Abstract

The present research aims to reflect on the accountability of the payment of expert fees and sucumbencial sums applicable to workers benefiting from free justice, and the violation of constitutional principles, especially that of access to justice. This is because in these restrictions imposed by the new articles brought with Law 13467/2017, which came into force in November 2017 may contain in itself the annihilation of the only way these citizens have to see their social rights guaranteed labor, whose subject is being discussed in the Federal Supreme Court through ADI 5766. It was pointed out that by restricting access to justice, in addition to unconstitutionally encumbering labor proceedings, a High Court response is sought in order to bring a consistent interpretation to trim the edges brought by the labor reform or better known as "labor deformation
