Abstract
A Constituição Federal de 1988 foi estruturada em torno do paradigma do Estado Democrático de Direito, com o que inseriu o Brasil em uma nova dimensão do constitucionalismo. A expressão inserida no artigo 1º, contudo, traduz um sistema complexo de conceitos e propostas transformadoras, cuja implementação vem sendo tentada em diferentes países há tempos, com sucesso apenas relativo. A democracia radical desejada no pós-Segunda Guerra deu origem a uma ampla revisão das estruturas e fins do Estado, o que permitiu avanços sociais significativos. Porém, o tempo todo o modelo se viu contestado, realidade que se agravou no início do Século XXI, momento em que se alarga a opção por medidas de força como resposta a diferentes crises, com a consequente fragilização de direitos fundamentais e do cânone democrático, no que se denomina de estado de exceção permanente.
