Abstract

In the presented study, the author raised the issue of the possibility of a handwriting expert’s opinion on the assessment of the testator’s state of mind. Considerations in this regard included e.g. determining the scope of the expert opinion by the judicial authorities, issues related to the testator’s awareness and freedom to make decisions and express will, and issuing an opinion by handwriting expert on the presence of pathological deformities in the testator’s handwriting. The article draws attention to the erroneous appointment of handwriting experts by judicial authorities to issue an opinion on the testator’s ability to draw up a valid testament.
