Abstract

Abstrak:Penelitian ini bertujuan untuk menggagas desain kelembagaan partai politik di Indonesia. Penelitian ini merupakan penelitian yuridis empiris dengan menggunakan pendekatan sosiological jurisprudence. Sosiological jurisprudence merupakan pendekatan yang melihat hukum sebagai suatu fenomena sosial, di mana perspektifnya berasal dari masyarakat. Penelitian ini menemukan bahwa sistem multi partai yang selama ini diterapkan di Indonesia menimbulkan banyak masalah seperti adanya konflik antar partai politik, konflik internal partai, sistem rekrutmen partai yang tidak jelas dan mencerminkan praktik nepotisme, serta munculnya dinasti politik di kalangan partai politik. Praktik tersebut mampu menggerus nilai-nilai demokrasi serta menurunkan kepercayaan masyarakat terhadap keberadaan partai politik. Berdasarkan hal tersebut, pemerintah perlu mempertimbangkan untuk menerapkan sistem dwi partai. Sistem ini dianggap mampu untuk menjamin adanya check and balance serta menjaga stabilitas politik karena ada perbedaan yang jelas antara partai pemerintah dan partai oposisi.Kata Kunci: Desain Kelembagaan; Partai Politik; Indonesia.
 Abstract:This research aims to investigate the institutional design of political parties in Indonesia. This research is empirical juridical research using a sociological jurisprudence approach. Sociological jurisprudence is an approach that sees law as a social phenomenon, where the perspective comes from society. This research found that the multi-party system implemented in Indonesia has caused many problems, such as conflicts between political parties, internal party conflicts, a party recruitment system that needs to be clarified and reflects the practice of nepotism, and the emergence of political dynasties among political parties. This practice is capable of eroding democratic values and reducing public confidence in the existence of political parties. Based on this, the government needs to consider implementing a dual-party system. This system is considered capable of ensuring checks and balances and maintaining political stability because there are apparent differences between government and opposition parties.Keywords: Institutional Design; Political Parties; Indonesia.
