneously meet the requirements of several international and national standards in managing the activities of enterprises in the real sector of the economy. In turn, the effectiveness and sustainability of such systems is determined by the level of their provision with appropriate information systems and technologies. The authors defined the criteria for a comparative analysis of methodological and practical approaches to the formation of ISM based on information systems and technologies. Particular attention is paid to the architectural approach to the design and development of standardized enterprise management systems, taking into account the level of maturity of its information technology support, as the basis of a resilience approach to business management in the conditions of turbulence of the internal and external environment of the enterprise.
