Abstract

Abstract The USA is struggling to adjust its national export control system to focus on 21st century security threats and commercial trends. The existing US export control regime has had a severe impact on US industry. The result is that the US market share in the commercial satellite-manufacturing sector has declined and this downturn has given an edge to European manufacturers. This situation gives Europe a unique opportunity to increase the relevance of European firms in the global commercial space marketplace, as long as it has a coherent export control policy supported by an effective legal framework. Unfortunately, the current situation in Europe is one of disharmony. This viewpoint identifies the effectiveness of the existing system and ponders the possibilities of mediating the existing political gaps by employing organisational theory and legal instruments, tools which are currently almost absent.
