Abstract

ANALYSIS OF THE PLEA BARGAIN IN THE BRAZILIAN BARGAINED CRIMINAL JUSTICE FROM THE PERSPECTIVE OF THE LAW PROJECTS 882/19 AND 8.045/2010                RESUMO: Este trabalho analisa a possibilidade de implementar o instituto do plea bargain na justiça negocial criminal brasileira. Sua problemática consiste em estudar sobre a (in)constitucionalidade do acordo penal proposto pelos Projetos de Leis nº 882/19 e 8.045/10. Seu objetivo é examinar as violações aos princípios processuais penais constitucionais e em buscar uma redação legislativa que coadune com o Estado democrático de direito. O método utilizado consiste no lógico dedutivo, baseando-se, principalmente, em literatura especializada, artigos científicos, dissertações e teses. Conclui-se que o plea bargain para ser implementado no ordenamento jurídico brasileiro precisa ser adaptado para que os direitos e garantias individuais não sejam aviltados a ponto de que a negociação seja realizada de forma unilateral.PALAVRAS-CHAVE: barganha; negociação; penal; princípiosABSTRACT: This paper analyzes the possibility to implement the rule of plea bargain in the Brazilian Bargained Criminal Justice. Your issue consists in studying the (un)constitutionality of the criminal agreement proposed by the Law Projects 882/19 and 8.045/10. Your goal is to examine the violations of the constitutional criminal procedural principles and seek a legislative writing that reconciles with the Democratic State. It was used the logic deductive method, mainly based on specialized literature, scientific articles, dissertations and thesis.
