Abstract

In Italy and in Germany, the concept of jus commune has got in recent legal history an importance broadly underestimated in France. The study of the common jurisprudence in Europe between 1100 and 1800 has been associated with critics about codification and projects of a new European Law. However the meaning of this jus commune is very controversial : did a unified complex of norms really exist in Europe during the Middle Ages and the Ancien Regime that national codes have broken ? This article tries to present the historiography of this debate and to suggest that the research of common features in the European legal past is more relevant thon the nostalgia of a lost and imaginary unity.
