A EVOLUÇÃO DA IDÉIA DE IGUALDADE: A efetivação de seu conteúdo no paradigma do Estado Democrático de Direito

Abstract

This article targets the discussion on the extension presented by the concept of equality’s through the time. To do so, we discuss the attempt of revealing the sense of “thing in itself” abandonment. This attempt was overcome by seeking a phenomenological interpretation, taking as a starting hermeneutic point the theory of the constitutional paradigms. We also present the importance of the affirmative actions’ policies as an effective way to materialize the substantial equality in Constitution, under the basis of the Democratic Rule-of-Law State’s paradigm.
