Abstract

Civil juries are under heavy attack. The critics allege that juries are capricious, biased toward plaintiffs, unpredictable, and overgenerous in their verdicts. They find juries often incompetent to pass judgment on issues brought before them, particularly in complex cases such as medical malpractice and products liability. Further, the critics claim that jury trials add to the already crippling delays and backlogs plaguing the American court system.
