Abstract

The purpose of this chapter is to consider ineffective assistance of counsel issues—aka “bad lawyering”—and their relationship to miscarriages of justice. This begins with a discussion of the right to effective counsel, as well as the structure and function of the criminal defense community. It concludes with a review of IAC issues, both before and during the trial process.
