Abstract
Wrongful death caused by traffic accidents in Ecuador is that type of crime committed by action, in which the objective duty of care is violated and as a result, the right to life is affected as a legally protected good. This article aims to analyze the trial procedure in cases of wrongful deaths due to traffic accidents in the city of Ambato, Ecuador, according to the Integral Penal Code, COIP. For this, a qualitative methodology was applied, through the analytical-synthetic and inductive methods, and, as a scientific result, it was obtained that in the Ambato canton, in the year 2021, there was the substantiation of wrongful death, by direct and ordinary procedure, with the exceptions of applicability in case of affecting the right to life, or personal integrity, concluding that the substantiation of this type of criminal offense causes a violation of the right, due process, legal security, and judicial protection effective. Regarding the results, the analysis generates what have been the main causes of wrongful death, among them: the transgression of the traffic regulations, lack of skill, negligence, imprudence and non-observance of the accused.
