The concept of human right is not new one as these are moral claims which every one of us is entitled to have. Besides, these rights have universal acceptance and accessible to all men, women and children without any discrimination based on caste, color, sex and religion. Its basic object is to uphold human dignity, equality and foster liberty and fraternity. This paper also highlights the various theories of human rights which play role on the promotion of the welfare of the society. Human rights are fundamental to the stability and development of countries all around the world. The concept of the right to life under article 21 of the constitution of India, which is basic right covered by the U.N Declaration, had been the subject of interpretation by the Supreme Court in various decisions. Now human rights need to more protect in regard of the women. Women face double discrimination being members of specific caste, class or ethnic group apart from experiencing gender-ed vulnerabilities. Women have low status as compared to men in the Indian society. They have little control over the resources and important decisions related to their lives. In India, early marriage and childbearing affects the health of the women adversely. Also, maternal mortality rate is very high. During infancy and growing years a girl child faces different forms of violence like infanticide, neglect of nutrition needs, education and healthcare. As adults they face violence due to unwanted pregnancies, domestic violence, sexual abuse at the workplace and sexual violence including marital rape and honor killings. The experience of violence and its impact on health varies according to the women’s caste, class and ethnic identity. Women have always been exploited by the patriarchal society. Even after more than 50 years of our independence, Indian woman wear a pathetic look. They face an atmosphere of debilitating violence. This Paper analyzes these critical issues surrounding human rights.The Research Methodology adopted for the purpose of this study is doctrinal, keeping in mind the conceptual, theoretical and evaluative aspects of the topic. The study on the topic has been extensive, ranging from researching books, case laws, articles and commentaries on the human rights and women, and recent regulations of criminal law, and suggesting a model policy for such regulations — from the RGNUL library as well as using the web-resources accessed through RGNUL Internet Center.
