Abstract

This article analyzes the subjective side of the crime of excess of power or of exceeding the attributions of service in the criminal law of the Republic of Moldova, identified through the signs and legal content of criminal guilt, the purpose and motive (motive) of the crime, in order to provide clarity and remove ambiguities in the process of applying to law enforcement agencies, including potential perpetrators of such crimes. An important emphasis is placed on guilt, which is a subjective sign through which the subjective side is identified and carries an essential and binding character, and in this sense, the crime of excess of power or of exceeding the attributions of service can only be found in the limits of a material component of the crime.
