Abstract
SISTEMA PENITENCIARIO NACIONAL E A INEFICIENCIA ESTATAL: UMA POSSIBILIDADE DE PARCEIRA PUBLICO-PRIVADO Resumo: Tema deste artigo e estudar a viabilidade da descentralizacao para a iniciativa privada do sistema penitenciario, sob a luz dos direitos fundamentais e do principio da eficiencia. O objetivo geral e tracar licoes propedeuticas sobre o instituto da Parceira Publico-Privado (PPP), correlacionando-o com o sistema carcerario nacional. O objetivo especifico e demonstrar que as PPP´s pode se tornar uma importante ferramenta para afastar a incompletude e ineficiencia da prestacao do servico publico penitenciario, pois diante do cenario nefasto que permeia o sistema carcerario nacional, o Estado nao pode quedar-se inerte, devendo prestar o servico publico de modo satisfatorio ou delega-lo para a iniciativa privada, garantindo direitos fundamentais e a efetivacao do principio da eficiencia. Sera utilizado procedimento bibliografico e documental, por meio de um metodo dedutivo e com uma abordagem qualitativa. Palavras-chaves: Parceria Publico-Privado. Descentralizacao. NATIONAL PENITENTIARY SYSTEM AND STATE INEFFICIENCY: A POSSIBILITY OF A PUBLIC-PRIVATE Abstract: Theme of this article is to study the feasibility of decentralization for the private sector in the prison system, in the light of fundamental rights and the principle of efficiency.. The general objective is to draw up propaedeutic lessons about the Public-Private Partner PPP institute, correlating it with the national prison system. The specific objective is to demonstrate that PPPs can become an important tool to eliminate the incompleteness and inefficiency of the provision of the public penitentiary service, because in view of the nefarious scenario that permeates the national prison system, the State can not remain inert, must provide the public service guaranteeing fundamental rights and the effectiveness of the principle of efficiency.
