Study on the Two-way Mutual Promotion Model of Digital Economy Development and Intellectual Property Protection

China has good soil for the development of digital economy, but the development of digital economy cannot be escorted by intellectual property rights. At present, the development of digital economy is facing many challenges and risks, and the development of intellectual property protection in China is in a new transition period, however, there is still a lack of intellectual property protection in the digital economy. Based on the analysis of the development status of digital economy and intellectual property and the interrelationship between them, an operation model is built to promote the development of digital economy and intellectual property in both directions, with the government, enterprises, society and the public forming an "ecosystem" to participate in the operation of the model, and a guarantee mechanism is set up to ensure the sustainable development of the model.

R&D investment and regional innovation performance – threshold effects based on intellectual property protection

ABSTRACT Based on the panel data of 24 provinces and cities in China from 2009 to 2017, this paper uses panel threshold regression model with regional intellectual property protection intensity as the threshold variable to investigate the effect of R&D investment on regional innovation performance from two perspectives of human resource investment and R&D funding investment with different threshold effects. The results show that human resource investment and R&D investment have a significant contribution to regional innovation performance with a lag of three periods, and there is a significant double threshold effect. The optimal intellectual property protection intensity range of human resource input on regional innovation performance promotion is (0.8698, 0.8712). The optimal intellectual property protection intensity range for R&D investment on regional innovation performance is (0.8698, 0.8781), and R&D investment on regional innovation performance shows an increasing and then decreasing effect. This paper constructs a system of indicators to measure the intensity of intellectual property protection in China based on the “dual-track parallelism” of intellectual property protection management in China. It also measures the intensity of intellectual property protection in each region of China. A non-linear relationship between R&D investment, intellectual property protection and regional innovation is found.

Evolutionary Game Analysis of E-Commerce Intellectual Property Social Cogovernance with Collective Organizations

China’s E-commerce market is very active. Despite the impact of COVID-19, the market has ushered in major development opportunities. Alongside, the level of intellectual property protection in China is constantly improving. However, there are relatively few studies on intellectual property protection in the field of E-commerce. This study introduces the theory of social cogovernance and explores the construction of China’s E-commerce intellectual property protection system with the participation of collective organizations. Evolutionary game method is applied to model construction. Through numerical simulation, the study analyzes the evolution of E-commerce platform and collective organization strategic choice. The results depict that improving the open space provided by E-commerce platforms for collective organizations and strengthening their public service capabilities can promote the construction of social cogovernance systems. The establishment of reasonable reward and punishment mechanisms can increase cooperation enthusiasm. We also discuss the theoretical and practical implications for governments, E-commerce platforms, and collective organizations, to improve the level of intellectual property protection in E-commerce. This study can provide suggestions for China’s E-commerce intellectual property protection, improve the overall level of intellectual property protection in China, and provide a reference for global E-commerce intellectual property protection.

FDI and Intellectual Property Protection in China: A Game Theory Perspective

The large-scale spread of R&D activities by MNCs to investment host countries is a new phenomenon of globalization in the past ten years. For the host country, especially a developing host country such as China, how to promote the spillover effect of TNC research and development institutions on the host country and curb its crowding-out effect is a new topic. This paper analyzes the R&D strategy adopted by transnational corporations in China. We explain the relationship between the strength of intellectual property protection in China and the choice of the organization form of R&D activities by transnational corporations with game theory and proves the relationship between the two with data. Finally, policy implications are proposed for the trend of sole proprietorship of R&D activities of transnational corporations.

New knowledge and regional entrepreneurship: the role of intellectual property protection in China

ABSTRACT This research examines the relationship between intellectual property protection (IPP), new knowledge and regional entrepreneurship development in transition China. Using provincial-level panel data collected over China from 2000 to 2017, consistent with conventional wisdom, we find that more investment in new knowledge is the key to encouraging regional entrepreneurship. IPP and entrepreneurship present a U-shaped relationship, that is, IPP first promotes entrepreneurship but impedes entrepreneurship when it exceeds a certain point. IPP negatively moderates the positive effect of new knowledge on entrepreneurship and there are heterogeneous effects in different industries and geographical clusters at different levels of entrepreneurship. New knowledge has a significant incentive effect on necessity-driven entrepreneurship, but not on opportunity-driven entrepreneurship. The moderating effects of IPP on the relationship between new knowledge and necessity-driven entrepreneurship and opportunity-driven entrepreneurship are negative and positive, respectively. These findings contribute to understanding the impact of IPP on entrepreneurial activities in emerging economies.

Innovation Cooperation Network Evolution About Green Building Technology With Government Intervention: Based on Evolutionary Game Theory

Green building technologies (GBTs) are becoming increasingly complex and are being rapidly updated. These factors lead to an inherent demand for GBT innovation cooperation. This article considers the common policy instruments of the Chinese government and builds a GBT innovation cooperation network by joint patent applications. Then, evolutionary game models are constructed based on the GBT innovation cooperation network. Numerical simulation is employed to analyze the impact of different policy intervention intensities on the decision-making behavior of enterprises and network structures. The results show that government intervention is reasonable and legitimate for GBT innovation cooperation. Subsidies, preferential tax policy, and intellectual property protection are the main policy instruments of the Chinese government. When subsidies and preferential tax policy exceed certain thresholds, network efficiency and network cooperation density can be improved. In addition, the simulation results show that green building intellectual property protection in China has difficulty stimulating the enthusiasm of GBT innovation enterprises. GBT innovation cooperation network efficiency and network cooperation density evolution trends are basically the same. This study also provides insights into government policy formulation and adds to the increasing literature on the topic of GBT innovation cooperation. It is one of the few studies to explore the impact of government policy instruments on GBT innovation cooperation.

Intellectual Property Tools in Safeguarding Intangible Cultural Heritage: A Chinese Perspective

Intangible cultural heritage (ICH) is an invaluable treasure for human being and China is a country endowed with rich ICH. Among all the measures of safeguarding ICH, intellectual property (IP) tools are effective while controversial. As China started relatively late in the legal protection of ICH, the gap between legislation and judiciary needs to be filled in. This study examines the IP protection of ICH in China based on the current laws and regulations and then provides a semiotic approach to the relevant legal evolution in China. This study, taking in some experiences outside China, goes further to provide recommendations for improving the IP protection in China.

PSY31 - Europe-China Comparison of Orphan Drugs Approvals

Rare diseases, today, constitute a public health issue. Specific legislations to incentivize the development of orphan drugs were adopted in Europe in 1999, whereas no specific legislation was established in China until now. Therefore, our study aimed to assess the availability of orphan drugs in China compared to Europe and to discuss potential challenges facing orphan drugs in China. The official websites of European Medicine Agency (EMA) and China Food and Drug administration (CFDA) were searched to identify approved orphan drugs up until 01/03/2018 in Europe and China, respectively. The delays in approval were calculated and delay rationales were discussed. A total of 102 orphan drugs were approved in Europe. Among these 102 orphan drugs, 15 (14.7%) were approved in China. Only the drug Dacogen® was approved earlier in China than in Europe, with a time interval of 3.98 years. The median delay was 3.29 years. The shortest and longest time lags were 55 days and 14 years, for the drugs Nexavar® and Zavesca®, respectively. Delays in approval may be due to several reasons: 1) the lack of a clear definition of rare disease in China, 2) the requirement of completing a phase 1 study outside China before implementing clinical trial in China, 3) manufacturers’ decision because of complex procedures, concerns regarding the profitability and uptake in the market 4) other reasons include staff shortage in drug evaluation center and inadequate intellectual-property protection in China. Special approval procedure for priority review of orphan drugs has been established as of 2017 in China. In addition, orphan drugs may also achieve faster reimbursement by national drug price negotiation. Improvement is expected for orphan drugs access. However, more efforts and a specific legislation for orphan drugs are still needed in China to ensure rapid patient access to orphan drugs.

Digital intellectual property protection in China: trends and damages in litigation involving the big five websites (2003–2013)

ABSTRACTAfter decades of breakneck economic growth and as its media environment continues to evolve, China’s notoriously cavalier approach to intellectual property rights (IPR) is also changing. In fact, it has recently become the most litigious country in the world when it comes to IPR protection in the digital domain. There is a wide range of interpretations on this topic given China’s political, economic and social complexities, but empirical evidence is lacking. This study aims to fill that gap by investigating 351 cases involving the country’s five biggest websites from 2003 to 2013. It analyses win rates and damages awarded based on the court records, as well as the factors that influenced the judgements. The data showed that, in that decade, the win rate was 24 per cent for websites being sued – but the rate jumped to 90 per cent for websites suing others. Plaintiffs were awarded a median 5,502 yuan in damages – representing a median 10 per cent of their claims. The average win rate fluctuated in the period, while the amount of median damages awarded decreased over time. More interesting, the data revealed the significant impacts of the situation of the litigants (the party capacity effect), the type of content in dispute (the medium effect) and the jurisdiction on the outcome of cases. This research adds an empirical footnote on the growing field of copyright on the Internet and sheds light on the general direction of digital IPR protection in China.

Quantitative Evaluation for the Level of Intellectual Property Protection in China

Making a review for the quantitative evaluation research of Intellectual Property Protection Level’s in China, we get the research status, research perspective and the research method of the study from the review. After analyzing the existed problem and deficiency of those studies, we set forth the prerequisite of Intellectual Property Protection Level’s study, and some new study thoughts, which are based on performance theory and value chain theory. We suggest a new study method should be used in the quantitative evaluation study of intellectual property protection level, which is a comprehensive evaluation method based on experts information. In the end, the principle of constructing parameter system will be elaborated, which will be used in quantitative evaluation study of intellectual property protection.

Supply chain management practices and intellectual property protection in China

Purpose– The purpose of this paper is to investigate the strategy used by German Mittelstand companies to achieve a profitable business in China. It explores how those firms seek to reduce their risk of entry into this market.Design/methodology/approach– Survey data were gathered over the phone from individuals in the companies who were identified as knowledgeable contacts. Their responses were then analyzed using descriptive statistics and structural equation modeling.Findings– German Mittelstand firms that hire Chinese nationals in China obtain market knowledge and a higher return on investment than others. German managers’ efforts to understand the Chinese cultural norms increased the firm’s unwillingness to share information with others. This was probably because their concern about protecting their competitive secrets increased, so they shared less information with suppliers, which decreased their return on investment.Research limitations/implications– First, the small sample size limited the analysis. Second, there was low inter-rater reliability on multiple items, so these responses could not be analyzed. There is a need to further validate the survey, and obtain a larger sample to analyze alternative models.Practical implications– This suggests to the practitioner that while it may be relatively easy to start a manufacturing business in China, it requires great effort to manage their risk of losing corporate secrets to their competitors in China.Originality/value– This paper provides a unique set of data from practicing managers about the risks and gains from doing business in China. This data can be of use to both researchers and to practitioners and it provides a foundation to examine how the risk of losing proprietary knowledge to Chinese competitors affects business.

Framework of High-Technology Industry Innovation of China: Intellectual Property Protection and Industrial Knowledge Base

Based on panel data from 2000 to 2012, quantitative analysis was conducted on the relationship between intellectual property protection and China’s high-technology industry innovation. Results indicate that the intensity of intellectual property protection in China increases year by year and has a positive effect on the industrial knowledge base of the high-tech industry in China. The industrial knowledge base of each sub-industry in the high-tech industry of China has positive effects on owning inventive patents (OIP) and sales revenue of new products (SRNP). However, but stringent intellectual property protection has a certain inhibitory effect on OIP and SRNP for the manufacture of medicines, manufacture of medical equipment and measuring instruments, and manufacture of electronic and communication equipment. Moreover, stringent intellectual property protection has negative effects on OIP of all five sub-industries of the high-tech industry in China.

Weak Enforcement of Intellectual Property Rights in China: integrating political, cultural and structural explanations

The discrepancy between de jure and de facto protection of intellectual property rights in China remains a heatedly debated topic. Unfortunately, political motivations have distorted the debate from its very beginning, which has not only resulted in a tendency for the different explanations to be played off against each other, but has also reinforced their specific flaws and biases. This study addresses these problems by advancing and integrating the three main explanatory frameworks for explaining the situation. The resulting integrated framework finds that structural factors such as bureaucratic fragmentation and political decentralization matter most in practical terms, but their durability cannot be understood without putting them into context. The findings also suggest that, contrary to most predictions, the future development of intellectual property protection in China might not follow the path laid down by other countries that have modernized in the past.

Three decades of bilateral copyright negotiations: Mainland China and the United States

Abstract The study analyzes the dynamics of intellectual property (IP) negotiations between mainland China and the United States from the late 1970s to 2007. As China has industrialized, it has faced significant pressure from its international trading partners led by the United States to improve protection for intellectual property rights (IPR). Analysis of the progress of IP protection in China provides an opportunity to test and modify a model of IP policy development in developing countries, and the impact of U.S. actions on internal IP politics and cultural development.
