Abstract

Contemporaneously is questioned in a profound way as an eternal, universal and timeless problem of justice and judges. It calls for a “more human” view by the main protagonist of the judicial drama and its function. The different attitudes evaluation that may take a judge in contemporary society, overcoming the traditional model that conceived it only as a passive subject, an inanimate spokesman of the general will, called “judicial activism” that tries to respond to real and concrete demands of a global, democratic, opened, pluralistic, dynamic and participatory society.
