Abstract

The article contains a scientific study in the field of the position of ensuring the constitutionally guaranteed fundamental rights and freedoms, which are essential for the free development of the human personality within the society organized in the state. And their real insurance with guaranteed rights constitutes the foundation of the society, which in fact is absent. In the given article we will elucidate both the organic connection between the guaranteed right and the insured right, that is, the complex unity of the phenomenon as well as the fullness of the normative regulations, through the prism of approaches to the doctrine in the specialized literature. Annotation It should be included that in the current concept and practice of the contemporary human community, the rule of law and democracy through the prism of authenticity, is the one in which the dignity of man, his rights and freedoms, the free development of the human personality represent supreme values and are guaranteed by art. 1 paragraph (3) of the Constitution of the Republic of Moldova.
