Abstract

The establishment of a Job Loss Security Program in The Stipulation of a Government Regulation in Lieu of Law Number 2 Year 2022 concerning Job Creation provides protection for worker/laborer who have experienced the severence of an employment relationship. This form of protection is in Convention 102 and Convention 168 of the International Labor Organization namely Unemployment Benefits. The Unemployment Benefit scheme in Indonesia is implemented through the Job Loss Security Program. In its arrangement, the Job Loss Security Program only provides protection to wage recipient workers participant. Unemployment Benefits Protection for non-wage recipient workers participan is still not covered because of the regulatory restrictions that receive benefits from the Job Loss Security Program only to worker/laborer who have experienced the severence of an employment relationship. This research method is a descriptive normative juridical method. This research shows that the existing regulations in the a quo regulations only provide partial protection. Non-wage recipient workers participants such as entrepreneurs, self-employed workers, and informal workers do not get access to program benefits due to regulatory limitations. Other countries such as Spain, Serbia, and the People's Republic of China, and others have previously implemented mandatory or voluntary unemployment benefit schemes. The urgency of protecting Social Security for Unemployment Benefits through the Job Loss Security Program is important as a form of state protection for the whole society.
