Abstract
MAIOR EFICIENCIA NA INVESTIGACAO CRIMINAL PREVISTA NA LEI ANTICRIME E SUA CONSTITUCIONALIDADE Resumo: A lei no 13.964, de 24 de dezembro de 2019 (lei anticrime), provoca mudancas significativas no direito processual penal e no direito penal brasileiro. O presente estudo verifica se o monitoramento de audio e video nos estabelecimentos penais de seguranca maxima aperfeicoa a investigacao criminal. Questao controversa e se a fiscalizacao estatal ofende o direito a privacidade dos presos e se viola as prerrogativas funcionais dos advogados. Por ultimo, resta saber se tais alteracoes legislativas compatibilizam-se com a Constituicao Federal e com direitos humanos. Ao final do trabalho, entende-se que as alteracoes processuais e penais robustecem os mecanismos de investigacao criminal na luta contra criminalidade, sendo consentâneas com a Carta Magna e com normas internacionais. GREATER EFFICIENCY IN CRIMINAL INVESTIGATION PROVIDED FOR IN THE ANTICRIME LAW AND ITS CONSTITUTIONALITY Abstract: Law no 13.964, of december 24, 2019 (anti-crime law), causes significant changes in criminal procedural law and Brazilian criminal law. The present study verifies whether the monitoring of audio and video in maximum security criminal establishments improves criminal investigation. A controversial issue is whether state enforcement offends prisoners 'right to privacy and violates lawyers' functional prerogatives. Finally, it remains to be seen whether such legislative changes are compatible with the Federal Constitution and human rights. At the end of the work, it is understood that procedural and criminal changes strengthen the mechanisms of criminal investigation in the fight against crime, being in line with the Constitution and international standards.
