Protection of the underwater cultural heritage. Draft principles and guidelines for implementation of article 303 of the United Nations Convention on the law of the sea, 1982

This article falls into three parts. In the first part, an explanation is given of the assumptions made by the writer in preparing it as a discussion paper for presentation at the National Maritime Museum Conference in January 1996. 1 The second part is concerned with the form of principles and guidelines and reviews a range of models which are available and the fora in which they may be processed. The final part contains a draft of the principles and guidelines, together with a brief commentary.

Society for American Archaeology Principles of Archaeological Ethics

At its April 10, 1996, meeting the Society for American Archaeology Executive Board adopted the Principles of Archaeological Ethics, reproduced below, as proposed by the SAA Ethics in Archaeology Committee. The adoption of these principles represents the culmination of an effort begun in 1991 with the formation of the ad hoc Ethics in Archaeology Committee. The committee was charged with considering the need for revising the society's existing statements on ethics. A 1993 workshop on ethics, held in Reno, resulted in draft principles that were presented at a public forum at the 1994 annual meeting in Anaheim, California. SAA published the draft principles with position papers from the forum and historical commentaries in a special report distributed to all members, Ethics in American Archaeology: Challenges for the 1990s, edited by Mark J. Lynott and Alison Wylie (1995). Member comments were solicited in this special report, through a notice in SAA Bulletin, and at two sessions held at the SAA booth during the 1995 annual meeting in Minneapolis, Minnesota. The final principles presented here are revised from the original draft based on comments from members and the Executive Board.

Unification of Law by Non-Legislative Means: The UNIDROIT Draft Principles for International Commercial Contracts

Efforts toward the unification of law usually have taken the form of binding instruments, be it supranational legislation, conventions or model laws. Only recently, in view of the fact that these instruments often remain little more than a dead letter' and that often they are rather fragmentary in character2 with the consequence that they in any event need to be supplemented by domestic laws, an increasing number of voices are raised in favor of recourse to non-legislative means of unification or harmonization of law. Some of these advocates suggest development of what they call international commercial custom, that is model clauses and contracts formulated by the interested business circles on the basis of current trade practices and relating to specific types of transactions or particular aspects thereof.3 Others, also in view of the fact that such instruments are often drafted in a one-sided manner and that they presuppose a more gen-

Special Commission 2 held 11 of its scheduled 13 meetings, most of this time being devoted to its consideration of the structure and organization of the Enterprise and to the drafting of a Training Programme under paragraph 12(a)(ii) of resolution II, in accordance with the programme of work for the seventh session set forth in paragraph 29 of LOS/PCN/L.65. The Ad Hoc Working Group on Training, established by Special Commission 2 in 1987 to prepare draft principles, policies, guidelines and procedures for the Training Programme, completed its work at this session. Proposal by the German Democratic Republic on use of the geostationary orbit

In 1986, the German Democratic Republic submitted the working paper entitled “Draft principles governing the activities of States in the utilization of the geostationary orbit.” The underlying motive for the G.D.R.—which supports the mandate given by the UN General Assembly to the Committee on the Peaceful Uses of Outer Space/Legal Sub-Committee, namely “to consider matters relating to the character and utilization of the geostationary orbit, including consideration of ways and means to ensure the rational and equitable use of the geostationary orbit without prejudice to the role of the International Telecommunication Union”—was that a generally accepted solution to the complex political, legal and technical questions relating to the use of the geostationary orbit both within the ITU and in the framework of the Legal Sub-Committee would be in the interest of all States. In that quest, both the ITU and the COPUOS/LSC should play a major part. Here, the Legal Sub-Committee could substantiate and develop the international legal framework for the use of the geostationary orbit in conformity with existing space law and the relevant ITU decisions.

Indigenous Peoples: An Emerging Object of International Law

The Working Group on Indigenous Populations, an organ of the United Nations Sub-Commission on Prevention of Discrimination and Protection of Minorities, ended its fourth annual session last August by distributing seven “draft principles” to governments and nongovernmental organizations (NGOs) for comment as the first step in preparing “a draft declaration on indigenous rights, which may be proclaimed by the General Assembly.” For the first time since indigenous organizations took their concerns to the international level in 1977, a formal commitment has been made to the development of new law, probably in time for the “cinquecentennial” in 1992 of the “discovery” of the Americas and a proposed international indigenous year.

A Declaration Adopted by the Uppsala Collogium, Sweden, June 21, 1972. In June 1972, in Uppsala, Sweden, legal and human rights experts from 25 countries joined in a colloquium to examine the meaning and implications of Article 13 (2) of the Universal Declaration of Human Rights, which states: “Everyone has the right to leave any country, including his own, and to return to his country.” Brought together under the auspices of the Law Faculty of Uppsala University, the Renέ Cassin International Institute for Human Rights, in France, and the Jacob Blaustein Institute for the Advancement of Human Rights, in New York, the participants reviewed current policies and practices around the world related to the right to leave and to return. Taking as their springboard a group of draft principles approved in 1963 by the UN Sub-Commission on Prevention of Discrimination and Protection of Minorities, they adopted a Declaration on the subject.
