Interactions between the international convention and the system of guaranteeing the rights of persons with disabilities in Ukraine

The purpose of the study is to clarify the essence and outline the functions of the international convention-institutional mechanism for the observance and protection of human rights, as well as to reveal the directions of its interaction with the national system of administrative and legal protection of the rights and freedoms of persons with disabilities of Ukraine. We use methods of scientific knowledge, in particular system-functional, formal-legal, technical-legal, methods of analysis and synthesis. The National system of ensuring the rights and freedoms of persons with disabilities of Ukraine, which is presented in the form of a three-level structure, among which: organizational level - is implemented by the Commissioner of the President of Ukraine for the Rights of Persons with Disabilities and the Government Commissioner for the Rights of Persons with Disabilities; management level – the Cabinet of Ministers of Ukraine; functional level – individual central bodies of the executive power of Ukraine, their structural units and local self-government bodies. The key directions and principles of coordinated interaction of public administration subjects with relevant international institutions, primarily the UN and the Council of Europe, in the analyzed area are indicated.

Social Innovation for the promotion of decent work for people with disabilities

In modern conditions, disability is a social phenomenon that no society can avoid. There are more than 2.7 million people with disabilities in Ukraine. The realities of today allow us to state the fact that people with disabilities belong to the most vulnerable segments of the population, who are deprived of some basic life benefits. The problems of employment and labor, which need sufficient attention from the state, are also often overlooked. Unfortunately, in recent years there has been a significant increase in the number of people with disabilities in the country. Therefore, the question of the urgent need to study the protection of labor rights of persons with disabilities is relevant. Research methods are chosen to take into account the purpose and objectives of the study, its object, and its subject. In the course of the research philosophical, general scientific, as well as special legal methods of scientific knowledge were used. The purpose and task of the research are to determine the legislative and theoretical legal provisions regarding national instruments for the protection of the labor rights of persons with disabilities, to outline the existing guarantees for persons with disabilities in the field of work, to identify problematic aspects in the field of employment, to develop recommendations and proposals for the optimal ways of reforming labor legislation to effectively protect employees with disabilities.

The Right to Social Protection of Persons with Disabilities According to International Standards

The relevance of the subject under study is determined by the socio-economic state of the country and the long-term armed conflict in the Donbas, in particular, as a result of which thousands of people were injured and disabled. Insufficient funding for the healthcare system, lack of rehabilitation programmes for persons with disabilities, lack of housing and appropriate equipment for the movement and full functioning of the life of persons with disabilities in Ukraine lead to the fact that such people are discriminated against in society. Therefore, the purpose of this paper is to investigate the right to social protection of persons with disabilities in the context of compliance with international standards. Based on the monitoring study, available rehabilitation programmes, theoretical material, legislative analysis, and reports of international organisations, the authors came to relevant conclusions and made recommendations for the authorities, namely relevant ministries. The study discovered that the attitude towards people with disabilities is being transformed in the world, and their rights to a full-fledged, high-quality, non-discriminatory life in society are being consolidated. The need to reform national legislation and bring it in line with international standards was confirmed. It is proved that the main standards relate to the accessibility and adequacy of the right to social protection. The main elements of accessibility and adequacy of the right to social protection are highlighted. Key international regulations in the field of protection of the rights of persons with disabilities are analysed. The study investigated the term “discrimination for persons with disabilities”. It was established that the integration of persons with disabilities is possible if the problems with focusing attention on the category of persons with disabilities due to war are thoroughly studied. The practical value of this paper is to provide recommendations for relevant ministries, considering the monitoring study conducted by the authors in 2019-2020, which will contribute to improving the right to social protection as such.

REGULATORY AND LEGAL PROVISION AND ORGANIZATION OF THE WORK OF ACCOUNTANTS WITH DISABILITIES

Introduction. In modern conditions for employers are required compliance to the regulation jobs for persons with disabilities, provided for in Article 19 of the Law of Ukraine “On the basics of social protection of persons with disabilities in Ukraine”. The fulfillment of the standard of workplaces in the amount determined in accordance with part one of this Article shall be considered as employment of an enterprise, institution, organization, including enterprise, organization of public organizations of persons with disabilities, an individual who employs employed persons with disabilities for whom this place of work is the main. In addition to the standard of workplaces, it is necessary to take into account the individual approach to the physical abilities and professional abilities and skills of a person with a disability to perform a particular job. Aim. To summarize the features of business communication of persons with disabilities in the normative provision of accounting documentation and to show some experience in improving them. More often, people with disabilities are contraindicated in physical work, which is why they choose mental work. Popular among them is the profession of accountant, which requires professional experience, communications and a wealth of knowledge of regulatory accounting. Results. Many of the conceptual, methodological and organizational aspects of documentation and workflow in the accounting system continue to be debatable and need further investigation. In particular, the content of definitions, the composition of the classification features, which are necessary to deepen the analytical capabilities of accounting and strengthen its control functions, are not sufficiently clarified; disorganization of the spectrum of factors and prerequisites that affect the system of workflow and business communication of the enterprise and determine the tendencies of their development, etc. Along with the unresolved theoretical issues, drawbacks to the practice that involve structuring the documentation are noteworthy; streamlining the movement of primary documents; streamlining documentation; use of digital signatures, etc.

Mechanism of administrative and legal regulation of medical and social examination

The article examines the mechanism of administrative and legal regulation of medical and social expertise, its concept and essence are clarified. The structure and mechanism of administrative and legal regulation of medical and social expertise is defined, its general (main) elements are characterized, which include: 1) administrative and legal norms; 2) administrative and legal relations; 3) acts of application and implementation of administrative and legal norms. It has been updated that the mechanism of administrative and legal regulation, including MSE, is a means of practical implementation of the regulatory influence of public administration subjects on social relations and, at the same time, a complex phenomenon that deserves the attention of representatives of the scientific and legal community. It is indicated that the main legislative act in the MSE system is the Law of Ukraine «On the Rehabilitation of Persons with Disabilities in Ukraineя» dated 06.10.2005 No. 2961-IV, which provides for the definition of the concept of «medical and social examination» (Article 1) and generally regulates the procedure for organizing and conducting the International Trade Fair (Article 7). Attention is focused on the rule-making activity of a specialized subject of public administration – the Ministry of Health of Ukraine, which carries out legal regulation of MSE by issuing special orders, as an example of the order «On approval of the forms of the individual rehabilitation program of a disabled person, a disabled child and the procedure for their preparation» dated October 8, 2007 No. 623, «On the approval of the Instructions on establishing disability groups» dated September 5, 2011, No. 561, «On the approval of the Procedure and Criteria for establishing by medical and social expert commissions the degree of permanent loss of professional capacity as a percentage for employees who have suffered health damage, related to the performance of labor duties» dated 06/05/2012 No. 420, «On approval of forms of primary accounting documentation used in medical and social expert commissions» dated 07/30/2012 No. 577. It is proposed to divide administrative and legal norms as the main element of the mechanism of administrative and legal regulation of medical and social expertise into basic and special (concretizing) ones, and subjects of public administration as a mandatory party of administrative and legal relations that are formed on the occasion of providing (receiving) of medical and social expert services, - to subjects of public-authority powers and subjects of public-service (non-authority) powers.

Social Integration of Persons with Disabilities in Ukraine

The main directions of Ukraine’s social policy towards the disabled are presented in the article. Topical issues of integration of persons with disabilities into society are covered. The meaning of the concept of “social stigmatization” is revealed. The authors analyze and define the tools of social stigma in the legislation of Ukraine on issues of social integration of persons with disabilities. It has been proven that stigma in some cases deprives a person of full status, becomes a source of prejudice, discrimination, social isolation of the stigmatized, causes low self-esteem and feelings of depression, forms a negative social identity, and complicates psychosocial adaptation. Certain steps have already been taken to ensure the protection of persons with disabilities by creating appropriate conditions for them in society and equal opportunities for the realization of vital needs, abilities, and creative potential. The article defines a system of measures aimed at improving the lives of persons with disabilities, restoring their social status, achieving material independence, and comprehensive integration into society. The authors also propose measures to remove obstacles caused by stigmatization in the way of integration of persons with disabilities into society.

Human Rights Bulletin

This bulletin considers the situation of children with disabilities in Ukraine, who at the time of the onset of the armed conflict were living in institutional care. DRI investigations have revealed that despite abundant international assistance, the government of Ukraine and international relief agencies have failed to ensure the safety and protect the lives of these children within institutions – or to ensure their safe return to families in the community.

The article analyzes the dynamics of the number of people with disabilities in Ukraine, in particular by groups and separately children with disabilities, the provision of services by the State Employment Service for people with disabilities, including Lviv region during January-September 2020-2021. The stages of the order of creation and development of social services and information support are given; determining the need for social services, goals, objectives; prioritization of social services and project; planning the provision of social services and developing a strategy for their provision; organization of social services and implementation; monitoring and evaluation of service quality. Factors of influence of external and internal environment are defined. Legislative and regulatory framework, economic factors, social policy in the country, technological factors, as well as demographic factors are the main external factors. The main internal factors influencing the quality of social services there are available human resources; material-technical base; information support and financing. The main prerequisites for receiving quality social services by the population are identified, in particular, accessibility for all citizens, both territorially, financially and informationally, individual approach to consumers, taking into account the level of satisfaction of service recipients, as well as compliance with market needs and market trends. The main problems that cause low quality of social services and directions of their solution and avoidance of consequences are identified. There are the main problems: - lack of thorough analysis of demand and supply of social services in the market, control system after their provision to a particular person, as well as feedback from the client in the form of assessing the quality of services received; - low level of staffing in the provision of social services and the level of qualification of employees who provide services; - the lack of a unified approach to the financing of inpatient institutions that provide social services in Ukraine, as well as insignificant amounts of budget funding, imperfect mechanism of transfers of financial resources of the state to the local community cause low quality social services provided by the enterprise; - low level of methodological support for the process of providing quality social services for people with disabilities due to the lack of state quality standards for social services

The role of neurotrophins in post-stroke rehabilitation

Annotation. Acute disorder of cerebral circulation (ADCC) occupies leading positions in mortality and disability in Ukraine, despite new treatments and modern medical care. Current data suggest that the problem of treatment and rehabilitation of patients after ADCC can be solved with the help of neurotrophins – a family of proteins that regulate the processes of plasticity in the brain. Due to the similarity of their structure, they are able to act as a holistic system, helping to repair damaged areas of the brain. Therefore, the purpose of this review was to collect information on the structure and function of neurotrophins BDNF, NGF, NT-3 and NT-4, their role in neuroplasticity after stroke in order to develop modern methods of influencing them for further implementation in practice. For this purpose, 50 sources from the main databases (Elsevier, Pubmed, Web of Science, Google Scholar) were used. The systematic review describes the structure of neurotrophins and their function, mechanisms of neuroplasticity and methods of influencing it, in particular exercise and diet. Since these methods have a general therapeutic effect and require a long time for its onset, the prospects for further development are the creation of drugs targeted to the neurotrophin system for effective rehabilitation of patients after stroke.

CURRENT STATE OF SOCIAL ASPECTS OF THE UKRAINIAN DISABLED LABOR MARKET

The formation and development of the modern labor market is very important for the further development of Ukraine as a legal, democratic and socially oriented state. This presupposes the creation of clear, understandable forms, mechanisms and systems of access to this market. Among them, a special place belongs to the system of formation and use of additional opportunities (guarantees) of employment for persons with disabilities. The share of the employed among people with disabilities is less than among the population as a whole. In 2020, the employment rate for people with disabilities was 67 percent, compared with 77 percent for the general population. The conducted studies indicate that disability in Ukraine is explained by the poor state of the national health care system of citizens, the low level of safety and labor protection at enterprises, the unsatisfactory state of environmental culture, manifestations of various disasters in our country, in particular, military, natural, environmental, consequences Chernobyl disaster, hostilities in Afghanistan and in the Donbass region. The formation and development of the modern labor market, which is very important for the further development of Ukraine as a legal, democratic and socially oriented state, presupposes the creation of clear, understandable forms, mechanisms and systems of access to this market. Among them, a special place belongs to the system of formation and use of additional opportunities (guarantees) of employment for persons with disabilities. Despite the existence of state-guaranteed rights, legislative support for the employment of workers with limited labor opportunities, their involvement in productive work remains a weak point in our state. As practice shows, due to limited health opportunities, workers with limited labor opportunities do not have the opportunity to compete on equal terms with other citizens in the labor market, as a result, their rights to work are violated, the process of displacement from the sphere of labor activity continues, the level of unemployment and the depth of poverty. In this regard, the analysis of foreign experience in promoting the employment of workers with disabilities and determining the possibilities of its application in Ukraine becomes relevant.

Статистична оцінка та інформаційне забезпечення аналізу якості життя осіб з інвалідністю в Україні: проблеми та перспективи дослідження.

The article is devoted to the problems of analyzing the quality of life of people with disabilities in Ukraine. Th e purpose of the article is to carry out an objective assessment of the qua lity of life of persons with disabilities, taking into account the existing information support. Proposals are formed for full-fl edged surveys of this category of persons in Ukraine, taking into account the subjective assessment. Th e relevance of the study is due to the lack of suffi cient information support in Ukraine, both at the regional and national level. Th e analysis of persons with disabilities is carried out based on the available database of the State Statistical Service of Ukraine, the Ministry of Social Policy of Ukraine, State Employment Center and the Fund for Social Protection of the Disabled. Th e paper analyzes the dynamics of the number and structure of the causes of disability, access to educational services and the level of emp loyment of people with disabilities. Th e level of provision of persons with disabilities with durable goods that ensure their functioning in society is partially analyzed. Th e impact fac tors on the level of employment of people with disabilities are identifi ed. Th e classical regression method with the help of Statistica soft ware package is used to determine the impact of fac tors on the level of employment of persons with disabilities. Іt was found that the variation of employment of people with disabilities by 28 % depends on their access to higher education, in particular, the access of people with disabilities to higher education of full cycle of study has a greater impact on the level of employment. Th e results of the study showed that in Ukraine there is no comprehensive approach to the study of the socioeconomic profi le of persons with disabilities, which does not allow the formation of eff ective social policy. Th e paper proposes an author’s approach to the subjective assessment of the quality of life of people with disabilities and formulates proposals for assessing all aspects that form the quality of their life.

Comparative analysis of weight-bearing function of lower extremities in children with recurrences of congenital equinovarus clubfoot after surgical treatment by «traditional» methods and Ponseti method

Congenital equinovarus clubfoot (EVC) is the second most common congenital anomaly of the musculoskeletal system in children and one of the most common causes of childhood disability in Ukraine. The frequency of EVC reaches 1–3 cases per 1 000 newborns (35–40 % of all foot deformities). Objective. To determine the features of the children ability with EVC recurrences, before and after surgical treatment by «traditional» methods and Ponseti method. Methods. Biomechanical examinations of 65 children with EVC recurrences were performed. They were divided into two groups: group I (33 patients) — treated by «traditional» methods, which provided initial surgery, in order to completely correct all components of the deformity; group II (32 patients) — treatment by Ponseti method. Weight-bearing function was studied for all patients, before treatment, after 6 and 12 months after surgery, with statography. Results. It was determined that the standing parameters in the groups were not statistically different. After 6 months after the treatment, according to the statograms, the weight-bearing displacement remained, under the conditions of two weight-bearing standing towards the contralateral limb, in both groups of patients. In group I, after treatment, this parameter did not change (p = 0.924), and in group II it decreased by (2.7 ± 4.7) % (p = 0.013). Weight-bearing on the operated limb in both groups, in 12 months from surgery increased by 45 %. Conclusions. In patients, after treatment of EVC recurrences by Ponseti method, the weight-bearing function indicators, in the case of two weight-bearing standing, changed statistically significant. During the recovery process, when patients began to load the operated foot, a slight deterioration of standing parameters was observed in patients of group I in 6 months from surgery. In patients of group II, a complete restoration of statographic parameters occurred earlier, in 6 months, a normalization of weight-bearing and stability was observed. Thus, it can be argued that the use of Ponseti method in the complex treatment of EVC allows to restore the ability of weight bearing much earlier than with the «traditional» method. Key words. SYSTEM OF ECONOMIC MEANS OF STATE ADMINISTRATION OF THE RIGHTS OF PEOPLE WITH DISABILITIES TO HEALTHCARE

At the current stage of the development of society the problem of social protection and state support for people with disabilities is particularly relevant and requires reform and improvement. Ukraine, as a country aspiring to join the European Union, should take into account the best foreign experience of the leading countries of the world in the field of state policy to support people with disabilities and its implementation. The process of reforming the national healthcare system demonstrated the ineffective policy in this area, the high level of corruption and the inability to transform this system to the level of world standards of medical care, especially for people with disabilities. The problem of disability in Ukraine is becoming particularly acute. The goal of this article is to investigate the system of economic means of state administration of the rights of people with disabilities to healthcare, to identify the areas of budgetary management and the formation of a new mechanism of economic administration. Scientific analysis was carried out by using the method of systematic approach and analysis, which enabled us to study theoretical aspects of economic methods of state administration of the right of people with disabilities to healthcare, formation of the budget management in Ukraine for the economic security of the rights to healthcare, and features of the new mechanism of the economic administration of the right of people with disabilities to health care. It has been researched that along with administrative methods of state management of the right to health protection of people with disabilities the economic group of methods is important. These include programs of economic development of health care, rehabilitation programs for people with disabilities, implementation of pilot projects to change the mechanism of financial support for operative treatment, etc. Methods of regulating influence (indirect management) are becoming increasingly important, and economical methods of management belong to them. Implementation ensures that the financial and material interests of the management objects are satisfied through the activities of its subjects, which create favorable conditions for achieving the goals and objectives of management. For example, local self-government bodies, within the limits of their competence, can finance local programs for the development and support of community healthcare institutions. In 2019, a new mechanism of rehabilitation support for children with disabilities was introduced based on the principle of "money follows the people", which should ensure targeting, transparency and improve the quality of rehabilitation services. Resources are divided vertically among regional bodies, which divide budgetary funds among local bodies in proportion to the number of children who require rehabilitation measures, according to the place of their residence (location). The national legislation also reflects the norms that created the conditions for the implementation of the right to work of people with disabilities, as well as ratified Convention on the Rights of Persons with Disabilities and the ILO Convention on professional rehabilitation. From the point of view of the Ministry of Healthcare of Ukraine, the funds allocated by the state are extremely insufficient for the uninterrupted functioning of the medical system. In its budget memorandum for 2021 the ministry has allocated twice as much – 296 billion UAH, 225 billion UAH of which for the implementation of the medical guarantee program (which is 5% of GDP, as required by the Law of Ukraine "On State Financial Guarantees of Medical Services to Population"). But the proposals of the Ministry of Health both at the time of formation of the state budget and at the time of its approval were not taken into account. The requirement of the Law of Ukraine "On State Financial Guarantees of Medical Services to the Population" for the establishment of financing of the program of medical guarantees at the level of 5% of GDP was lengthened for one more year.

Abstract. Introduction. The main challenge of the world community, affecting every seventh person in the world is disability. Disability is characterized as a social phenomenon, which is a priority of every civilized and legal state to deal with. Recognized in society, as well as in various scientific studies on the effectiveness of measures to integrate persons with disabilities, is the gradual involvement of children and adults of this category in physical culture and sports. This path allows people with disabilities to develop personal skills, sports skills, build relationships with other people, achieve significant achievements in sports, increase their own self-esteem, and reach professional heights in various fields. Purpose. The purpose of the article is to study organization of physical culture and sports of persons with disabilities in the current conditions at the regional level, in particular: the analysis of state regulation of the organization of physical culture and sports of persons with disabilities in Ukraine is carried out; the state of organization of physical culture and sports of persons with disabilities at the regional level is studied and directions for improving the level of their social integration are determined. Results. The study of the state of organization of physical culture and sports of persons with disabilities at the regional level in the conditions of today, allowed to determine the directions of increasing the level of their social integration, in particular: to provide in the State target social program for the development of physical culture and sports a separate direction "Physical culture and sports for persons with disabilities", which will allow to make more reasonable approach to the organizational and regulatory conditions for the development of physical culture movement among persons with disabilities by state institutions; to identify tasks related to the development of mass sports and active involvement of persons with disabilities in physical culture classes in the Program of development of physical culture and sports in the Mykolaiv region and in the city program "Physical culture and sport" (Mykolaiv); to form and implement a strategy of informing society about the opportunities of persons with disabilities and popularizing their achievements, including sport ones. Conclusions. The course of society humanization chosen by Ukraine should contribute to the formation of respect for people with disabilities and ensure their high-quality integration into all spheres of life, including the field of physical culture and sports. State institutions, together with public volunteer organizations of disabled people, have significant opportunities in practical solution of physical, social and economic problems of persons with disabilities, which allows to make more reasonable approach to organizational and regulatory conditions for the development of physical culture movement among persons with disabilities.

Prerequisites for Creating Textbooks for Auxiliary Schools: Correctional Psychopedagogy for Children with Intellectual Disabilities

The history of the use of school textbooks as a special teaching tool dates back more than two centuries. Throughout its existence, the textbook has played a significant role in teaching students. It records the amount of knowledge, skills and abilities to be acquired in the learning process. The textbook is a special didactic object, which is both a carrier of the content of education, forms of recording its various elements and a project of the educational process. It implements the substantive and procedural aspects of learning in their organic unity, because the content of education and the learning process are closely interrelated, without each other impossible. One of the important areas of research in the history of pedagogy is the study of the history of school textbooks, a phenomenon that has come a long way in history, and at the present stage is an important tool for learning. The didactic functions of the school textbook are determined: informational, consolidation and control, systematization, self-education, integrating, coordinating, reference, developmental and educational. It is established that foreign and domestic correctional pedagogy has accumulated some experience in the practical creation of textbooks for the auxiliary school. Most of all in Ukraine it concerns textbooks on native language and reading. It was found that the formation and development of textbooks for children with intellectual disabilities in Ukraine were not the subject of a comprehensive analysis that would overcome the fragmentary historical and pedagogical knowledge to understand the historical experience gained in Ukraine and help identify the most progressive ideas and provide useful material for use by authors of textbooks in modern conditions.

Some aspects of establishment and development of social entrepreneurship

Problem setting. Social entrepreneurship as a phenomenon has long been known to the world community. Although its formation in Ukraine has started relatively recently, the pace of development of Ukrainian social entrepreneurship is simply impressive. Target of research is to study the main factors promoting social entrepreneurship. To achieve this goal, structural, comparative and statistical research methods were used. Analysis of resent researches and publications. Problems of development of social entrepreneurship have received considerable coverage in the works of scientists: B. Androschuk, N. Gusak, A. Kornetsky, V. Nazaruka, A. Tumanova and others. Article’s main body. A. Kornetsky and B. Androschuk identify three main stages in the development of social entrepreneurship in Ukraine. The first is called the period 1991-2010, when international donors, in particular the United States Agency for International Development, began to finance the development of social entrepreneurship in Ukraine. In 1991, the Law of Ukraine “On the Fundamentals of Social Protection of Persons with Disabilities in Ukraine” was adopted. It is still in force and provides benefits for doing business for people with disabilities, in particular, determines the financing of their business initiatives from a special state fund. The second stage defines the period 2010-2016, which was characterized by the merger of partner organizations into consortia to launch educational and financial programs for social entrepreneurship. In 2010, the Consortium for the Promotion of Social Entrepreneurship in Ukraine was established. With its support, a number of trainings for trainers were conducted, three resource centers were opened (in Kyiv, Donetsk and Lviv) and the first lending program for social enterprises was launched. During this period, the publication of educational materials on social entrepreneurship began. It is believed that the third stage of development of the social enterprise began in 2016 and continues to this day. Significant assistance in the development of social entrepreneurship in Ukraine during this period is provided by the European Union (EU) and some EU member states. Conclusions and prospects for the development. In general, Ukraine is currently at the stage of forming an ecosystem of social entrepreneurship and networking of local centers for its development. In the period from 2016-2020, about 10 Ukrainian-language manuals on social entrepreneurship were published, 3 Ukrainian-language online courses were created. Every year, the number of educational activities aimed at promoting social entrepreneurship increases, and public awareness of the role of social enterprises is growing. However, an important aspect is that, for the most part, the implementation of activities aimed at the development of social entrepreneurship in Ukraine is supported by international donors, rather than government programs and initiatives. Further research should focus on the study of foreign experience in determining the main factors of social entrepreneurship, as well as a detailed analysis of these factors.

Improving the Quality of Life of Persons with Disabilities by Promoting Their Professional Rehabilitation

The article considers fundamental aspects of ensuring the quality of life of persons with disabilities in Ukraine, recognition of their rights to a full life in society and the creation by the state of appropriate conditions for their rehabilitation and social integration. There have been significant changes in attitudes towards people with disabilities in recent decades. The basis of such changes is the recognition of their rights to a full life in society and the creation of appropriate conditions for their rehabilitation and social integration, but, despite the positive changes, the quality of life of people with disabilities lags far behind and does not meet today's requirements. Today in Ukraine, the employment of people with disabilities is part of vocational rehabilitation, the purpose of which is to provide them with work directly. The article is devoted to the study of the development and supports system of vocational training of persons with disabilities in Ukraine. Particular attention is paid to the structure of state and non-state institutions, through which vocational training of persons with disabilities is carried out. The critical shortcomings of the vocational education system of persons with disabilities in Ukraine are selected. In particular, in terms of financing such education, logistics for certain groups of persons with disabilities, as well as educational institutions and enterprises that need to adapt their place of study or work to the needs of persons with disabilities. The feasible analysis also indicates the shortcomings of the Procedure for choosing a profession for people with disabilities with the participation of medical and social expert commission (MSEC). Recommendations for overcoming these shortcomings are formulated separately.

REGULATORY AND LEGAL PROVISION OF PEOPLE WITH DISABILITIES IN UKRAINE

One of the main components of a developed state is to ensure human rights and freedoms and decent living conditions. Ensuring social protection of people with disabilities and normal living conditions is one of the main issues today. The article reveals the essence of normative and legal provision of life of people with disabilities in Ukraine. The main legislative documents on social security and protection of people with disabilities were also collected and analyzed. In order to fully outline the real picture of the opportunities that the state provides to people in this category. The purpose of the article: to analyze the legal framework for the livelihood of people with disabilities, to determine the main provisions, purposes and activities. Research methods: during the study, the search for sources of information, relevant legal documents was used. Priority legislative documents regulating the issues of social security of people with disabilities were also analyzed and singled out. The positive and negative aspects of the social security system of life of people with disabilities have been synthesized. The received information is generalized for systematization of the basic provisions concerning social security of people with disabilities. The above material allows us to draw the following conclusions that the legal framework for the protection of people with disabilities is indeed a powerful means of improving their living conditions. It involves solving a large number of problems and issues in the field of social security for people with disabilities. The findings of the study indicate the imperfection of the system of ensuring the livelihood of people with disabilities. The main disadvantage of the system is the lack of comprehensive impact on the lives of people with disabilities. Despite the interrelationships between the regulatory and structural elements of the social security system. This system will be more effective if it works comprehensively, ie in harmony with all structural elements. The legal framework on the subject of research is a fairly extensive system, which includes a number of bylaws, which also requires detailed study, which will be the purpose of further research.
