Abstract

This article discusses some points of the rational theory of traditions proposed by the Scottish philosopher Alasdair MacIntyre, who lives in the US. In this context, it focuses on the relation between rational theory of traditions and judicial process, in the sense of seeking procedural objectivity, without denying the infl uence of traditions on judicial decisions.Key words: MacIntyre, reason, morals, materialism, formalism, process.
