Comprehensive intellectual property ability and firm productivity: A quasi-natural experiment based on national intellectual property demonstration advantage firm policy in China.

Intellectual property is crucial for the development of firms. At the micro level, firm comprehensive intellectual property ability involves abilities about intellectual property creation, utilization, protection, and management. In order to develop the comprehensive intellectual property ability of firms, the China National Intellectual Property Administration began to implement the national intellectual property demonstration advantage firm (NIPDAF) policy in 2013. Based on this exogenous policy shock, using data from listed companies from 2011 to 2020 as the research sample, the time-varying DID method is used to test the impact of the NIPDAF policy intended to cultivate comprehensive intellectual property ability on firm productivity. The results show that after policy implementation, the total factor productivity of NIPDAFs increased by about 3.3% compared to the control group. This finding is robust after a series of tests. Furthermore, the NIPDAF policy promotes firm productivity through stimulating technology innovation, improving investment efficiency, and enhancing competitive advantage. In addition, the NIPDAF policy has a more significant incentive effect on the total factor productivity of non-state-owned enterprises, firms in the eastern region, and firms in patent intensive industries.

In this context, an important aspect of the functioning of modern society is intellectual property law, which in the digital age acquires new challenges and opportunities.
 Intellectual property law recognizes and protects the intellectual and creative achievements of an individual or collective, giving them the right to own and control these achievements. Importantly, intellectual property law helps stimulate creativity and innovation, as it provides appropriate economic incentives to intellectual property owners.
 The growing use of digital technologies and the Internet raises several new questions and challenges related to intellectual property rights. On the one hand, the digital age creates unique opportunities for the creation, distribution, and use of intellectual property, leading to new forms of creativity and supporting cultural exchange. On the other hand, it creates problems regarding the control, protection, and reproduction of this property in the digital environment, particularly the growth of piracy and copyright infringement.
 In the digital age, intellectual property rights become the basis for innovation, technological development, and cultural exchange. Understanding its functions, challenges, and prospects is an important task for the further development of society in the digital age. In this context, the study highlights key aspects and solutions to the problem of intellectual property rights in the digital age, in particular, the role of legal norms, protection measures, innovation, and cooperation at the international level.

Separate Issues of Implementation of Parallel Imports Regime and Related Problems of Intellectual Property Protection in Russia under Sanctions

It is already possible to conduct a comprehensive assessment of parallel imports introduction into the Russian legislation, which aims at providing Russian consumers with goods that are no longer available on the national market due to the sanctions against the Russian Federation adopted in 2022 and a number of companies suspending their activities in the Russian Federation. Exhaustion of intellectual property rights has been known in the world for quite a long time as a tool aimed at ensuring a balance of interests of copyright holders, consumers and importers, as well as a tool for ensuring international competition. In a particular state, one or another regime of exhaustion is applied taking into account the economic, political foundations of the functioning of the state economy, legal and evolutionary prerequisites. In this context, the paper presents a number of conclusions and proposals aimed at optimization of the parallel imports regime in Russia. The author considers some aspects of the customs, and substantiates the expediency of direct consolidation of international exhaustion of rights in the Russian legislation and possible development trajectories of the «list» approach to parallel imports. General approaches to the protection of intellectual property under sanctions are formulated, as well as proposals for solving problems related to the use of copyright objects belonging to copyright holders who have suspended their activities in Russia following sanctions regimes. The formulated conclusions and proposals could be summarized and taken into account in the Strategy for the Development of Intellectual Property in Russia — a strategic document that is extremely necessary in order to systematize and optimize measures for the development of approaches to the protection and promotion of the creation of intellectual property in Russia.

It emphasizes the importance of judicial practice in addressing legislative gaps and providing clarity on various aspects of employee patent rights, including ownership, remuneration, formal procedures, and dispute resolution. Drawing comparisons with the German system, the article underscores the role of case law as a critical source of law in shaping the legal framework for employee patent rights. It concludes by highlighting the significance of ensuring inventors’ rights and fair compensation to foster innovation.

Comparative law is designed for alignment of constitutional law with other countries advocating public welfare and safety. The United States has an Intellectual Property provision under U.S. Fair Clause using their constitution as pre-emptive doctrine. The aim of this paper is to evaluate the applicability of UK Intellectual Property Law based on their complexed policies on Artificial Intelligence. Hence, it leads to problem statements questioning: (1) the eligibility of matters of facts did not meet UK IP Law; (2) the standard for evidence towards invention using Artificial Intelligence does not conform with UK IP Law; (3) Liability in AI patent infringement is not subsistent in UK IP Law; and (4) AI’s compliance is not subject for responsibility under creativity and non-obviousness criteria. The Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement promotes public welfare and safety under constitutional laws. India, as a member, is obliged to comply with the standard of evidence in patentability under World Trade Organization (WTO). The WTO is a committee responsible for advocating business law. Invention for marketability of patent product has its own complexed policy to comply for acceptance of an Intellectual Property creation. Constitutional law is designed to be made comparable with other countries, promoting the monetary success of their nation exhibiting economic progress in industrial and technological advancements. ASSESSMENT OF THE INNOVATIVE MANAGEMENT PROCESS OF A BUSINESS ORGANIZATION

The article analyzes approaches to the evaluation of the process of managing the innovative activity of a business organization, and gives an example of such a process in a production-type organization. The relationship between the process of evaluating innovative activity and measuring the effectiveness of business organization activity is shown, a comparison of modern and traditional approaches to evaluating the effectiveness of business organization activity is made, and common points with the process of evaluating the management of innovative activity are identified. The characteristics of four main approaches are presented: multi-criteria, cost-based, risk-oriented, integrated. The main indicators on the basis of which it is possible to evaluate the innovative activity of an innovatively active business organization are given: indicators characterizing the innovative level of a business organization, indicators characterizing the production effect of the application of innovation, and indicators characterizing the financial efficiency of innovations. The relationship between innovation and investment is shown, the main factors affecting investment in innovation activity are identified, among them: high cost of innovation activity, creation of intellectual property, probability of success and uncertainty of the results of innovation activity, which makes it difficult to forecast the main parameters of such activity, etc. The innovative activity of LLC “MARGIT” was studied: the analysis of innovative solutions of the business organization was carried out according to the main groups of innovations, a map of the potential of innovation projects of LLC “MARGIT” was built. The strategic assets of the business organization, on the basis of which a new innovation process can be initiated and implemented, have been analyzed. Within such an analysis, the most important functional areas for a business organization are delineated, namely: finance, technology, fixed assets, research and development, marketing, etc.

Legal Protection of Intellectual Property Rights of Academic Staff Members and Researchers

Amid current development of innovations and technologies, academic staff, including research officers of educational institutions of higher education and research officers of research institutions play a key role in the creation of intellectual property. It is because man creates the results of intellectual activity, and academic staff of educational institutions, researchers in research institutions are, in the designated context, special subjects involved in the processes of creating intellectual property, mainly on a regular basis. Academic staff of educational institutions and researchers in educational and research institutions in a certain sense seem to be the weak side. Often, educational and research institutions in employment contracts and local regulatory legal acts establish conditions that the corresponding institutions are automatically the copyright holders of exclusive rights to intellectual property created by the faculty and researchers. Publishers that publish scientific works of the faculty and researchers often impose the transfer of exclusive rights free of charge, without paying remuneration to the authors. In this context, the paper proposes measures to develop models for the protection of intellectual property rights of the academic staff and researchers, as well as solving a number of problems related to ensuring the rights and interests of this category of authors.

Design of programmable hardware security modules for enhancing blockchain based security framework

Globalization of the chip design and manufacturing industry has imposed significant threats to the hardware security of integrated circuits (ICs). It has made ICs more susceptible to various hardware attacks. Blockchain provides a trustworthy and distributed platform to store immutable records related to the evidence of intellectual property (IP) creation, authentication of provenance, and confidential data storage. However, blockchain encounters major security challenges due to its decentralized nature of ledgers that contain sensitive data. The research objective is to design a dedicated programmable hardware security modules scheme to safeguard and maintain sensitive information contained in the blockchain networks in the context of the IC supply chain. Thus, the blockchain framework could rely on the proposed hardware security modules and separate the entire cryptographic operations within the system as stand-alone hardware units. This work put forth a novel approach that could be considered and utilized to enhance blockchain security in real-time. The critical cryptographic components in blockchain secure hash algorithm-256 (SHA-256) and the elliptic curve digital signature algorithm are designed as separate entities to enhance the security of the blockchain framework. Physical unclonable functions are adopted to perform authentication of transactions in the blockchain. Relative comparison of designed modules with existing works clearly depicts the upper hand of the former in terms of performance parameters.

Scientific and technological achievements - intelligent management platform of intellectual property in universities

As many platforms on the market are of different quality, it is difficult to ensure the security of intellectual property rights, while many university campus websites lack the embedding of intellectual property management platform, which is not conducive to the transformation of scientific and technological achievements of intellectual property rights in universities. In the "Outline for the Construction of a Strong Intellectual Property State (2021 - 2035)"[1], it is clearly pointed out that the construction of a strong intellectual property state should be promoted in an integrated manner, the level of intellectual property creation, application, protection, management and service should be improved comprehensively, and the important role of intellectual property system in the construction of socialist modernization should be given full play. It is divided into three major sections: patent, trademark and copyright, to realize intelligent and safe management of customers, and at the same time provide professional IPR application services, laws and regulations publicity, application documents information, etc., which helps to accelerate the transformation of achievements of universities and enterprises. The purpose is to promote the transformation of scientific and technological achievements of universities, and it can also be applied to enterprises to maintain, manage and protect the intellectual property rights of rights holders for universities and enterprises [2]. In the future, the database of the platform can be expanded for deep learning-based IPR management to promote the integration of Internet application, management, transaction, and maintenance of IPR.

An Analysis of Intellectual Property Education in Japanese Compulsory Education

지식재산권 보호는 4차 산업혁명 시대에 국가 경쟁력의 핵심으로 그 중요성이 점점 강조되고 있다. 이 연구는 지식재산권 보호를 위해 일본에서는 국가적으로 어떠한 노력을 하고 있으며, 학교에서는 지식재산교육이 어떻게 전개되고 있는지 그 특징을 밝히는데 목적이 있다. 이를 위해 일본의 지식재산교육 정책을 검토하고 의무교육 단계의 교육과정에 해당하는 학습지도요령을 분석하였다. 그 결과 정책 측면에서는 학생들에 대한 ‘지식재산 창조 교육’을 국가적으로 임해야 할 시급하고 중요한 과제로 명확하게 제시하면서 능동적으로 대응해나가고 있는 것을 알 수 있었다. 학습지도요령에 나타난 지식재산교육 관련 목표 및 내용 요소를 분석한 결과에서는 다음과 같은 세 가지의 특징이 드러났다. 첫째, 지식재산교육 커리큘럼이 소학교와 중학교의 학교급별로 계통적･체계적으로 구성되어 있다. 둘째, 지식재산교육 내용을 포괄적으로 반영하고 있는 교과로 소학교는 도화공작(図画工作)과, 중학교는 미술과와 기술･가정과로 나타났다. 셋째, 의무교육 단계에서는 저작권 관련 지식･이해와 지식재산을 존중하는 태도를 강조하고 있다. 이와 같은 일본의 지식재산교육은 특정 교과에서 한정적으로 다루고 있는 우리나라 의무교육 단계에서의 지식재산교육에 정책 마련이나 커리큘럼 구성 측면에서 유의미한 시사점을 제공하고 있다.The importance of protecting intellectual property rights is increasingly emphasized as the core of national competitiveness in the era of the 4th industrial revolution. The purpose of this study was to examine the national efforts to protect intellectual property rights and the characteristics of intellectual property education(IPE) in Japan. To this end, this paper investigated the Japanese policy of IPE and analyzed the curriculum guidelines of elementary and junior high school in Japan focusing on the goals and content elements related to IPE. The research results are as follows: Japanese government corresponded IPE proactively and presented 'Intellectual Property Creation Education' for students as an urgent and important issue that should be addressed on a national level. As a result of analyzing curriculum guidelines, the following three characteristics were revealed. First, the curriculum structure related to IPE is systematic for each school level in elementary and junior high schools. Second, subjects that comprehensively reflect the content of IPE are ‘drawing & crafts’ in elementary school and ‘arts’ and ‘technology & home economics’ in junior high school. Third, both ‘knowledge and understanding’ related to copyright and ‘attitude’ to respect intellectual property are generally emphasized in the compulsory education stage. This study provides significant implications in terms of policy making and curriculum composition to IPE of compulsory education stag in Korea, where limitedly dealt with in specific subjects.

Promote or inhibit? The effect of the whole chain development of intellectual property on manufacturing firm performance.

With the promotion of intellectual property strategy, the whole chain development of intellectual property environment faced by manufacturing firms has been improved, but the effect of the whole chain development of intellectual property on firm performance still needs to be studied. The purpose of this study is to investigate the impact of the whole chain development of intellectual property on different types of manufacturing firm performance. A panel regression model is constructed based on listed manufacturing firms from 2010 to 2020, and this is tested empirically. The results of the study show that the whole chain development of intellectual property has a promotion effect on manufacturing firm performance, among which the promotion effect of intellectual property services is the strongest, followed by intellectual property utilization and intellectual property creation, and the promotion effect of intellectual property management has a significant lag, while the relationship between intellectual property protection and manufacturing firms performance is significantly negative. The promotion effect of the whole chain development of intellectual property on different types of manufacturing firm performance is heterogeneous, and the promotion effect of the whole chain development of intellectual property on the performance of small-scale, non-state-owned, medium-high-technology manufacturing firms is stronger than that of large-scale, state-owned, low-technology manufacturing firms. This study not only extends the research direction of intellectual property, but also adds to the literature on firm performance. In addition, the findings of this paper help government authorities to further optimize the strategic layout of the whole chain development of intellectual property, promote manufacturing firms to solve internal management problems, and achieve a positive interaction between the top-level design of the intellectual property and the bottom-level logic of manufacturing firms.

The modern economy, when creating new technologies, innovative solutions, requires effective implementation in the real sector, ensuring the development and formation of the country’s gross domestic product (GDP). The created intellectual property should not settle as a dead weight in formal registries. In this paper, the problems of commercialization of intellectual property in Russia are analyzed and effective options for implementing this process are proposed. Trends in the creation of intellectual property, its reflection as intangible assets and its inclusion in commercial circulation are analyzed.

The mission of modern universities as subjects of the knowledge economy

The aim of the study was to analyze the features of education management in the context of development of the University 3.0 and 4.0. The article identifies the factors that determine the activation of the formation of innovative and entrepreneurial competence of the modern manager of education at the university. In particular, the transformation of universities into a component of the national innovation system in the conditions of globalization changes. The characteristics of the involvement of universities in cooperation in the context of the study of national innovative universities are characterized. In the course of the study, the problems of transformational changes and the missions of universities of foreign countries in the conditions of the development of the knowledge economy were clarified and the ways of their solution were outlined. The new role of universities in the knowledge economy society is presented: innovative development of the country due to the contribution of modern universities to the creation and commercialization of intellectual property; modern universities solve the task of transferring knowledge into intellectual capital by using the resources of globality, openness, dynamism, and a constant influx of active youth; the mission of modern universities is to actively create technologies and technology companies; universities become leaders and centers of creation of new technological industries.

지식재산 확산을 위한 제주 향토 문화 활용 지식재산 경진대회(상표, 디자인)를 통한 생물자원의 권리화 사례 연구

The 'Jeju Local Culture Utilizing Trademark and Design Contest' is held as part of disseminating intellectual property and nurturing human resources with the goal of creating a leading model for intellectual property education, the only base in the Jeju region including subtropical biological industry such as citrus. This contest has been operated since 2019 in collaboration with related organizations in Jeju Island. The purpose of the contest is to induce the creation of intellectual property through the realization of creative ideas using the local culture of Jeju Island, and to discover intellectual property talents to strengthen employment and start-up capabilities. The target audience is elementary, middle and high school students, undergraduate and graduate students, and the general public residing in Jeju Island. The fields of participation are divided into trademark and design fields using Jeju language and Jeju culture. Ideas of various age groups are being discovered and combined with local culture. The submitted works are reviewed and the best works are selected and supported so that they can be turned into rights. Through this study, we intend to review the operation cases and results of competitions utilizing local culture, and suggest best practices for nurturing intellectual property talents and securing regional-specific intellectual property rights.

How does digital piracy affect innovation? Evidence from software firms

Despite digital piracy's well-documented impact on firm revenue, the relationship between piracy and firm innovation, including the creation of new intellectual property (IP) rights, is not well-understood. To fill this gap, this paper estimates the impact of piracy on innovation through a quasi-experimental design and explores the mechanisms driving this relationship using data on software firms. Leveraging a 2001 technological shock that suddenly enabled rising software piracy, we find increases in subsequent R&D spending, copyrights, trademarks, and patents for large, incumbent software firms. Furthermore, firms with large patent portfolios appear to disproportionately increase copyrights and trademarks following the piracy shock. After considering alternatives, our analysis suggests that impacted firms perceive piracy as a form of product-market competition that causes them to increase innovation and balance their IP portfolios.

The Coupling and Coordinated Development of Intellectual Property and High-Quality Economy: Using China’s 30 Provinces as an Example

Research Background and Content. Intellectual property and high-quality economic development are mutually reinforcing and restrictive, China is a large but not a strong intellectual property country, and China’s high-quality economic development still has problems of inadequacy and imbalance. Based on the above research background, this paper mainly studies the relationship between the intellectual property system and the high-quality economic development system from the perspective of coupled and coordinated development. Research Objective. The objective is to measure the coupling and coordination degree between the intellectual property development system and the high-quality economic development system and to explore the spatiotemporal characteristics and differences in the coupling and coordination between the two systems. Research Method. Based on the data of 30 provinces (autonomous regions and municipalities) from 2013 to 2020, the methods used in this paper to analyse include entropy weight method, grey correlation analysis, coupling coordination degree model, and Dagum Gini coefficient. Research Results. The development of economic openness and innovation are more closely related to the development of intellectual property, and the protection, utilization, and creation of intellectual property are more closely related to high-quality economic development; the coupling coordination degree of the two systems shows the characteristics such as “high in the east and low in the west” and “coastal area is better than inland,” and the development of intellectual property lags behind the high-quality economic development; the coupling and coordination degree of the two systems shows a slight growth trend in most provinces, but the overall differences shows an expanding trend, and differences between regions are the main sources of overall regional differences. Research Innovation. Research innovation is to study the two-way relationship between intellectual property and high-quality economic development and to measure the coupling and coordination degree between the development system of intellectual property and the high-quality economic development system, and its spatiotemporal characteristics, regional differences, and sources of differences are analyzed. Research Value. Research value is to provide decision reference for the two-way empowerment of intellectual property and high-quality economic development and regional coordinated development.

Application of Patent Right and Trademark Right in Packaging Design Based on Computer Nonlinear Prediction Systems for Virtual Reality Technology

Comprehensively strengthening the protection of intellectual property rights (IPRs) and stimulating the vitality of innovation to foster a new development paradigm, innovation is the primary driving force behind development, and protecting IPR is equal to protecting innovation. China is changing from Chinese products to Chinese brands, the need to comprehensively strengthen IPR protection from the perspective of national strategy, so as to promote the building of a modernized economy, stimulate the innovation vitality of the whole society, and foster a new development paradigm. This paper is based on application of patent right and trademark right in packaging design based on computer nonlinear prediction systems for virtual reality technology; from the perspective of intellectual property protection and innovation promotion, combining with several cases of packaging design in computer nonlinear prediction system, this paper expounds different forms of intellectual property creation in packaging design practice, and the irreplaceable important role that intellectual property protection plays in the follow-up market operation of products. At the same time, the combination of computer nonlinear virtual reality technology and packaging design can provide more powerful support for the creation and experience of commodity packaging virtual world, emphasizing the importance and urgency of the creative industry to improve the knowledge level of intellectual property, and the ability to create, apply, and protect intellectual property.

Protecting Network-on-Chip Intellectual Property Using Timing Channel Fingerprinting

The theft of Intellectual property (IP) is a serious security threat for all businesses that are involved in the creation of IP. In this article, we consider such attacks against IP for Network-on-Chip (NoC) that are commonly used as a popular on-chip scalable communication medium for Multiprocessor System-on-Chip. As a protection mechanism, we propose a timing channel fingerprinting method and show its effectiveness by implementing five different solutions using this method. We also provide a formal proof of security of the proposed method. We show that the proposed technique provides better security and requires much lower hardware overhead (64%–74% less) compared to an existing NoC IP security solution without affecting the normal packet latency or degrading the NoC performance.
