Abstract
Central to any union prevention strategy is the election. Of course, employers seek to avoid representation petitions in the first place. However, once a petition is filed, a secret ballot election is the employer's last opportunity to win the hearts and minds of employees. Unions know that as well, which is why they routinely seek to have an election conducted as quickly as possible after the filing of a petition. Minimizing the amount of time that an employer can honestly and lawfully educate employees on the true meaning of unionization is a significant element of a union campaign. Unlike employers, unions can lawfully make empty promises and various threats, as well as interrogate and engage in surveillance, and they are under no obligation to tell employees the truth while attempting to build support. It should come as no surprise that pro‐union interests want to cut the time an employer will have to respond.
