MODELING INFORMATION SECURITY THREATS AND DETERMINATION OF THEIR RELEVANCE FOR INFORMATION SYSTEMS OF INFORMATIZATION OBJECTS OF FEDERAL EXECUTIVE AUTHORITIES

Task. The purpose of writing this article is to improve the security of information in information systems. Model. The article explores methods for modeling information security threats and determining their relevance for information systems of informatization objects of federal executive authorities. Conclusions. The study is based on an assessment method that uses a cluster of outcomes, and the concept of “significance coefficient” is also introduced, as the product of the corresponding values of the priority vectors of outcome clusters. Value. The materials presented in the article will help improve methods for analyzing and evaluating the assets of an informatization object, vulnerabilities, information security threats, possible attacks and security goals.

Актуальные проблемы законодательного регулирования миграционных процессов на территории государств – участников СНГ. Об итогах проведённой 15 октября 2021 года Международной научно-практической конференции

On October 15, 2021, at the St. Petersburg University of the Ministry of Internal Affairs of Russia, as part of the activities of the scientific school «Administrative and administrative-procedural activities of the Ministry of Internal Affairs of Russia», the annual international scientific and practical conference «Actual problems of legislative regulation of migration processes on the territory of the CIS member states» was held , where they exchanged views on problematic issues of legislative regulation of migration processes, administrative and jurisdictional activities of the internal affairs bodies of the Russian Federation in the field of migration, on theoretical and applied problems of improving legislation on administrative offenses in the migration sphere, on ensuring security and public order, improving police and other law enforcement activities, as well as the results of the conference were summed up. The conference became the next stage in the consideration and discussion of the scientific and theoretical foundations of the legal regulation of migration processes on the territory of the Russian Federation and made it possible to compare the scientific doctrine with the practical activities of the federal executive authorities of the region, non-profit, public organizations in matters of law enforcement in the field of migration and migration policy. During the discussion of the issue on the agenda, the conference participants exchanged views and experience on improving legislative regulation, finding effective forms and methods for regulating migration processes on the territory of the CIS member states, experience in law enforcement activities on migration issues and strengthening scientific and practical ties between employees of territorial bodies Internal Affairs of the Russian Federation, educational, scientific organizations of the Ministry of Internal Affairs of Russia, regional non-profit and public organizations. The conference was attended by representatives of Turkmenistan, the Republic of Uzbekistan, the Republic of Ghana, the Democratic Republic of Sao Tome and Principe.

Problems of Legal Regulation of Rural Tourism in the Context of Sustainable Rural Development

Rural tourism today is one of the new and actively developing types of tourism in Russia. Due to political and epidemiological factors, the approach to choosing a place of rest has changed and many modern tourists prefer to travel around Russia, getting acquainted with the geographical, agro-industrial, gastronomic, ethno-cultural characteristics of rural areas. The article analyzes the state of legal regulation of rural tourism at the present stage. Program documents, federal laws, by-laws containing norms regulating the provision of services in rural tourism are considered. The main provisions of the program for providing state support in the field of rural tourism – the "Agrotourism" grant - are revealed and the problems associated with the inability of some agricultural producers to become grant applicants due to non-compliance with the rules for registration of individual entrepreneurs engaged in agriculture are raised. Also, the article analyzes the requirements for accommodation facilities in agriculture and tourism adopted in November 2022, points out the shortcomings of the federal executive authority when adopting an order approving such requirements related to ignoring the specifics of providing services in rural areas, the performers of which are non-professional participants in the tourism industry. In conclusion, it describes the currently most effective way to promote services in rural tourism using online aggregators. The conclusion is made about the importance of support by state authorities and local self-government of agricultural producers wishing to develop rural tourism in parallel with the implementation of agricultural activities.

In the presented article, the authors prove the need to consolidate the form of the protocol on an administrative offense by the order of the head of the federal executive authority. The emphasis is placed on the fact that the protocol on an administrative offense, in case of its incorrect compilation, violates the rights of citizens associated with emotional suffering caused by the infringement of such intangible benefits as personal dignity and reputational losses, as well as the right of these persons to judicial protection. It is substantiated that in the presence of significant shortcomings of the protocol on an administrative offense, a citizen or a legal entity has the right to apply to the court for recognition of the protocol as illegal.

The paper considers the key elements of modern interaction between two dominant institutional structures of modern Russia – the federal executive authority in the field of customs affairs, ensuring the performance of fiscal and law enforcement functions in ensuring the economic security of the state and the Russian Orthodox Church - the spiritual and moral center for ensuring the integrity of the Russian state throughout its more than 1000-year history.

Organizational and legal problems of functioning of public councils under the Ministry of Internal Affairs of Russia and its territorial bodies in matters of road safety

The subject of the study is the organizational and legal problems of the functioning of public councils under the Ministry of Internal Affairs of Russia and its territorial bodies in matters of road safety. The object of the study is public relations related to the functioning of public councils under the Ministry of Internal Affairs of Russia and its territorial bodies. As a result of the analysis of normative legal acts, scientific literature, the author comes to the conclusion that despite the existence of public councils for more than ten years, the analysis of the practice of their functioning allows us to assert that there are separate problems, both legal and organizational, that do not allow them to fully fulfill their intended purpose expressed in the coordination of the coordination of socially significant interests, solutions to the most important issues of the activities of internal affairs bodies, including in the field of road safety. The methodological basis of the research was a complex of general scientific and private scientific methods of cognition (formal legal, analytical, system analysis, synthesis, modeling, comparison, etc.), special scientific (technical and legal analysis, etc.). The scientific novelty of the research is expressed in the author's vision of the solution of the identified problems of the functioning of public councils. The author's general conclusion is the statement that the high social significance of the road traffic sphere for society determines the need to improve the mechanisms of citizens' participation in the management of public relations related to ensuring the safety in question, one of which is the public councils under the federal executive authority in the field of internal affairs and its territorial bodies. For the effective functioning of the institution under consideration, it is necessary to improve the organizational and legal foundations that help transform it into a real tool for expressing the position of civil society, allowing for managerial influence on the sphere of traffic.

The system of administrative and legal means of ensuring legality in the implementation of licensing activities of federal executive authorities

The object of the study is the social relations arising in the process of carrying out the licensing activities of federal executive authorities. The subject of the study will be the current legislation regulating permissive activities, as well as individual "permissive regimes" established and supported by authorized federal executive authorities, other regulatory legal acts of the Russian Federation, scientific and other analytical studies (monographs) on the implementation of permissive activities, publications in scientific publications on permissive activities. This article presents an overview of administrative and legal means of ensuring legality in the implementation of licensing activities of federal executive authorities. The scientific novelty of the dissertation research will consist in the formation of new theoretical and legal approaches to the implementation of licensing activities of federal executive authorities and the preparation of practical ways to solve the problems facing the functioning of the licensing system in the Russian Federation. In addition, proposals will be formulated to improve the efficiency of the implementation of licensing activities, proposals will be developed to ensure the legality of the licensing system. The article provides an overview of the mechanisms for ensuring the rule of law in the implementation of the relevant powers of the above-mentioned FOIV, their essential industry features are given, as well as key shortcomings in their current work are indicated.

Protecting the labor rights and interests of citizens is one of the important tasks of the Russian prosecutor’s office. The subject of prosecutorial supervision over compliance with labor legislation and labor protection is implemented in three main areas, in particular, compliance with and implementation of the Constitution of the Russian Federation, federal laws and laws of the constituent entities of the Russian Federation in the field of labor, by-laws adopted by federal executive authorities and executive authorities subjects of the Russian Federation, acts of local self-government bodies, acts of regulatory bodies and their officials, as well as local regulatory legal acts adopted in commercial and non-commercial organizations, from employers - individuals who are individual entrepreneurs. Wherein the prosecutor is obliged to monitor the observance of labor rights and interests of employees by employers, established not only by regulatory legal acts adopted by state and municipal bodies, but also by acts of social partnership. The main areas of interaction between the federal labor inspectorate and the prosecutor’s office of the Russian Federation are, in particular, the fact that employees of the prosecutor’s office and state labor inspectors regularly share important information about the established violations of labor legislation, including about representatives of the employer brought to legal responsibility under Art. ... Art. 5.27 and 5.27.1 of the Code of Administrative Offenses of the Russian Federation and the fact that prosecutors are usually employed as specialists of state labor inspectors in order to closely monitor compliance with labor legislation. Prosecutors must protect not only the right of workers to timely and full payment of wages, but also other labor rights and interests of citizens.

It gives a brief history of the reorganization of the national cartographic and Geodetic service from the Main Department of Cartog-raphy under the Council of Ministers of the Russian Soviet Federative Socialist Republic (RSFSR) in 1991 to the Public Legal Company "Roskadastr" in 2022. The articles analyses the consequences of the planned reorganization in 2022 by joining JSC "Roskartografiya" and the Federal State Budgetary Institution "Center for Geodesy, Cartography and Spatial Data Infrastructure" to the Public the legal company "Roskadastr".

ПОТЕНЦИАЛЬНАЯ РАБОЧАЯ СИЛА СОВРЕМЕННОЙ РОССИИ: СОЦИАЛЬНО-ДЕМОГРАФИЧЕСКИЙ ПОРТРЕТ И УРОВЕНЬ ОБРАЗОВАНИЯ

The study aims to determine the scale and socio-demographic characteristics of the potential labor force in the Russian labor market. The object of the study is the unemployed persons who want to get a paid job, but due to circumstances are limited in their search or desire to start it. The paper is based on new approaches to the study of economic inactivity of the population, enshrined in the “Resolution on Statistics of labor activity, Employment and Labor Underutilization” (ILO, 2013). For the analysis of statistical data, the author applies the methods of logical analysis and mathematical statistics. The results of the study showed that the size of the potential labor force in Russia is comparable to the scale of general unemployment. In the course of the research, the main sociodemographic characteristics of this population group were identified, indicating a high level of its human potential and, accordingly, the feasibility of developing measures to involve this category of the population in economic activity, since its representatives are balanced across all working ages, have a relatively high level of professional education (more than half graduated from an academic institution), low gender and inter-settlement asymmetry. The empirical basis of the study was the data of the Sample Labor Force Survey (LFS) conducted by Rosstat in 2010-2021. The author concludes that Federal executive authorities can use the research materials in developing state employment policy and academic institutions to prepare students and postgraduates in the “Labor Economics” specialty.

The article studies issues of digitalization of archiving and statutory regulation of procedures for using artificial intelligence technologies in this field of activity. The authors have attempted a systematic approach to the problem of using AI in the work of archives, taking into account the processes taking place within the framework of digitalization of the economy of the Russian Federation. The study is to analyze the experience of using artificial intelligence technologies in archiving and statutory and methodological regulation of this sphere. The authors identify trends in the use of artificial intelligence technologies, as reflected in the preparation of draft standards (Artificial Intelligence. Artificial intelligence technologies used in activities of federal executive authorities. Classification and general requirements). The article touches upon development of competence-based approach in training of personnel, including archivists, in line with current trends of digitalization of all documented spheres of state activity. The article assesses compliance of local regulations with requirements of current professional standards. It addresses organization of storage, acquisition, and accounting of use of archival documents in correlation with digitalization of documented spheres of organizations’ activities; organization of document storage in operational records management; formation of fonds for use of electronic copies of documents; formation of electronic archives of organizations; transfer of electronic archival documents to state permanent storage; organization of work with electronic documents in state archives; planning and construction of archival storage processes; accounting and use of documents of temporary and permanent storage; regulation and control of federal and regional state information systems, registers, and databases; creation of a unified system of archival storage of documents; introduction of an electronic archive system (acquisition, accounting, examination of value, use of archival documents). The authors have identified three tasks that need to be solved within the framework of creating archives of tomorrow, based on widespread use of AI and on determination of main standards to use in the work of archives, the solution of which requires training of personnel capable of mastering and using AI technologies in archivist’s practical work.

Spatial-compositional assessment and prediction of the corporate state of organizations in the copper sub-industry in the conditions of the new economic reality

The new “post-February” economic reality will significantly affect the production and marketing policy of domestic enterprises in the copper sub-sector. In this regard, in order to formulate managerial decisions at the corporate, regional and federal levels, an objective presentation of value judgments about the forecast state of enterprises in the copper sub-industry in the short and medium term is necessary. The aim of the study is to assess and generate predictive data on the corporate state of organizations in the copper sub-industry based on the development of the theory and methodology of spatial-compositional assessment and medium-term forecasting, taking into account the results of current scientific research on the issues under consideration. The subject of the study is a set of theoretical data and methodological approaches to the essence of conducting a spatial-compositional assessment and predicting the corporate state of organizations in the copper sub-industry. The object of the study is the organizations of the copper sub-industry, taking into account the peculiarities of their financial and economic activities, as well as economic relations of this type of organizations in the sectoral, inter-sectoral and national economy in the new economic reality. The theoretical and methodological basis of the study is the author’s methodology of spatial-compositional assessment and forecasting of the corporate state of organizations in the copper sub-industry, which makes it possible to form integrated value judgments in a visual graphical representation. The most significant scientific results obtained by the author in the course of the study, which have scientific novelty, lie in the practical implementation of the theory and methodology of spatial compositional assessment and forecasting of the corporate state of organizations in the copper sub-sector in the new economic reality. The results of the study can be used both at the corporate level to formulate targeted tactical and strategic decisions, and at the level of regional and federal executive authorities for the purpose of forming a policy to minimize the negative impact on the functioning and development of the non-ferrous metallurgy industry of the Russian Federation.

Personalized accounting in the pension system of the Russian Federation

The article deals with the issues of pension provision of citizens, namely, the features of reporting in the mandatory pension insurance system. The authors studied the norms of the adopted Federal Law № 136-FZ as of 24.04.2020 On Amendments Being Made to Articles 2 and 11 of the Federal Law On Individual (Personalized) Accounting in the Mandatory Pension Insurance System, Federal Law № 436-FZ as of 16.12.2019 On Amendments to the Federal Law On Individual (Personalized) Accounting in the mandatory pension insurance system and analyzed the newly introduced employers obligation to provide information on personnel changes (on the admission and dismissal of a citizen) no later than a working day, following the day of the issuance of the relevant order or other document. Much attention is paid to the mechanism of implementation of the provisions on the obligation of timely reporting to the bodies of the Pension Fund of the Russian Federation, as well as responsibility (administrative) for non-fulfillment of this obligation. At the end of the study, a conclusion was made about the imperfection of the existing model of receiving reports by one body (the Pension Fund of the Russian Federation), and the control over the provision of such reports by another body (the Federal Executive authority exercising federal state supervision over compliance with labor legislation).

Theoretical, Legal and Organizational Foundations of Volunteer Activities in the Field of Social Adaptation of Individuals Sentenced to Non-Custodial Punishment in Russia

Introduction: the article investigates theoretical, legal and organizational foundations for participation of volunteers in the social adaptation of individuals convicted to non-custodial punishments. Aim: we review theoretical, legal and organizational foundations of the work of volunteers in the field of execution of sentences in Russia and foreign countries and show the prospects for their participation in the social adaptation of individuals convicted without isolation from society in our country. Methods: comparative legal, empirical methods of description, interpretation, theoretical methods of formal and dialectical logic, private scientific methods: legal-dogmatic and method of interpretation of legal norms. Results: in the life of those convicted to non-custodial punishments, volunteerism performs mobilization, regulatory, stimulating, communicative functions, as well as the functions of socialization and self-affirmation. Conclusions: we propose to supplement the list of activities in respect of which the federal executive authorities, executive authorities of constituent entities of the Russian Federation, and local government bodies approve the procedure for interaction between state and municipal institutions and volunteers, with one more type of activity such as assistance in the work of institutions and bodies executing sentences, participation in the reformation of convicts and their social adaptation. We substantiate the proposals on assigning the state authorities of the Russian Federation, constituent entities of the Russian Federation, and local government bodies the obligation to provide organizational, informational, methodological and other support to the subjects of voluntary (volunteer) activities that promote the work of institutions and bodies executing sentences, to take into account the voluntary (volunteer) activity of the convicted person when determining the degree of their reformation, recognition of the active participation of the person convicted to non-custodial punishment in voluntary (volunteer) activities as the basis for applying incentive measures to such convicts.
