Abstract
The study seeks to analyze the regulatory epistemology of Complementary Law n. 142, of December 16, 2021 (Pará, 2021), from the perspective of the problem of the lack of regulation of the Social Protection System of the Military of the State of Pará, which affects the processing of the Special Military Pension (PME), causing a delay that takes from 03 (three) to 04 (four) years for its granting to its dependents. The aim is to uncover the dysfunctions of the system in question and objectively demonstrate the search for the Judiciary to guarantee the right to the granting of the indemnity pension as a way of filling in the gaps and ambiguities present in the legislation. The research is carried out using the inductive method, documents and empirical and secondary fieldwork, backed up with data, as well as a bibliographical review. The work reveals that the legislation researched, referring to the PME, lacks prompt regulation, which could be carried out by means of a Regulatory Decree by the Head of the State Executive Branch, which would make the processing of the PME faster and more effective, thus fulfilling its social function for the families of police officers killed in the service of the State of Pará.
