Abstract

In modern legislation there are many legal illusions, arising both systematically, for the development of society and the state, and spontaneously as reactionary measures to certain social circumstances (pandemic, sanctions). There are also legal illusions in labor law. Identification and classification of legal illusions will improve labor legislation. The article defines the role of legal illusion as an element that constitutes a new social reality. The key doctrinal approaches to the understanding of legal illusion are analyzed. It is proposed to distinguish target illusions, which in turn are divided into illusions and simulacra. Legal simulacra in the process of implementation entail distortion of legal reality, conflicts and violations of the rights of participants of social relations. The implementation of certain provisions of the Labor Code of the Russian Federation is considered as examples of legal illusions and simulacra.
