Abstract

ABSTRACT The National Heritage Act 2005 (NHA 2005) is an important act supporting the enforcement of acts related to underwater cultural heritage in Malaysia. The issue of theft of artifacts in the area of the shipwreck site is one of the important issues that must be addressed by tightening the enforcement aspect. This paper aims to analyze the legal provisions related to the enforcement of the sinking site area in the National Heritage Act 2005. This paper also intends to recommend a proposed solution to the identified issues. This paper is based on a qualitative approach – data collection through an interview method with respondents with 10 years or more experience in shipwrecks. The data obtained were analyzed through thematic analysis methods.
