Abstract
The institution of resumption the proceedings is an extraordinary means of verifying the decisions made in military disciplinary proceedings. Its essence consists in the rehearing and resolving of a disciplinary case that has been completed and not appealable under the ordinary procedure, if the proceedings were affected by a qualified legal defect. The main function of the resumption procedure is to protect the rule of law in the structures of the Polish Armed Forces and the vital interests of punished soldiers and/or their families.
