Abstract

Statute of the judges and justice organization are present time issues in several Countries of Europe. The article describes the evolution of the Italian system and the broken course to guarantee independence of magistrate and quality of the justice from the birth of the Republic to the reform of the Berlusconi government to the hopes, up to now disappointed, dependent on the change of the parliamentary majority. Separation of the careers or the functions, guarantees of independence for the prosecuting attorney, career profile, civil and disciplinary liability for the judge or prosecutor in their quality of authors of a judicial decision, evaluations of professionalism: these are the tackled questions. They are the same problems to which French magistrate must face. From here the interest to know how they were solved in a very close Country.
