Personal Reception of Citizens: Problems of Legal Regulation and Implementation

Personal reception represents a way of submitting citizens’ complaints and one of the forms of implementation of the constitutional right of citizens to appeal (complain). However, the legislative regulation of the issue under consideration seems insufficient, which has given rise to adverse law enforcement practice.The article determines signs of personal reception that allow us to distinguish it from other types of citizen’s communication with officials. The paper makes a thorough analysis of the duty of officials to conduct personal reception. Two models of performing the reception are highlighted: 1) personal reception is carried out only by chairpersons (of the government agency as a whole, its deputies or heads of structural divisions); 2) personal reception is carried out not only by chairpersons, but also by other authorized officials or specialized units. Moreover, the paper focuses on the problem of delegation of the obligation to perform personal reception to other officials.The paper investigates the procedure of personal reception that includes four stages: registration for personal reception (optional stage); arrival of a citizen at the place and time provided for personal reception, identification and determination of the order of personal reception; personal intercourse with the official, including a statement of the essence of the oral request or submission of a written application; registration of a personal reception card. Special attention is paid to the issue of registration of a personal reception, which allowed to formulate conclusions about the most relevant content of a personal reception card. The procedure of holding the all- Russian day of personal reception and experience of introduction of regional uniform days of personal reception in constituent entitities of the Russian Federation is analyzed.Also, the author scrutinizes the experience of organizing personal receptions in various governmental bodies and authorities in order to generalize additional guarantees of the rights of citizens during personal reception, as well as to develop an approximate list of feasible constrains.

Improving the System of Statistical Accounting of Appeals to the Court at the Initial Stage of Criminal Proceedings in the Digital Era

Based on the results of compilation and analysis of statistical data on consideration of complaints of interested persons by the courts of general jurisdiction, filed pursuant to articles 125 and 125.1 of the code, the author proposes some measures for improving the system of judicial statistics given the active introduction of digital technology in the field of criminal procedural relations. The paper notes the priority role of the court in the implementation of the constitutional right of citizens to access justice and in their protection from illegal actions (inaction) and decisions of bodies and officials carrying out criminal prosecution. To optimize the areas of judicial activities the author suggests broad interpretation of the provisions of part 1 of article 30 of the Criminal Procedural Code of the Russian Federation and the formation of the court composition for consideration of requests submitted with the court at pre-trial stages of the criminal process, with the use of an automated information system. The paper substantiates the necessity of successive integration of the State Automated System of legal statistics with the State Automated System «Pravosudie [Justice]», which will allow users of these systems to track the results of the procedural activities of the preliminary investigation, prosecution and court activities at all stages of criminal proceedings. The author also considers it relevant to reflect in more detail the results of consideration and resolution by the court of citizens’ appeals received at the initial stage of criminal proceedings in the annual analytical reviews prepared by the Judicial Department at the Supreme Court of the Russian Federation based on summary statistical reports of all courts of the Russian Federation.

The article discusses the problems of psychological preparation by an investigator to carry out a search and seizure as independent investigative actions. A quick and complete investigation of crimes depends on the skills and abilities of the investigator when applying methods of lawful mental influence on the person being searched. Psychological problems, questions of organizing the conducting a search are the objects of the works of M.I. Enikeeva, N.P. Yablokova, V.A. Obraztsova, V.I. Popova, A.S. Knyazkova, R.L. Ahmedshina, T.V. Averyanova, R.S. Belkina, Yu. G. Korukhova, E.R. Rossinskaya, etc. The purpose of this article is to consider the psychological nature of the search, to reveal a specific series of circumstances. In legal literature, a search is understood to mean not only search coercive activity, but also the cognitive activity of the investigator. Peculiarities of the investigator's cognitive activity are expressed in the personal perception of the searched premises and the personality of the most searched in a conflict situation. It should be noted that at the time of the search, the constitutional rights of citizens to privacy and the right to privacy of housing are limited. Therefore, compliance by the investigator with the procedural order of the search and the rule of law ensures the effectiveness of this investigative action, which in turn guarantees the observance of the constitutional rights of citizens.

The Regulation Of Restrictions On Workers / Labourers Having Marriage In The Same Workplace

The purpose of this study was to determine the regulation of restrictions on workers/laborers to marry in one office as regulated in the Decision of the Constitutional Court Number 13/PUU-XV/2017. The method used in this research is normative research and the type of approach used is the law approach, conceptual approach, and case approach. The technique of analyzing legal materials in this study uses a systematic interpretation method. The results of the study show that the provisions of Article 153 paragraph 1 letter f explain that employers are prohibited from terminating employment because the worker/ laborer has blood ties and/or marital ties with other workers/ laborers in the same company unless it has been stipulated in a work agreement, regulations company, or collective work agreement." The limitation of the right to marry in one office is based on a work agreement which is the desire of both parties. Meanwhile, the workers are citizens whose constitutional rights are protected to have a family without being limited by certain parties. AbstractConsuming halal and safe food products is a constitutional right of citizens. This right is realized through guarantee of halal products, the institution authorized to issue fatwa halla on a product is LPPOM MUI. The results showed that LPPOM MUI issued a halal certificate for a product after previously going through a trial process at the MUI Fatwa Commission. Although judicially the position of MUI is not a state institution, the presence of the MUI, especially LPPOM MUI, can answer the needs of the community. Halal certificates from LPPOM MUI can at least provide legal certainty for the community. Abroad, halal certification institutions are government or private institutions that have their own statutory regulations and standards.AbstrakMengkonsumsi produk pangan halal dan aman merupakan hak konstitusional warga negara. Hak tersebut diwujudkan melalui jaminan produk halal, lembaga yang berwenang mengeluarkan fatwa halla atas suau produk adalah LPPOM MUI. Hasil penelitian menunjukkan bahwa LPPOM MUI mengeluarkan sertifikat halal atas suatu produk setelah sebelumnya melalui proses sidang di Komisi Fatwa MUI. Meskipun secara yuridis kedudukan MUI bukan merupakan lembaga negara, namun kehadiran MUI, terutama LPPOM MUI, bisa menjawab kebutuhan masyarakat. Sertifikat halal dari LPPOM MUI setidakya bisa memberikan kepastian hukum bagi masyarakat. Di luar negeri, lembaga sertifikasi halal merupakan lembaga pemerintah atau swasta yang memiliki perundang-undangan dan standar resmi tersendiri.

Political Corruption: Harm to State Foundations and Public Interests

The problem of political corruption is quite acute for all countries. Often, methods to counter this phenomenon are not effective. Sometimes, this happens because of the specifics of political corruption: it is practically legitimate in the view of citizens. Society perceives it as a "necessary" element of the political struggle. At the same time, it undermines the democratic the basic foundations of the state, leads to the fact that constitutional rights of citizens become only declarative. This is even more dangerous as only few subject categories are involved in corruption offenses, thus it is “latent” and not obvious to most citizens.
 
 In this regard, it is necessary to make a complex comprehensive analysis of the types of manifestations of political corruption, determine their essence and identify corruption risks.

Система освіти покликана сприяти реалізації основних завдань соціально-економічного і культурного розвитку країни. В статті проаналізовано сучасний стан цієї галузі, місце та її значення в економіці України. Виявлено основні проблеми, які стосуються фахових компетентностей, фінансового забезпечення, недосконалості законодавчої бази та державного регулювання освітньої сфери. Визначено основні напрями державного управління в умовах реформування освіти. 
 Показано що освіта - одна з найважливіших областей, які держава підтримує створенням умов для її розвитку. Україна запроваджує реформу освіти, яка може змінити якість освітніх послуг, ставлення до престижу педагогічної та наукової діяльності. Проте, в контексті реформ, існує проблема в управлінні цією сферою, оскільки необхідно реагувати на виклики для її вдосконалення. Система освіти є невід'ємною складовою духовності, яка готує молодь до життя на основі їх знань у дошкільних, середніх, професійно-технічних та вищих навчальних закладах. Згідно зі статтею 5 Закону України «Про освіту», освіта є державним пріоритетом, який забезпечує інноваційний, соціальний, економічний та культурний розвиток суспільства. Фінансування освіти - це інвестиції в людський потенціал, сталий розвиток суспільства і держави.
 Наголошено та тому що одним з пріоритетних напрямків є реформа економічних основ системи освіти, яка має бути спрямована на створення прозорих фінансово-економічних механізмів цілеспрямованого накопичення та цільового використання коштів, необхідних для повного здійснення конституційних прав громадян на освіту.

 Запропонована реформа освіти та науки України передбачає зміни, які наблизять її до європейських стандартів, значно підвищать конкурентоспроможність, а також дадуть можливість децентралізації її управління.

GROUNDS FOR IMPLEMENTATION OF INVESTIGATIVE ACTIVITIES — A GUARANTEE OF THE CONSTITUTIONAL RIGHTS OF CITIZENS INVOLVED IN THE SCOPE OF INVESTIGATIVE ACTIVITIES

The article reveals the essence of the «grounds» for conducting investigative activities — the most important guarantor of ensuring the constitutional rights of citizens involved in the field of such activities. Taking into account the analysis of legal literature, the most acceptable approach to the division of the grounds for conducting investigative activities into «actual» and «formal» (legal) grounds is highlighted. It is noted that in some cases, investigative activities can be carried out only if there are factual grounds, but with the mandatory registration of legal grounds in the future, after the implementation of such activities. The position is substantiated that certain circumstances that have been revealed experimentally — by operational and investigative practice — and are typical circumstances preceding, accompanying, or following a crime, can be considered as grounds for conducting investigative measures. The author’s position on what should be understood by the «grounds» for conducting investigative activities is highlighted.

AKSESIBILITAS PERLINDUNGAN HUKUM BAGI TENAGA KERJA PENYANDANG DISABILITAS DI KABUPATEN KARAWANG

Accessibility legal protection for every citizen to get a job is a fundamentalism as fundamental right in Indonesia. Karawang district has number persons with disabilities in 2016 to 6,237. The purpose research to analyze the legal protection of workers for persons with disabilities. The normative juridical research method carried out with a statutory approach the aim of the study providing more descriptive. The research result confirms lack of fulfillment the rights of persons with disabilities in employment with consequent yet to regulated the constitutional rights of citizens in Karawang Regulation can be applied to ensure the protection of the law.

Determinants of Right of Access to Information (R-ATI): Application-Status based Select Case Analyses from Ministry of External Affairs (MEA), Government of India

For good governance to exist in both theory and practice, citizens must be empowered to participate in meaningful ways in decision-making processes. The Participants of democratic India i.e. citizens, have a right to know “what, how and why” of any decision, changes or continuity regarding its functioning. Right to Information (RTI) is a constitutional right of citizens guaranteed as per articles 19 and 21 of the constitution of India that was enacted in the Indian Parliament in 2005. On the one hand, access to information remains a hindrance to citizen participation in the so-called Information Society, while on the other the rights to such information is not guaranteed absolute as a constitutional aspect. This research is an attempt to examine the determinants of R-ATI in the purview of information society. Focal elements of this study will help to analyse various parameters that constitute R-ATI for good governance in terms of: a. Transparency b. Accountability c. Information provision: Disclosure & non-disclosure d. Awareness e. Active citizen participation f. Info processing cycle g. Citizen empowerment A descriptive investigation action into the relevance of the above-stated parameters through a detailed analysis of various theoretical underpinnings to observe the dissemination of information to the public by the government reasonably, without causing any political instability as the provision of information is a national asset of a country like India. This is in congruence with the RTI Act 2005 that provides means to secure access to information from a public authority. A few cases will be analyzed in this regard to correlating this theoretical concept. Further investigation will examine factors hampering free flow of information that will address issues pertaining to “access to information” and “access to know”. Conceptual approaches in Information Access will provide a methodological basis to criticality assessment of various concepts of Information Ethics as examined by various scholars in this domain. Demonstrating the use of Information Access provision by citizens and dissemination by authorities constitutes the conceptual framework of this study to explore the interrelationship between determinants and factors constituting the access to guarantee the Right to Information to the public. An infocommunication model of R-ATI is, hence, proposed and intertwined with the conceptual framing of the select parameters or variables under investigation.

Accessibility of Persons with Disabilities in Realizing Elections with Integrity

The right to vote and be elected is a constitutional right of citizens who are recognized as part of the rights to the same position in law and government. Elections are a very important momentum, in fact, the Election still often raises problems for persons with disabilities. Persons with disabilities are a group of persons with disabilities who most need special facilities so that they can choose independently so they can fulfill the principle of elections, namely Direct, General, Free and Confidential and Honest and Fair. So that the political rights of persons with disabilities have not been maximally fulfilled through the provision of accessibility in elections for them. This research is normative legal research. By using several methods of approach, namely: Legislative approach (statute approach), conceptual approach (conceptual approach), case approach (case approach). The results of the study show that the provision of accessibility space, not only on the momentum of giving rights (giving ballots to be tested) to persons with disabilities on voting days and hours in elections but giving accessibility to persons with disabilities in elections was given since the stages of election implementation were echoed. Ideally, Disabled Persons must have access as election organizers as well as election participants. The accessibility of persons with disabilities should not only be given to access rights as voters on the day and time of voting.

Protection of Homeowners in Russia from Unlawful Encroachment on Their Rights and Legitimate Interests

The relevance of the study is due to the fact that with the initiation of the new Housing Code of the Russian Federation the situation with the provision of housing rights has not radically changed for the better. In this context, the article aims to analyze the features of civil-legal regulation of housing relations, ensuring the constitutional rights of citizens to housing, ways of committing offenses in the sphere of residential properties and their preventive actions, the problem of improving the legislation. Leading approach to the study of this problem is the descriptive method that has afforded revealing peculiarities of regulation of civil and housing legislation under consideration within Russian Federation. In the article the suggestions for improving the legislation of Russian Federation are presented. The materials of the paper imply the practical significance for the university teachers of the legal specializations.

Государственное радиовещание в России: тренд на потерю влияния

В статье рассматриваются проблемы развития федерального государственного радиовещания на примере радиостанций «Радио России» и «Маяк», являющихся структурными подразделениями Всероссийской государственной телевизионной и радиовещательной компании (ВГТРК). Накопленные данные исследований позволяют увидеть, что радиостанции ВГТРК за последние 22 года потеряли лидирующие позиции в России. Доля аудитории на общероссийском уровне с 1996 г. по 2018 г. снизилась: у «Радио России» с 27% до 5,8%, у «Маяка» — с 26% до 3,1%. И если в 1996 г. две станции занимали, соответственно, первое и второе места по величине доли аудитории, то в 2018 г. «Радио России» было лишь на шестом месте, а «Маяк» — на двенадцатом. Основная причина — недостаточное внимание руководства радиостанций к техническому распространению сигнала. В 1996 г. население России слушало радио преимущественно с помощью проводного радио и приемников, способных принимать средние и длинные волны. В 2018 г. подавляющее большинство российских радиослушателей использовало FM-диапазон, где государственные станции представлены слабо по сравнению с коммерческими станциями-лидерами. Возможностью приема «Радио России» и «Маяка» на проводном радио к 2018 г., оценочно, обладает всего лишь 12% российского населения, при том, что вещание на длинных волнах прекращено. Потери аудитории сопровождаются ослаблением силы бренда радиостанций, особо остро проявляющимся у «Радио России» — спонтанное знание радиостанции обнаруживают лишь 8,4% опрошенных (данные компании «Медиаскоп»). Для того, чтобы вернуть лидирующее положение, государственным радиостанциям необходимо обеспечить стопроцентное присутствие в FM-диапазоне хотя бы крупных и средних городов, в первую очередь в Москве. Если этого не сделать в ближайшее время, показатели аудитории будут продолжать снижаться. Потеря аудитории федеральными государственными радиостанциями несет в себе опасность для развития социально-политических процессов в России, поскольку именно благодаря государственным СМИ, в том числе радиостанциям, реализуется конституционное право граждан на получение информации и доступ к культурным ценностям, выполняются законодательно установленные функции освещения деятельности органов государственной власти и агитация за кандидатов и политические партии во время предвыборных кампаний.

Improving the mechanism of implementation of effective employment policies at the regional level

State employment policy is the expression of the constitutional rights of citizens of a social state to the free use of their abilities for entrepreneurial and other economic activities, including the free disposal of their abilities to work and the choice of activities.
 The formation of a socially oriented market economy requires an interconnected active socio-economic policy not only at the republican, but also at the regional levels. The merit of many regional administrations was that, to the best of their abilities and because of their special proximity to the population and enterprises, they tried to reduce the negative social consequences of crisis phenomena in the economy. The article discusses the main directions of implementation of the state policy of the Republic of Kazakhstan in the field of employment promotion. The article also discusses the problematic aspects of the implementation of this policy and made recommendations for improving the state economic policy in the context of increasing the general level of employment and fighting unemployment.

Rights and freedoms in information and communication activities of a modern human

The urgency of studying the problems of rights and freedoms in the information and communication activities of modern humans is determined by the fact that they exist due to the spread of all new knowledge through the growing functionality of digital information and communication technologies and information processing systems. It begins to rethink the role and significance of the country's information resource. At the same time, the very concept of "information" from the category, which for centuries characterized the system of knowledge, is transforming. The purpose of the study is the conceptualization of rights and freedoms in the information and communication activities of a modern person, which is conditioned by the dissemination of new knowledge through the use of functional capabilities of digital information and communication technologies and information processing systems. Tasks of the research: analysis of technological, ideological and legal problems of the global information and communication space; definition of the conceptual-categorical apparatus of the research - "information", "knowledge", "information security", "jurisdiction of states in the conditions of globalization", "monopolization of legal force" and their influence on the development of information and communication activities of society; formation of the directions of increase of the state information and communication activity of Ukraine for realization of constitutional rights of citizens; consider information law as a science, which allows a new way to consider communication processes that have infocommunication technological horizontals and based on the understanding of the resource of knowledge. «ON-LINE SUPPORT» SYSTEMS AS A COMPONENT OF STRATEGY OF REFORMATION OF HIGHER EDUCATION

The work is devoted to the study of the impact of the use of automated bots of consultants in making managerial decisions on improving the efficiency of management in higher education institutions in the conditions of reform.The current conditions for the reform of higher education in Ukraine are analyzed and directions of integration in the world educational process are determined. Higher education reform is to consume the constitutional rights of citizens to high-quality higher education and equal access to high-quality higher education, reorganization of the system of higher education management in order to protect the national, regional and local interests, as well as the interests of all subjects of the national system of higher education of Ukraine. It is established that the development of application of automated control systems in educational institutions abroad is becoming. One of the varieties of this is the CRM-system. It is recommended to apply the above-mentioned approach in higher education institutions in Ukraine. It is proposed to use the work of the CRM-system in higher education institutions of Ukraine, which involves the introduction of automated systems of "on-line support" for the adoption of administrative decisions by the administration on the basis of the attraction and processing of information that covers the issues of financial and economic, legal and social activities of the educational institution and promotes increase its competitiveness in conditions of integration reform. The essence of the notion of the main stakeholder of a higher educational institution is defined. The introduction of a flexible automated system of material incentives in higher education institutions is recommended. It is determined that the use of innovative technologies in the work of the CRM system should ensure transparency, increase the level of employee satisfaction and prevent absenteeism.

Reform of participation in shared construction as a condition for urban development

The article deals with the issues of reforming the institution of shared construction. The relevance of the research topic is determined, firstly, by the special social role of the institution of shared construction in providing citizens with housing, and secondly, by the currently implemented large-scale reform of this institution, requiring systematic scientific reflection. The reasons for appearance and main directions of development of this institution from the moment of its appearance, its influence on the realization of the constitutional rights of citizens are shown. The ambiguity of the legal qualification of this treaty is noted as one of the causes of problems in law enforcement practice. An important area of research is analysis of regulatory framework for reform of institution of participation in shared construction and related (providing) economic and legal institutions (deposit insurance system, escrow agreement, etc.). The legal regulation of contractual basis of the formed project financing system is subject to the detailed analysis. The study allows formulating a number of conclusions about the role of reform of shared construction in the development of cities.
