Abstract
The paper describes a group of dispute resolution mechanisms introduced in the Health Care Reform known as AUGE. The reform included forms of mediation and arbitration that currently represents an important part of the total civil litigation in Chile. The article explores some problems that those alternative mechanisms could create. The most important issue is that the Chilean state do not recognize the importance of a civil justice system and the possible loss of some of its values, especially those relate with the transparency of is operation.

En el caso del sistema de salud, los mecanismos creados, mediación y arbitraje, corresponden a fórmulas que tradicionalmente se pueden situar fuera o dentro del aparato estatal, pero son ejecutadas por personas que no pertenecen a él. Pero además de la descripción de los mecanismos de resolución de conflictos creados por las leyes de reforma del sistema de salud, pretendemos iniciar una discusión acerca de las ventajas y problemas que este tipo de soluciones pueden acarrear, con el fin de contar con algunas herramientas analíticas que permitan evaluar las diversas fórmulas de política pública para la solución de conflictos que se han ido implementando en el país, y que se continuaran incorporando. Hemos podido revisar las actas de varios procesos 45 de arbitraje y hemos dado seguimiento a varios casos abordados por las diversas formas de solución de conflictos que se describen
